Extractions: State Employment Issues Univ. of Alabama v. Garrett Has your school district announced that the Americans with Disabilities Act has been found unconstitutional? Wrong. But a case decided February 21, 2001 by the U.S. Supreme Court said basically that a state employee cannot sue their state employer for money damages under Title I of the ADA, the Act's Employment Section, because the Eleventh Amendment provides immunity. The fact that the University of Alabama was involved sounds like it is an education case, but it is not. It is an employment case. First, what does this decision not do? It does not prevent a parent from using the ADA in any of the advocacy steps that we describe in our Manuals, Newsletters and Conferences. It does not prevent a parent from suing a local school district (not a state education agency) under the ADA. It does not prevent a parent from suing the state education agency under Title II of the ADA, Public Services.
