Any comments on the paper may be emailed to the authors at: BLethics@law.uts.edu.au Contents On two previous occasions papers have been presented to the Law in Non-Law Schools Interest Group of the Association of Australasian Law Schools (now called "ALTA") drawing a comparison between teaching law to non-law school students particularly with regard to the introductory "business law" subject from 1973 to the present day. On the first occasion in a paper presented to this same group at the ALTA Conference held in Canberra at the ANU in 1990 entitled "Law in Non-Law Schools - The Future after the Pearce Committee" an attempt was made to draw a comparison between the publicity which had been given to statements which the Pearce Report had made regarding the perceived quality of individual law schools and the neglect of that part of the Report - "Chapter 7 - Teaching Law to Non-Law Students". As an illustration of what was perceived to be the approach towards the teaching of law to non-law schools prior to the round of universities and colleges of advanced education (CAE) mergers during the Dawkins period of 1989-91. From the Pearce Report comes the following relevant extracts were quoted:
Networking Skills Career Strategies for Making Effective personal Contacts, Cynthia Talking Your Wayto business and Social 2001 ChicagoKent College of law, Illinois Institute http://www.kentlaw.edu/depts/cso/handout_networking.html
Extractions: Usually the term "networking" evokes anxiety in the hearts of all job seekers; especially when they feel they "know no one." However, it is often the anticipation of calling a contact or asking for a colleague's advice that is more anxiety-provoking than the actual meeting itself. Networking is simply the act of obtaining information and increasing your contact base through informational sessions with other professionals. Just as your opinion about Chicago-Kent may be solicited by a prospective student, so do practitioners expect questions from current law students about their practice area, employer, or other issues related to the field of law. Networking can take place in a variety of settings and contacts may be persons with whom you have either a professional or personal relationship. It is often easier to start with people you already know: friends, family, classmates, former employers/colleagues, etc. so that you feel more comfortable talking with them about your current situation and career goals. It is important to ask "Who else do you suggest I talk with?" so that you can expand your list of contacts as you progress in your job search. In addition to personal contacts, identify potential people to contact from relevant institutions or organizations. Following are suggested sources:

He was 91. The founder of a powerhouse law firm dedicated to representing people injured and wronged, Boccardo was a South Bay institution since the 1930s, amassing a real estate fortune to go along with his legal empire. Boccardo's renowned law firm survived for decades, despite being embroiled in frequent financial spats with former partners who fought the legal patriarch over clients and money. Boccardo's son, John, said his father's health was failing in recent weeks and he ``died of old age.'' But Boccardo said his father had remained fairly active since retiring in 1997, going out to breakfast and lunch, occasionally consulting with lawyers and spending time with Lorraine Boccardo, his wife of 65 years.

Extractions: 1991 No. 8 December Table of contents Lawyers in Business Conflicts Principles Approved After studies, debates, drafts and re-drafts that stretch back almost 20 years, the Benchers have now approved seven principles that will lead to a new business conflicts ruling in the Professional Conduct Handbook Law Society committees studying business conflicts over the past decade have recognized that a lawyer may act as a legal advisor or a business partner, but not both. Yet translating this concept into specific principles and rulings has proved difficult. A special committee chaired by William Ireland, Q.C. of Vancouver prepared a preliminary draft ruling on conflicts arising out of lawyers' business relationships with clients in 1985. This was reviewed and sent back for revision by the Benchers. The re-draft was circulated to members for comment in early 1987, [February, 1987 Benchers' Bulletin ]. Some lawyers at the Annual Meeting that year criticized the proposed rulings as too broad and almost enforceable, especially in smaller communities where some of the provisions were contrary to accepted practice. The ruling was also criticized for extending to lawyers' affiliates and associates. The pivotal business conflicts ruling B/9(b) of the Professional Conduct Handbook now states that "[n]o member shall act for a client where there is a possibility, no matter how remote, that his duty to his client conflicts with his personal interests." Other aspects are covered by Canons 3(2) and 3(7), and by Rulings B/8 (engaging in other business), B/13 (borrowing and investing), and B/14 (finders fees).

First, the Computer Abuse Act, Title 18 of the criminal code, section 1030 specifically, renders computer trespass (not the scan "rattling of doorknobs" but penetration, retrieval and/or damage) and destructive programs (worms, viruses, etc.) illegal. Second, the Electronic Communications Privacy Act (ECPA) establishes privacy of electronic communications at a standard similar to the wiretapping act of the late sixties. In short, the disclosure of any information by an Internet Service Provider to the public is actionable. Since Congress amended ECPA in 1994 to include wireless communications, "sniffing" (1) "Sniffing" is a slang term for interception of data communications. In telephonic communcations the analogous term is "tapping." I decided to contact the student, not as an employee of the university but as a regular person on my home computer and with my private e-mail address. I asked him to redact my name and that of another employee. He never did; it remains up today as I write. Now, if this is the worst incident to occur in my life I shall lead a charmed one indeed. Given its minor significance I present it as an example of an ethical question. In lieu of law, how do we, as citizens of the United States and of the world of Internet users, articulate an ethics of electronic media?
