Chang Ku-feng and a co-worker, Kao Chia Song, both employees of Jade Fortune International based on Taipei's historic Ti Hua Street, were sentenced along with their Cambodian interpreter, Phang Phoeung, to five years imprisonment and fines of US$500,000. Phoeung is still at large. "It won't be a problem ... I have an American passport," Chang said when asked about the possibility of some day being extradited to Cambodia. "The person I really feel sorry for is our interpreter ... it's very unfair." Chang and Kao traveled to Cambodia last December to finalize the details of the dumping of the FPC waste with Sam Moeun, owner of the Cambodian Muth Vuthy Import Co in Phnom Penh. Moeun was sentenced to seven months imprisonment on the same charge.

King Norodom Sihanouk remains the constitutional monarch and Head of State. Most power lies within the executive branch and, although its influence continues to grow within the coalition structure, the National Assembly does not provide a significant check to executive power. The Khmer Rouge no longer is a political or military threat. Source: U.S. Department of State The Cambodian court system consists of lower courts, an appeals court, and a Supreme Court. The Constitution also mandates a Constitutional Council, which is empowered to review the constitutionality of laws, and a Supreme Council of the Magistracy, which appoints, oversees, and disciplines judges. The composition of both of these bodies is viewed widely as biased toward the CPP. There is a separate military court system. Trials are public. Defendants have the right to be present and to consult with an attorney, to confront and question witnesses against them, and to present witnesses and evidence on their own behalf. However, trials typically are perfunctory, and extensive cross examination usually does not take place. In 1998 the introduction of newly trained lawyers, many of whom received supplemental training by NGO's, resulted in significant improvements for those defendants provided with counsel, including a reduced pretrial detention period and improved access to bail; however, there remained a critical shortage of trained lawyers in most parts of the countryespecially outside Phnom Penh.

Extractions: Press Review Archive Monday, 11 February, 2002 UN Leaves Killing Fields by our Internet desk, 11 February, 2002 The Cambodian Government is asking for international assistance in its efforts to bring former Khmer Rouge leaders to trial for genocide, following the sudden withdrawal of the United Nations from the trial process last week. Cambodian Prime Minister Hun Sen, himself a former Khmer Rouge officer, has described the UN withdrawal as a mistake similar to its official recognition of the Khmer Rouge government in the 1970s. Meanwhile diplomats have not given up hope that the UN could be drawn back to the trials of several high-level Khmer Rouge leaders, considered responsible for the "killing fields" genocide in Cambodia from 1975 to 1979. An estimated 1.7 million people died or were killed as a result of the revolution instigated by the Khmer Rouge. Cambodian Haste Raymond Feddema talking to Newsline's Robert Chesal 2'41" According to Raymond Feddema, Southeast Asia expert at the University of Amsterdam, the UN withdrawal was not completely unexpected. It had disagreed with the Cambodian government regarding the composition of the court, and what kind of power would be given to non-Cambodian judges. The issue had become crucial because "the Cambodian government and particularly Hun Sen are really in a hurry." The haste is due to the imminent legal problems regarding the incarceration of two senior Khmer Rouge leaders, who have been in prison almost three years and who will soon be released unless new law is drafted. These men are

In the Spotlight CRI Online News China Back to News Main Page China: Parties concerned should consult Cambodian Government on Trial of Former Khmer Rouge Leaders China says that consultions should be maintained with the Cambodian government in order to reach an agreement on bringing to trial former leaders of the Khmer Rouge. Foreign Ministry Spokeswoman, Zhang Qiyue, made the remarks in Beijing after an agreement failed to be reached during the New York meetings between Cambodia and the United Nations. The United Nations suspended talks in February, saying the main sticking point was Cambodia's insistence on having precedence over the United Nations in conducting the trials. The Cambodian government maintains that it wants to establish a special court within its judicial system to deal with the prosecution of crimes committed during the Democratic Kampuchea period, and has asked for assistance from the international community. China holds that Cambodia's stance should be understood and respected.
A Blind Eye To Justice In Cambodia The United Nations recently abandoned its negotiation with the cambodian governmentover establishing a tribunal for prosecuting Khmer Rouge leaders. http://web.mit.edu/phrj/publications/020327_washington_post.html
Extractions: A Blind Eye to Justice in Cambodia By Balakrishnan Rajagopal The United Nations, which has had a terrible record in dealing with Cambodia ever since the horrific Khmer Rouge revolution, has now added a new chapter to the sorry tale. The United Nations recently abandoned its negotiation with the Cambodian government over establishing a tribunal for prosecuting Khmer Rouge leaders. The reason offered was that it would be too difficult to guarantee observance of international standards of justice. Surprisingly, international human rights groups have greeted this act with approval, because of their fear that the proposed tribunal would not measure up to international standards. Both the United Nations and the human rights groups are wrong on this matter. And by overstating the importance of international standards of justice, they have missed a great opportunity to continue to pressure Cambodia to build a culture of accountability. The United Nations' unenviable record in dealing with Cambodia goes back more than a quarter-century. The world body ignored atrocities during the Khmer Rouge's brutal reign in the 1970s, and it continued to recognize the Khmer Rouge as Cambodia's legitimate U.N. representatives until 1991, even though the whole world knew that they were mass killers. Worse, it refused to provide any systematic assistance to the Cambodian people during the 1980s, while aiding the Khmer Rouge by supplying them food in refugee camps on the Thai-Cambodian border.

Extractions: The Adoption Process in Cambodia - An Update (The following remarks were made on February 6, 2002 by Catherine Barry, the Managing Director of the Office of Visa Services, Bureau of Consular Affairs, Department of State, to Congressional staffers interested in Cambodian adoptions.) We share your deep concern for the children and families who have been caught up in the problems associated with the adoption process in Cambodia. We will share with you today our assessment of the overall situation in Cambodia. What is that assessment? Two points. Let me tell you how we arrived at our assessment of the situation in Cambodia. In brief, this is what we learned. These are our conclusions about the defects in the Cambodian adoption regime. I want to stress that we are not simply reiterating the viewpoint of any single institution. · We have reason to believe that facilitators have been able to get the paperwork for these "abandoned" children through the Cambodian system by paying significant bribes. The facilitators charge thousands of dollars for their services, very little of which goes for official fees or the bona fide cost of care for the children. · How does this happen? Cambodian law and procedure does not ensure that children offered for adoption are genuine orphans. Children acquired in such manner are not "orphans" under U.S. law, nor under the Hague Convention on Adoptions - the international standard to which the U.S. and many other nations subscribe.

Extractions: It has come to our attention that some prospective adopting parents may be attempting to bypass the Cambodian government's January 25th decision to suspend the processing of intercountry adoptions by completing their adoptions through the Cambodian Judicial system. Prospective adopting parents are advised that the December 21, 2001 decision by the U.S. Bureau of Citizenship and Immigration Services in the Department of Homeland Security (BCIS) to suspend all orphan processing for Cambodia remains in effect. While it may be possible to complete a legal adoption through the Cambodian courts, children adopted in Cambodia, including those adopted through the court system, will not be issued orphan visas to enter the United States unless the case falls under the special Humanitarian Initiative announced by the Department of State and the BCIS on March 5, 2002. The Department of State is sympathetic to the desires of U.S. citizens to build families through intercountry adoption. In Cambodia, however, mounting evidence of serious irregularities, including illegal baby selling, dictate that the suspension must remain in place until the Cambodian Government can implement adoption laws and procedures that meet international norms and prevent abuses. The U.S. government is continuing to work with the Cambodian government to aid in this process. Return to International Adoption Page
