Member Benefits New ESEA Requirements Did You Know The February NewsLeader reported on the newly-enacted No Child Left Behind Act (P.L. 107-110) which alters the premier federal education law, the Elementary and Secondary Education Act (ESEA) . You probably realize by now that the new law adds some significant assessment, accountability, and educator quality requirements. But did you know about these changes and additions to the Act that will also apply to your school Military Recruiting - Military recruiters must be allowed access to students in the same ways that postsecondary institutions and prospective employers are allowed access. In addition, schools must provide basic student contact information (names, addresses, and telephone numbers) to military recruiters upon request. Parents may request that this information not be released without their prior written consent. Boy Scouts Contraception - Schools are not allowed to use ESEA funds for any programs that incorporate distribution of any contraceptive device on campus. The law previously banned use of ESEA funds only for programs that incorporated distribution of condoms. In addition, ESEA funds may not be used to distribute obscene materials on school grounds; fund courses or the development or distribution of materials that are designed to promote or encourage sexual activities; or fund sex education in schools unless such program is age appropriate and emphasizes abstinence. As written, these provisions should have little effect on most schools' daily activities. However, further definition during the regulatory process concerning what constitutes "obscene material" and what "promotes or encourages" sexual activities may further restrict certain school activities.

In testimony prepared for delivery before the U.S. House Committee on Government Reform, Ronald Goldstock, chair of the ABA Criminal Justice Section Standards Committee, also stressed the importance of government accountability, saying, "Accountability is a multi-pronged effort that includes administrative rules; internal regulations; periodic review by law enforcement agencies; and providing the public general information about the type of surveillance being used and the frequency of its use." Goldstock was among the prosecutors, criminal defense lawyers, law enforcement officials, judges, privacy experts and academics who worked together to develop the ABA standards for the use of technologically-assisted physical surveillance. The standards, intended to provide guidance on how and why to use these technologies in law, enforcement, were adopted as ABA policy in 1998.
