Class action lawsuits--allowing one or a few plaintiffs to represent many who seek redress--have long been controversial. The current controversy, centered on lawsuits for money damages, is characterized by sharp disagreement among stakeholders about the kinds of suits being filed, whether plaintiffs' claims are meritorious, and whether resolutions to class actions are fair or socially desirable. Ultimately, these concerns lead many to wonder, "Are class actions worth their costs to society and to business? Do they do more harm than good?" To describe the landscape of current damage class action litigation, elucidate problems, and identify solutions, the RAND Institute for Civil Justice conducted a study using qualitative and quantitative research methods. The researchers concluded that the controversy over damage class actions has proven intractable because it implicates deeply held but sharply contested ideological views among stakeholders. Nevertheless, many of the political antagonists agree that class action practices merit improvement. The authors argue that both practices and outcomes could be substantially improved if more judges would supervise class action litigation more actively and scrutinize proposed settlements and fee awards more carefully. Educating and empowering judges to take more responsibility for case outcomes--and ensuring that they have the resources to do so--can help the civil justice system achieve a better balance between the public goals of class actions and the private interests that drive them. ... Transparent and Balanced Research
This study is likely to remain the last word on class action research for some time to come. The depth and breadth of this study is extraordinary - and so are its revelations.

This is by any standard a major piece of work and we are fortunate that the RAND Institute for Civil Justice has the resources to publish it so fully. The substantial appendices contain much of the detail about methodologies, data collection and calculations that usually have to be omitted from law review articles. Readers can judge for themselves the thoroughness of the researchers and the accuracy of calculations supporting many of their assertions and assumptions.

At heart of this study is the question whether the policing of the public interst and public safety ought to be a function of the state or of "private attorneys general". The study is largely non-judgmental - although you may conclude that this research suggests an answer. There is plenty of ammunition for both points of view to be found in this book.

It is a treasury of fascinating facts about this kind of litigation. It includes the revelation that some attorneys were remunerated at the rate of $2,000 per hour for their efforts - and to think that we thought only mergers and acquisitions lawyers could aspire to that kind of reward!

The only criticism I have to make is that the executive summary that RAND publishes separately is not contained in the book. That is a useful document and its inclusion here would not have added substantially to publication costs but would have enhanced the final product.

Slowest Shipping Available
The condition of the book was exactly as stated, that is not the issue.

The issue is the shipping.I ordered the book on January 20th and did not receive it until February 17th!!! Amazon clearly states that shipping will take 4-14 business days upon checkout.That is a fair definition of STANDARD shipping.EVERYTHING I have ordered from Amazon no matter where it is coming from has arrived sooner than that.This shipper does not use standard shipping but rather uses MEDIA MAIL.THIS IS NOT THE SAME THING!This is the SLOWEST service that the post office offers.

Due to the low shipping I had to purchase ANOTHER book for my class.When I spoke to the seller, she said that she would refund my money less a restocking fee - for HIS error and MISCOMMUNICATION!I was fortunate enough to find another seller who was more than happy to work with me and the second book I had to purchase.

This book is an absolute neccesity for police officers on the street. It reads well, and easy, yet covers the court cases so important to law enforcement.

A must have for every law enforcement officer
What an incredible study guide and reference for law enforcement officers.This should be required reading for every cadet in every academy in the country.Mark Bannon does a spectacular job of summarizing Supreme Court decisions that affect the day-to-day activities of law enforcement officers.He covers arrests, searches and seizures, vehicle searches, probable cause, etc.

With each topic he traces the history of the Supreme Court decisions that have established current doctrine; he provides the facts and the reasoning of each Supreme Court case.This book opens the door for law enforcement officers to an understanding of Supreme Court decisions that both enable and constrain their actions on the street.
