The 8-year-old would sit across from his father and listen to what it was like to live in the jungle, running and hiding from the Laotian government after the Vietnam War. Like many Hmong, Daniel's father had fought for U.S. forces against Communists in Laos during the war. William Yang eventually made his way to a refugee camp in Thailand. "In the camp, you have no hope, you have no future," his father told him. The stories stayed with Daniel, of St. Paul, and they shaped him into an 18-year-old who's so committed to shedding light on the plight of refugees and other struggling people that he traveled to Africa several times by himself, even taking some time off school, to document their conditions. Such is the focus of his book, "Kakuma Turkana Dueling Struggles: Africa's Forgotten Peoples," which will be published in August. The book is a compilation of 75 black-and-white photos of the Turkana people of remote northwestern Kenya and of refugees who live nearby in the Kakuma Refugee Camp. In each photo, Daniel shows how the Turkanas' way of life is surviving despite the influx of more than 81,000 refugees from war-torn Sudan and Uganda. The camp, which was opened in 1992, is bringing in people whose cultures clash with the Turkana and who are competing for scarce resources, such as water and land.

The current policy, Operational Directive 4.20 (OD 4.20) has been in effect since 1992. The main objectives of the policy are to insure that World-Bank financed development projects do not cause adverse impacts upon indigenous peoples, and that they provide them with culturally compatible social and economic benefits. The current revision process, which began in 1998, is not meant to change those objectives. The revision is meant to facilitate the implementation of the policy. Some observers suggest that the draft, revised policy (OP 4.10), released to the public electronically in July 2001, is considerably weaker in important areas. Indigenous organizations complain that the draft lacks strong language to protect their rights, and that the consultation is too rushed. The Bank is now beginning a last round of external stakeholder consultations on OP 4.10, and the accompanying Bank Procedure (BP 4.10). There is a pressing need to facilitate meaningful participation in that process. Consultation Process The external stakeholder consultations regarding OP/BP 4.10 are taking place in all of the Banks regions October 1 December 15 (see table below).

The importance of a strong safeguard policy on Indigenous Peoples The World Banks policy on Indigenous Peoples is of crucial importance for indigenous peoples because it will determine how Bank staff and borrower governments deal with indigenous communities affected by their development projects and programmes. Mandatory provisions that respect indigenous peoples rights are very important because they provide affected indigenous peoples with a clear mechanism to raise concerns with Bank staff, implementing agencies and, if problems continue, with the Banks Inspection Panel. It is also important to realise that a strong and useful Indigenous Peoples Policy underpins the effectiveness and credibility of other key safeguards including the Banks Involuntary Resettlement, Environmental Assessment and Forests policies

In his opening keynote Dr. Tewolde Berhan Egziabher (Ethiopia) outlined the development of the international discussion on biopiracy in the context of the Convention on Biological Diversity (CBD) an d highlighted critical the diverging interests of market oriented research and local communities, striving for survival. During the following presentations and discussions in the two parallel sessions on ABS and intellectual property rights (IPR) a general disappointment was expressed that the expectations generated by the CBD of bioprospecting as a tool for generating funds for nature conservation and improvement of the livelihoods of indigenous and local communities could not be fulfilled until today. As reasons predominantly missing legal frameworks at the national level, unequal negotiating power between bioprospecting companies and resource countries, lacking recognition of indigenous peoples by national governments and missing protection of traditional knowledge were pinpointed.
