Product Description
This book considers the appropriate response of the criminal law with regard to women whose acts or omissions in pregnancy cause the death or injury of the child born alive. It compares recent developments in English law in the light of the Human Rights Act 1998, with those in America, which has seen an enormous growth in litigation over the last two decades. In England and Wales, the 'born alive rule' is currently applied only to third parties who injure the fetus, which is later born alive and dies as a result of these injuries. In some American states, a rule of similar origins has been extended so as to criminalize recent mothers whose acts or omissions in pregnancy caused injury or death to the resulting child. The author examines the implications of the laws in both systems, and also looks at the rights of the mother and child in relation to the obligations of the state to protect both of them. ... Product Description

The question of whether a young woman should be allowed to terminate a pregnancy without her parents' knowledge has been one of the most contentious issues of the post Roe v. Wade era. Parental involvement laws reach to the core of the parent-teen relationship in the highly contested realm of adolescent sexuality. This is the first book to examine in thorough detail the decision-making experiences of teens considering abortion. Shoshanna Ehrlich evaluates the Supreme Court's efforts to reconcile the historically based understanding of teens as dependent persons in need of protection with a more contemporary understanding of them as autonomous individuals with adult-like claims to constitutional recognition.

Arriving at a compromise, the Court has made clear that, like adult women, teens have a protected right of choice, but that states may impose a parental involvement requirement. However, so that parents are not vested with veto power over their daughters' decisions, young women must be allowed to seek a waiver of the requirement. Integrating a wealth of social science literature, including in-depth interviews with 26 young women from Massachusetts who obtained court authorization for an abortion, the book raises important questions about the logic of a legal approach that requires young women to involve adults when they seek to terminate a pregnancy, but that allows them to make a decision to become mothers on their own.

Product Description
This is a David and Goliath story of a mother's successful struggle against public authorities to secure justice for her son murdered while in their care. In 1994, Christopher Edwards was found dead in his cell at Chelmsford Prison battered beyond recognition by a paranoid schizophrenic prisoner with whom Christopher - himself also mentally ill - had been made to share a cell. The tragedy occurred despite the fact that information was in the pipeline that his assailant presented an exceptional risk to other people. For the next eight years Christopher's parents, Audrey and Paul Edwards, sought truth and justice at every turn. What they encountered was a wall of officialdom and red tape: sometimes accompanied by a culture which served to exclude them at key stages and which was often indifferent to their needs as a bereaved family and as victims. This ranged from silence to misleading information, obstruction, insensitive treatment and an attitude of self-preservation - leading in turn to suspicion and mistrust across the board at the way public responsibilities were being discharged.Undeterred, Audrey and Paul Edwards ceaselessly challenged the official responses and the legal and other processes which had relegated them to the sidelines. Ultimately, with the assistance of the civil rights organization Liberty, they sought redress in the European Court of Human Rights where in 2002 it was established that the UK Government had denied Christopher his right to life and the criminal justice, mental health and inquiry arrangements were found wanting at various points."No Truth, No Justice" is Audrey Edwards' personal account of these events from the day that a police officer knocked on her door with news of her son's death. It is the story of a ceaseless and arduous campaign imbued with lessons and warnings about the way individual rights are always at risk of being over-ridden by the state machine. It describes a David and Goliath struggle in which decency, openness and proper treatment are placed under scrutiny and some individuals may have escaped their just deserts. The book also acknowledges the supreme efforts of certain dedicated individuals to preserve the always fragile integrity of public services and - on an equally constructive note - makes a number of recommendations for preventing similar tragedies in future. ... Product Description
When parents - usually mothers - try to protect their children from sexual abuse, they can be devastated to find that support from the legal system is not always there. Suspecting their husbands or partners of the abuse, mothers may seek a divorce and custody or, if already divorced, request withdrawal of visitation rights. However, if unable to prove abuse, a mother can be labelled `hysterical' and her desperate efforts to secure her child's safety may jeopardize her case - and even result in the suspected perpetrator being granted custody of the child.

A ddressesing this troubling issue, this book provides parents and professionals with the necessary information to protect themselves against a legal system backfire. John ... Read more

Product Description
"The story of Amelia's conception, birth, and early raising, and of the two lesbian mothers who vie for custody of her without benefit of legal precedent or guidelines, is compelling, harrowing, and heartrending."-LeAnne Schreiber, author of Light Years

"An absorbing, well-told story . . . an original contribution to the emerging body of work on gay and lesbian parenting."-Jane Schacter, Professor of Law, University of Michigan

On a spring day in 1993, Nancy Abrams helped her daughter dress for day care, packed her lunch, and said good-bye. Next she drove to court, where she learned that in the eyes of the law she was nothing more than "a biological stranger" to the child she helped bring into the world and raise. That was the last time she would see her daughter or hear her voice for five years.

The Other Mother begins as Abrams and her female lover decide to start a family together. With giddy anticipation, they search for a sperm donor, shop for baby clothes and crib, and attend childbirth classes. But despite their high hopes, the relationship begins to fall apart, and they separate when their daughter is a toddler. Problems between the two intensify until, shortly before her daughter's fifth birthday, Abrams loses custody.

In unprecedented depth, Abrams's compelling narrative examines the social, legal, and political implications of gay and lesbian parenting. Her haunting memoir asks the question, "What makes a mother?" It is a question that biological parents, co-parents, adoptive parents, step-parents, and divorced parents must each answer in their own way. In telling one woman's story, The Other Mother makes a solid case for legal protections, including marriage, for lesbian and gay families. ... Read more

5-0 out of 5 stars A must-read
Given the current debates about gay marriage and gay rights, this book is a must-read. By telling one woman's story, Nancy Abrams makes a case for why it is imperative to make the legal benefits of marriage available to all people. But this is not just a political work by any means. It is a moving and well-told narrative.

3-0 out of 5 stars badly written, but an important book
Her writing style is ridiculous, flowery and forced-sounding.But the story Abrams has to tell is an important one.The book did get to me, although throughout most of it I kept cringing at the horrible decisions both Abrams and her ex-lover make as they try to work things out outside of the court.Still, it was worth reading, just to make myself aware that these things do happen.Until a more well-written book on the subject comes along, we'll have to make do with this.

5-0 out of 5 stars Abrams:Another look at lesbian motherhood
This book let me look at this woman as a woman first, then a lesbian, and lastly a mother.Abrams has a unique way of letting the reader in on her most intimate feelings, she does this by very often sharing journal entriestaken from the time she was fighting for her daughter. On page three, Iknew I was in for it, I was already crying. For me, this book gave me morea sense of myself as a lesbian. I have struggled in the past to find myselfin the gay culture only to be left out in the cold.Nancy's book, not onlydetails her life events that came to be, but she surrounds her story withother parts of her life. Her relationship, her work, her self. You reallyget a sense of her as a woman, just a person trying to make it in theworld. The journey Abrams takes you through will make you angry. The waythe system works for gays and lesbian parents is horrendous. Abrams andmany others have to prove their relationships to their children, usually ina long drawn out court battle.I loved this book because I finally feel aconnection, with a lesbian. Abrams pours her life out on these pages, leaving her readers to pick up their own piecies. She is not alone in hersituation, she has just been brave enough to share it with the world.I amthankful she did. It left me with a better sense of what our community isfighting for, and why we need civil unions and other legal protections. Itis easy to forget in the midst of the politics of it all, that this isabout the love between a woman and her child. Yes, it is heartwrenching, but in the end reedeeming. Reminding all of us, gay or straight that theties of family are beyond blood. ... Read more

Product Description
This book is about the Constitutional rights of illegitimate children and their parents, about the right to give birth and raise your own children regardless of race and marital status. It was inspired by Chrystal Chambers and her lawsuit against the Omaha Girls Club for pregnancy and race discrimination tried in l986. Ms. Chambers' case had a role in the passage of the l991 Civil Rights Act, Section 105 (a)(2)(a) banning the use of the business necessity defense in cases where intentional discrimination is alleged. It literally took an act of Congress to get the Omaha Girls Club to abandon their single pregnancy negative role modeling discharge policy. The case has been covered in "The Loud Voice" of the national media. In June of 2003, Ms. Chambers and her case were featured by national black syndicated morning radio talk show host Tom Joyner Show in his segment "Little Known Black Heroes." In the winter of l986, the case was featured in the New York Times,in Newsweek, in The New York Daily News as well as locally. The case was also featured twice on National Public Radio's 'All Things Considered,' and Ms. Chambers and her lawyer Mary Kay Green and others were featured on Phil Donahue's national talk show. The book also covers the Magdalene asylums in Ireland for unwed mothers, and challenges the Constitutionality of the Welfare Reform Act. ... Read more
