Product Description
Continually changing health threats, technologies, science, and demographics require that public health professionals have an understanding of law sufficient to address complex new public health challenges as they come into being. Law in Public Health Practice, Second Edition provides a thorough review of the legal basis and authorities for the core elements of public health practice and solid discussions of existing and emerging high-priority areas where law and public health intersect.

As in the previous edition, each chapter is authored jointly by experts in law and public health. This new edition features three completely new chapters, with several others thoroughly revised and updated. New chapters address such topics as the structure of law in US public health systems and practice, the role of the judiciary in public health, and law in chronic disease prevention and control. The chapter on public health emergencies has also been fully revised to take into account both the SARS epidemic of 2003 and the events of the Fall of 2001.The chapter now discusses topics such as the legal basis for declaring emergencies, the legal structure of mutual aid agreements, and the role of the military in emergencies. Other fully revised chapters include those on genomics, injury prevention, identifiable health information, and ethics in the practice of public health.

The book begins with a section on the legal basis for public health practice, including foundations and structure of the law, discussions of the judiciary, ethics and practice of public health, and criminal law and international considerations. The second section focuses on core public health applications and the law, and includes chapters on legal counsel for public health practitioners, legal authorities for interventions in public health emergencies, and considerations for special populations. The third section discusses the law in controlling and preventing diseases, injuries, and disabilities. This section includes chapters on genomics, vaccinations, foodborne illness, STDs, reproductive health, chronic disease control, tobacco use, and occupational and environmental health.

All chapters take a practical approach and are written in an accessible, user-friendly fashion. This is an excellent resource for a wide readership of public health practitioners, lawyers, and healthcare providers, as well as for educators and students of law and public health. ... Read more

3-0 out of 5 stars Good Basic Resource
This is a handy resource for professionals. The only problem is that it could use some updating. At the time this book was published, the ADA wasn't in place.

4-0 out of 5 stars A Lifesaver- but a bit out of date
This book was a lifesaver when it came to preparing for final exams. A very nice summary that hits all the major topics in Mental Health law. My only complaint is that it hasn't been updated since 97.So although most of the information is still accurate, it doesn't cover any of the more-recent developments in the law. Either way, if your struggling in a course, it's a great tool to have- just be aware that it was published in 1997, but I've looked and this was the best option I could find. ... Read more

5-0 out of 5 stars ONE OF THE EARLIER CRITIQUES BY A PROMINENT "ANTI-PSYCHIATRIST"
Thomas Szasz (born 1920) is Professor Emeritus of Psychiatry at the State University of New York Health Science Center. He is a well-known critic of psychiatry, of the social role of medicine in modern society, and is a social libertarian.

In the Preface to this 1963 book, Szasz writes, "Psychiatric activity is medical in name only. For the most part, psychiatrists are engaged in attempts to change the behavior and values of individuals, groups, institutions, and sometimes even of nations.Hence, psychiatry is a form of social engineering. It should be recognized as such... The present book has two major aims: first, to present a critical inquiry into the current social, and especially legal, uses of psychiatry; second, to offer a reasoned dissent from what I consider the theory and practice of false psychiatric liberalism. Most of the legal and social applications of psychiatry, undertaken in the name of psychiatric liberalism, are actually instances of despotism."

(Interestingly, he states in the 1989 Preface to the Second Edition of the book, "why---I am often asked---did I enter psychiatric and psychoanalytical training? I did so for two reasons: because I wanted to practice psychotherapy, and because I wanted to see if I could mount a successful critique of the fundamental principles and practices of psychiatry.")

Here are some representative quotations from the book:

"(T)he relationship between the mental hospital and its inmates is suffused with dishonesty and deceit. Usually, the patient is not told the true reason for his detainment. Nor is he given explicit directions about the way he must behave. Finally, his discharge is not predicated upon objective criteria, such as confinement for a given period of time. It depends instead upon the judgment by the staff of a transformation of his personality."
"Let us recall that Freud, Jung and Adler treated only consenting patients. They refused to inflict therapy on people who did not want it. This is true also for most of the best known contemporary psychotherapists."
"My objections to many current practices ... rest on a fundamental proposition: We should value liberty more highly than mental health, no matter how defined."

4-0 out of 5 stars Law and Mental Health Professionals--Massachusetts
When I initially purchased this book, I was disappointed with it.It offers little in-depth discussion of the matters it considers, and this gave me an (unwarranted) impression that its treatment of the subject was superficial.Actually, as I've come to use it and refer to it, I've found it to be an ideal referenceon the subject. It is well laid-out, and the brevity it offers is that of being very succinct and clear: ideal for a reference.

Now that I'm teaching a course on Boundaries and Ethics for pastoral counselors, I find that I'm drawing from this text a lot, in order to refresh my own memory on important points.I could wish that there was an edition of this guide available for every state, and that I could be certain that all were as clear and well-organized.But I'm deeply grateful to have it for my own use. ... 4-0 out of 5 stars Excellent introduction to the New Health Care System
For anyone who wants to understand what the press has reported and elements of the
New Health Care bill that gets very little press, this book provides a great introduction.
It overviews the current health care system and its deficiencies and the intended benefits
of the new legislation. As Nather repeatedly stated, the bill allows for some experiments
to test what works. The book covers all aspects of the bill for those insured by their
employers, those with private insurance, and the uninsured. For the new policies, I wished
that the author had explained if other countries have instituted the policy and the results.
Finally, the book ends rather abruptly. The author should add a concluding chapter.

4-0 out of 5 stars The New Health Care System
Well written in plain language to explain what we can expect. The listed resources were very helpful so while some items may change, at least I have the resources to keep up to date. After reading it to see what was in it for me, I found the bill tepid in many respects and wondered what the fuss was all about.Suppose I believe that health insurance like utilites should be run as non profits as opposed for profit. If you are unsure about purchasing this book, then check it out of the library first and then decide if it should be purchased as a reference book.

5-0 out of 5 stars EXCELLENT PRIMER on the new health care bill
I read David Nather's "The New Health Care System: Everything You Need to Know" while suffering insomnia one night...and found it an excellent, step-by-step guide on the ins and outs of the new health bill. While I consider myself fairly informed on current public policy issues, it was hard for me to make heads or tails of the new health bill, and Nather's book clearly and succinctly lays out what the new health insurance exchanges are designed to do, how new categories [platinum, gold, silver etc] will allow consumers to more easily determine the relative comprehensiveness of various plans out there, and how subsidies and credits will work based on one's income level.I also really appreciated the resource section at the end of each chapter...as my family continues to struggle with finding ways to finance long-term care, those links have become extremely useful.

5-0 out of 5 stars EVERYONE NEEDS A COPY
David Nather's book THE NEW HEALTH CARE SYSTEM Everything You Need to Know is exactly that.It is both useful and user-friendly and is filled with information which answers a variety of questions about this new legislation.I work in the health field and brought a copy into the office for everyone's general use. While I would rather read a novel, I also want to be informed, and this is the book to read to get up to speed on this issue.A real winner!

1-0 out of 5 stars Needs to be in the fiction section
I am a Health Care Provider and have extensive experience providing and billing for medical care. We have actually read the bill, (tried anyway ) and it is so open-ended, confusing, redundant and conflicting and written in legalese gibberish.
Nather keeps trying to reassure, calm and convince the reader that the bill is just great and will actually not increase costs. Beware, he comes to conclusions that conflict with most other people who actually have experience with medical care costs.
I think Nather really believes that you can cut off three feet from the end of a blanket, sew it on the other end and have a blanket that is three times bigger than the original blanket.
It should tip you off right away that the author is able to tell you exactly what the bill will do-- and nobody really knows because there are too many unknowns: how will the shortage of care affect rationing? How can we pay for so many more people with less money? If it really controlled insurance payments then why are they going quietly with what would bankrupt them? How are the elderly going to take it when they are deemed short-timers anyway and are not worth treating? Never mind that it may be illegal to force people to buy insurance.
Go ahead and read it if you enjoy fairy tales. There's no good pictures, though.

Product Description
The first title from the 'Law in Context Series' to fully consider the issues surrounding this subject, this text provides a critical and in-depth analysis of the current regime and the tensions within it by examining the development of contemporary mental health law in its social and political context. Dr Glover-Thomas charts the origins of mental health law from the 19th century to the modern health law reform programme including the provisions of the Mental Health Act 1983. The author also addresses the provision of community care and the disillusionment over the use of that policy that has followed. Importantly, the provision for mentally disordered offenders and the use of diversion is examined. Finally, there is a critical analysis of the latest mental health legislation, and some views as to the future of mental health provision in England and Wales. Product Description
There is a fundamental contradiction at the core of health policy in the EU that makes it difficult to draw a line between EU and Member State responsibilities. This raises a number of difficult questions for policy makers and practitioners as they struggle to interpret both 'hard' and 'soft' laws at EU and Member State level and to reconcile tensions between economic and social imperatives in health care. The book addresses these complex questions by combining analysis of the underlying issues with carefully chosen case studies that illustrate how broader principles are played out in practice. Each chapter addresses a topical area in which there is considerable debate and potential uncertainty. The book thus offers a comprehensive discussion of a number of current and emerging governance issues in EU health policy, including regulatory, legal, 'new governance' and policy-making dynamics, and the application of the legal framework in these areas. ...
