Extractions: Passes New Special Education Regulations (Courtesy of the Federation for Children With Special Needs. www.fcsn.com March 28, 2000 - By a vote of 8-0, with 1 member abstaining, the Board of Education voted to adopt newly revised proposed special education regulations. Despite some concerns over potential conflicts with both state and federal law, the board decided it was in the Department's best interest to move forward with the new regulations so that local school systems could receive training on the regulations this spring and implement them in September. Chief author of the regulations, Marcia Mittnacht, Director of the Office of Special Services, was asked several questions by members of the Board before the vote was taken. When asked if the regulations met with approval from the United States Department of Education, Mittnacht stated that the USDOE had reviewed the proposed regulations and "had some minor concerns" which were subsequently addressed. Members of the Board discussed the possible ramifications of passing new regulations while the state legislature is considering its own changes to special education law. James Peyser, Chairman of the Board of Education, suggested that some legislators privately would like the Board to vote on the new regulations to force special education reform at some level. Commissioner David Driscoll assured members the new regulations could be adjusted to conform to any changes the legislature might make to special education law. In the end, the Board decided to make special education reforms at the Department level.

The booklet contains a question and answer guide as well as a copy of the regulations themselves. Since December 20, we have received numerous questions from school officials about the application of the regulations. It is our hope that this question and answer guide will respond to the most frequently asked questions and will assist schools and districts in fulfilling the requirements of the Student Learning Time Regulations in the spirit with which they were drafted. While some of the answers provided are concrete, others suggest a process for answering individual questions at the local level.

The changes proposed by the DOE will affect almost every element of the provision of special education: eligibility, assessments, provision of services, placements, TEAM procedures, classroom size, parent participation and many other aspects. An overall theme of the proposed regulations is to remove strong state controls and to allow local school districts more discretion to "experiment." These changes will diminish twenty years of strong protections for students and their families. In many respects, the regulations will weaken current provisions that help students access assistive technology and assistive technology services through special education. Some of the changes that will affect students access to assistive technology in special education include: eliminating the obligation that programs will provide for the maximum possible development in the least restrictive environment of a child with special needs;

Extractions: Site Map July 17, 2000 The Massachusetts Legislature voted today to repeal the "maximum feasible benefit" standard for special education services, arguing the slightly lower federal standard established for the rest of the country should also be good enough for students in Massachusetts. Under the federal Individuals with Disabilities Education Act, states are required to provide a "free appropriate public education" to all students with disabilities. While supporters of MFB say their children are among the best served in the country, thanks to the state's adherence to a higher standard, state lawmakers are drooling over the millions of dollars a shift to the FAPE standard could free up for other education programs. Under the original Chapter 766 of Massachusetts law, a student with special needs is entitled to "an education that assures the maximum possible development in the least restrictive environment." That definition opens the door for higher levels of service than the federal FAPE standard, defined by the 1997 amended IDEA as education and related services that "meet the standards of the state educational agency, include an appropriate preschool, elementary, or secondary school education in the state involved and are provided in conformity with the individualized education program" required by IDEA. Ironically, the two standards are not viewed as dramatically different from each other, despite the heated debate they have inspired. According to

The federal law that protects student privacy is limited to students who are enrolled in or attend "institutions," which has usually not been interpreted to include homeschoolers. The federal protections for student privacy are far from complete, and homeschoolers are unlikely to be satisfied by the mere possibility of limited protection under existing federal law. For this reason, several states are considering amendments to enhance homeschool privacy. Massachusetts law demands a great deal of documentation from each homeschooled student. Each homeschool proposal must be "approved" in advance by the superintendent or school committee. While many states collect little or no information at all on homeschoolers, Massachusetts school districts often accumulate significant files on each homeschooler. For this reason, it is important for Massachusetts families to know and rely on their privacy rights under state law.
