His story covering the conference followed the saga of a single family in Oregon whose complaint history is extensively referenced in the OAC report. His article also summarized the findings of the report. Mr. Carter made no mention in his article of either OPU or FEAT, who provided the parents who spoke at the table. No quotes from FEAT or OPU spokespersons made their way into his article. At the press conference, Mary Broadhurst, one of three Special Education Law parent attorneys referenced in the national EDLAW list of parent attorneys, appeared on behalf of her clients, the Millers, who the Oregonian article featured. Ms. Broadhurst also announced the filing of a class action lawsuit against the Oregon Department of Education on substantially the same grounds outlined in the OAC report. Special Education: School districts must make available special education designed to meet the needs of resident handicapped children in private schools. Such special education must not be provided in the private school. Private educational agencies furnishing special education to handicapped children pursuant to a contract with a public agency must have on file with the Oregon Department of Education a plan approved for the special education programs. The plan must 1) describe the population to be served and the instructional services to be provided; 2) include a staff roster indicating name, instructional qualification, and assignment of all special education personnel employed by the private educational agency; 3) describe facilities, equipment and materials to be furnished and utilized; 4) document compliance with state and local health, fire and safety standards; and 4) meet additional minimum standards set out by regulation. The MCLE program is administered for the court by the OSB Board of Governors, which appoints the MCLE Committee and operates the MCLE Department. The MCLE rules require that all regular active members complete 45 hours of approved continuing legal education activities in each 3-year reporting period.
