The Sioux Nation Theft We Never Learned
Lazarus research and writing is such an eye opener!Despite 12 years of K-2 and six years of college ending in an MS Degree AND living in South Dakota for four years never did I ever learn about this injustice in America. The background and unfolding of how the US Government consistently took the Sioux Lands and broke written treaties deservesour attention. The pride the Sioux Nation has to stand up and turn down a "buy off' is commendable. If you have never visited the Pine Ridge or Rosebud reservations that we left(over) after breaking multiple treaties to take the land I encorage you to stop in on your way to the Black Hills and Deadwood.I would hope the History Channel would one day do a story for the American people based on this book.Who knows, one day maybe we will give appropriate reparations for the extreme poverty people on the South Dakota Sioux reservations.

I'd also add a consideration of author Lazarus's viewpoint, which Stripes rightly says is distorted by Lazarus's attempt to vindicate his father's role as an attorney for the Lakota tribes.I am a third year law student who sees himself as a Peace Corps Volunteer sent from the "real world" to the world of law.Legal education is worse than most in its warping effect on students' judgment.I am also reading Lazarus's "Closed Chambers", about the Supreme Court for whose Justice Blackmun Lazarus served as a post-graduate "clerk" in 1988-9.This latter book was written recently and is generally well-balanced and hopeful.By contrast, the Black Hills book was written while and soon after Lazarus completed his education, and shows signs of the preternatural or premature jadedness that not only infects law schools but seems to be part of the curriculum.I'll let Lazarus speak for himself (from page 230-1, as far as I've gotten in the book):"Tough and technically precise, the motion to vacate reflected an unmistakable contrast between the tribe's old and new counsel.Gone was Case's [the "bungler"] essentially romantic view of the legal process and his sentimental confidence that the government's overriding sense of fairness would lead it to a just settlement with the Sioux.Instead, Sonosky, Schifter, and Lazarus brought to the Sioux claims a hard-nosed view of the law and a degree of skepticism about the federal government.To them, the law was a two-edged sword to be wielded boldly and carefully in the service of clients.The legal system was a battlefield where the better cause did not always prevail.And the federal government was sometimes an ally, sometimes an adversary, but rarely the impartial purveyor of justice.The lawyers differed in their attitude towards their clients as well.To Case--the frontiersman's son inspired by the melting pot image of America--the Sioux were warriors to the last man who, nonetheless, wanted to assume their rightful place as members of an integrated national family.Sonosky, Schifter, and Lazarus, by contrast, heirs to a Jewish sensitivity about issues of ethnicity and discrimination, believed deeply in the New Deal's promise of cultural pluralism and Indian self-rule.They thought Indian law generally, and the claims process specifically, should be directed not towards ultimate assimilation but towards obtaining for Indians every penny to which they were entitled under law and guaranteeing to them a degree of independence in the direction of their own destinies." I think the heirs of the European usurpers should give the heirs of the original inhabitants of the continent a tenth of the current land/wealth.If the latter heirs want to buy a chunk of California and set up a gated community or a new state, feel free.The trend in Indian law seems to be the steady encroachment on Indian "independence".The father Lazarus's representation of the Black Hills claim netted 17 million dollars, what, five hundred dollars per survivor.No wonder the tribes voted to reject the award or settlement.Old Case's wheedling of the various courts, which younger Lazarus depicts as deaf to any call for justice anyway, at least had the merit of believing that Right means something in this country.If you don't believe that your opposite number cares about justice, what is your basis for persuasion?Public humiliation?Dazzling ambiguities to batter her or him into silence?Veiled threats (that you couldn't carry through on anyway)?These seem like the public's view of "lawyer's tricks". I say all this with younger Lazarus's later "Closed Chambers" in mind.Despite a couple of rough edges in its early pages, it is a passionate and philosophical study (so far, as of page 260) of a nation struggling to govern itself under law.There are no particular bad guys, no Case fall-guys for Lazarus's righteous indignation to exhaust itself upon.The later book is more of a Shakespearean tragedy, with the worst characters having redeeming (or redeemable) qualities.In a phrase, Lazarus has lost, by the time of this later book's writing, the "scorched earth" mentality that carried him into his earlier work.I suspect he got that mentality, largely, in law school.I think, as elder bungler Case might have said sheepishly,that that's a damn' shame and not necessary.If law is indeed a conversation, you can't have a conversation with someone if you are constantly calling him or her, in your mind or under your breath, a damn' fool.Speaking of Jewishness, I believe the Old Testament, one of the Wisdom Books, says somewhere that the person who calls someone else a fool (a rakah?) will not be forgiven.That's not an epiphany--it's the experience of neighbors who distrust anyone who badmouths an absent neighbor:what will this guy say about you when your back is turned?If you're not a good citizen, you're not going to be a good lawyer.

This book offers good historical narrative, but also justifies the actions of the author's father. It lacks balance in its perspectives.

The author's father, Arthur Lazarus, was one of the principle attorney's whowon the largest, longest running Indian land claims case in US history. In1980 the US Supreme Court upheld a judgement in favor of the Sioux of $17.1million plus interest for loss of the Black Hills. However, the check hasnever been cashed; rather, the judgement money continues to draw interest.The Sioux now reject their legal victory that awarded them "justcompensation" for loss of sacred lands, arguing that only restorationof these lands to the Sioux will end the conflict.

In _Black Hills /White Justice_, Edward Lazarus describes the legal efforts of Oglalaattorney Mario Gonzalez (one of the leaders in the land restorationmovement) as a Lakota Don Quixote who lacks a sense of reality. This biasaffects much of the story that Lazarus tells in this history.

Never theless, there is no other book that offers a comprehensive overview of thehistory of US-Sioux relations through more than two centuries. The book iswell researched and well written. It is a good primer.

The story in thisbook begins as the Sioux begin their rise to dominance on the northernPlains as they acquire horses and guns. The focus then shifts to theinteractions of the Sioux with non-Indians from early traders and explorersto government officials, soldiers, settlers, and finally, bureaucrats andlawyers. In the focus on this relationship, the book offers little insightinto the internal dynamics of Sioux culture, but it says more about thelegal relationships between tribes and the federal government than manyother books. ... Sioux Tribes
This book tackles the topic of the Sioux tribes for fought for, or more often against, the US in the mid-late 19th Century.It is a detailed source on the clothing and material culture of these peoples, and also provides a good foundation for the study of their culture.My reason for giving it only three stars is that it strays from the main thrust of the Osprey Men-at-Arms series.Easily half the figures in the plates are either women or unarmed males, and the text does not discuss the armament of fighting styles of these warrriors in detail.For someone like me who is seeking an Osprey book that is truly about the Amerindian warriors, there are better alternatives (notably Comanche 1800-1875).

Good detail on uniforms but not on anything else
This book provides an excellent overview of what these warriors wore but little on tactics, strategy and the men themselves (backgrounds, etc.). Excellent reference for model and figurine builders but not for those interested in what was beneath the surface.

Standing the Test of Time as the best book on Pine Ridge Ghost Dance of 1890
Although it has been many years since I read this book, I have continued to reference it. The books relating to Wounded Knee that have come along since LAST DAYS was published in the 1960s don't measure up in terms of dispassionate and balanced analysis, nor in exploring the sources to the extent that Mr. Utley does.In fact, this book could be used in Historiography classes as an examples of how to write objective history and shown to students in all fields of history as a stellar example of such.

Utley explores the underlying causes that gave rise to the Ghose Dance religion, from the Dawes Act to the actions of an immoral Congress that reneged on food allotments for the Lakota and then turned an indifferent eye to their plight.He examines the military build up at Pine Ridge and the Lakota response, detailing especially the Seventh Cavalry which I found most useful. All of this culminates with the tragedy at Wounded Knee.It is especially noteworthy that he then includes an entire chapter on the Drexel Mission battle that happened the day after Wounded Knee and is generally overlooked in other treatments of the Pine Ridge campaign. The early 1891 death of Lt. Casey is also covered. Also recommended: Rex Alan Smith's MOON OF THE POPPING TREES and the recently published VOICES OF THE AMERICAN WEST, the two volumes of the compiled interview notes of Judge Eli Ricker who talked to soldiers, settlers and Indians about Wounded Knee.

HE PROVIDES DIRECT EVIDENCE, FOR EXAMPLE, THAT BIG FOOT'S WARRIORS WERE WELL ARMED & DID INDEED COMMENCE FIRE ON FORSYTH'S 7TH CAVALRY AT POINT BLANK RANGE. MILITARY ARCHIVAL DATA PROVIDES LITTLE SUPPORT FOR THE WIDESPREAD MYTH THAT MOST MILITARY CASUALTIES WERE INFLICTED BY FRIENDLY FIRE. SIOUX COMBATANTS INFLICTED DEATH BY GUNFIRE ON 25 7TH CAVALRY TROOPERS. A FACT SELDOM REPORTED BY "MASSACRE" PROPONENTS WAS THAT SIOUX COMBATANTS WERE INTERSPERSED WITH NON COMBATANTS DURING THE MELEE. Old Applehead Furrman, jogging home across the mesa from Albuquerque, sniffed the soft breeze that came from opal-tinted distances and felt poignantly that spring was indeed here. The grass, thick and green in the sheltered places, was fast painting all the higher ridges and foot-hill slopes, and with the green grass came the lank-bodied, big-kneed calves; which meant that. roundup time was at hand. Applehead did not own more than a thousand head of cattle, counting every hoof that walked under his brand. And with the incipient lethargy of old age creeping into his habits of life, roundup time was not with him the important season it once had been; for several years he had been content to hire a couple of men to represent him in the roundups of the larger outfits--men whom he could trust to watch fairly well his interests. By that method he avoided much trouble and hurry and hard work--and escaped also the cares which come with wealth.

But this spring was not as other springs had been. Something--whether an awakened ambition or an access of sentiment regarding range matters, he did not know--was stirring the blood in Applehead's veins. Never, since the days when he had been a cowpuncher, had the wide spaces called to him so alluringly; never had his mind dwelt so insistently upon the approach of spring roundup. Perhaps it was because he heard so much range talk at the ranch, where the boys of the Flying U were foregathered in uneasy idleness, their fingers itching for the feel of lariat ropes and branding irons while they gazed out over the wide spaces of the mesa.

So much good rangeland unharnessed by wire fencing the Flying U boys had not seen for many a day. During the winter they had been content to ride over it merely for the purpose of helping to make a motion picture of the range, but with the coming of green grass, and with the reaction that followed the completion of the picture that in the making had filled all their thoughts, they were not so content. Outlived its shelf life?
Much as historical surveys are needed in the growing (and delightful) world of Kindle, a word of caution is needed here. The title and product description would lead you to believe that this is a narrative of the entire scope of American history and that it is a new work. But it was published in 1904 as the first volume of twenty-eight. This one is solely about European origins. I'm sure it was a fine resource in its time and could be useful now for studying the history of history, but I would not trust it as a primer on American history. While some like to believe history never changes, history (being an interpretation of the past and not the past itself) is being continually refined. It has a shelf life, and this title is more than a little dusty.

And to the fine people at Amazon who have served me so well for so many years, I encourage you to keep republishing public domain works. They can be very useful. Please just label them properly. ... Read more

Indigenous pop!
The histories of the Sioux nation and other Native American tribes were recorded by a series of woodcut and ink methods, the limitations of which formed the unique art style of the North American tribal nations. These thin strips of wood were easily stored and protected and the respective legends and stories could easily be copied and transferred on these wooden veneers.

Only a few of these veneers survive in museums today, as they are prone to the usual long term storage problems associated with wood. However, the practice is a well known technique used in most Amerindian and Navajo tribes and can still be found in practice for the tourism trade around the American states that still retain a native heritage.

The histories that the Sioux nation pass on with heroics and stories from the past are stored on these veneers, and most of the material in this book has been decrypted and presented for the readers delectation. In fact, the Sioux wood cuts are probably the most sought after due to their deeper and more refined symbolism used in the veneers.

The true collector knows the value of these Sioux veneers and in some cases they become as vicious and tenacious in their Sioux veneer hunting as the very people they are describing in the stories.

A very good book, made of paper and using words you already know, and some unfamiliar ones, just arranged a little bit differently. Recommended.

Dignity shines like a beacon
Lakota Spirit: The Life of Native American Jack Little 1920-1985. In today's crazy loveless, money-grubbing, materialistic world, for those of us who understand the expression "nobility of spirit," Lakota, the man expresses the high degree of inner strength such nobility affords. It is from that inner spiritual strength that Jack Little a Lakota-Sioux Native American from the Rosebud Reservation in South Dakota is told with devastating clarity, which also describes mankind's inhumanity to man. Little's analogy of the difference between white and Indian cultures strikes home with chilling accuracy.
