Home Aircraft Accident Investigation and Reconstruction The laws that affect aviation accidents are some of the most complex and difficult areas of the law. To conduct a thorough post accident investigation with subsequent causation analysis, three steps have to be taken.
    • An examination of the parties involved in the accident. That examination would include the pilot, the aircraft owner and manufacturer, and any ATC personnel involved in the accident. Training records and maintenance logs have to be examined. Potential accident witnesses have to be interviewed. Their statements have to be analyzed and evaluated for accuracy and consistency. Participants in the litigation process must be educated with the evidence. It is estimated that human factors play a significant part in 80 percent of all aviation accidents.
    Therefore, it is important that evidence relating to the cause of an accident be gathered, analyzed and sorted in a manner that will prepare and educate the attorney who is participating in post accident litigation.

    When an aircraft accident or incident causing any injury to personnel or damage to an aircraft has occurred, the RAM, the OAS, and the pilot's supervisor will be notified immediately. Detailed instructions are covered in 352 DM 6. B. After receiving an aircraft accident report submitted by the Director of OAS, the Service shall take the following action: Review the contents of the report with specific interest directed to the recommendation(s) provided. Within 60 days of receipt of the final Aircraft Accident Report, provide the Director of OAS the following: (a) Concurrence or non-concurrence with the findings and recommendations. (b) A copy of any directives, regulations, guidance or corrective action, as applicable, taken as a result of the findings and recommendations. (c) Copies of any additional actions taken as a result of the accident. The above feedback is necessary as it will become a part of the final Accident Report file and may be used to update OAS Aviation Safety Training Programs.

    NASA Administrator Sean O'Keefe announced the members of the Space Shuttle Mishap Interagency Investigation Board, which will provide an independent review of the events and activities that led up to the tragic loss of the seven astronauts on board the space shuttle Columbia.
    Retired U.S. Navy Admiral Harold W. Gehman, Jr., who co-chaired the independent commission that investigated the attack on the U.S.S. Cole in Aden, Yemen, Oct. 12, 2000, and once served as the commander-in-chief of U.S. Joint Forces Command, will chair the panel.
    "While the NASA family and the entire world mourn the loss of our colleagues, we have a responsibility to quickly move forward with an external assessment to determine exactly what happened and why," said Administrator O'Keefe. "We're honored to have such a distinguished panel of experts, led by Admiral Gehman."

    The Associated Retired Aviation Professionals was formed in early 1997. Its members include former military, civilian, and aviation professionals who are committed to independently investigating the mysterious crash of TWA Flight 800 on July 17, 1996. Introduction
    CDR. William S. Donaldson , USN (ret.), challenged the official NTSB position on the cause of the crash of TWA Flight 800 in a series of letters to James Hall, Chairman of the NTSB between April 1997 and December 2000. Over the past four years, CDR. Donaldson worked with other Retired Aviation Professionals, including some previous crash investigators as well as persons inside the NTSB investigation itself. CDR. Donaldson has extensive experience as a Naval crash investigator and he and others concluded that the NTSB's explanation of the Center Wing Tank explosion was not credible. With the help of these other concerned aviation professionals, CDR. Donaldson produced an extensive report on the cause of the crash. The initial Interim Report was delivered to the House Aviation Subcommittee on July 16th, 1998. Recently uncovered information now shows that TWA Flight 800 could have been shot down by one or more shoulder-fired missiles. The FBI was briefed by military missile experts in the Fall of 1996 that Flight 800 was well within the range of a shoulder fired missile. The FBI conducted a covert dredging operation for stinger missile parts between November 1996 and April 1997.

    On Thursday November 3, 1994 at 06.57 local time an aircraft accident took place at Kajaani airport in which a Douglas DC-9-83 (MD-83) aircraft, registered F-GHED, owned by Gie Libellule 1 and operated by Tunisian Air Liberté Tunisie was severely damaged. There were 164 passengers and seven crew members on board. Three passengers suffered minor injuries. The Council of State (Government) appointed an investigation commission in accordance with the Investigation of Major Accidents Act (373/85) 5 §. Retired airline pilot Lars Westermarck was appointed investigator-in-charge, chief of accident investigation Seppo Hämäläinen from the Civil Aviation Administration deputy investigator-in-charge. Airline pilot Timo Uramaa from Finnair, inspector Esko Lähteenmäki from the Civil Aviation Administration, trouble shooting coordinator Heikki Tenhovuori from Finnair and detective chief inspector Eero Klemetti from the National bureau of investigations, Oulu were appointed members of the commission. Inspector Esko Lähteenmäki has performed the duties of secretary of the commission. Student of technology and psychology Tero Lybeck has assisted in writing the report and translated the report from Finnish into English. The commission arrived at Kajaani airport on the day of the accident at 11.50 local time.
