Course Description : This course examines a variety of federal and state laws, administrative regulations, and court rulings that regulate employment relationships. Topics include employee privacy rights and employer rights to acquire personal information about prospective and current employees; negligent hiring; disparate treatment and disparate impact under Title VII of the 1964 Civil Rights Act; the Immigration Reform and Control Act; age, disability, and sexual orientation discrimination; wage and hour regulations; sexual harassment; pregnancy, and family and medical leave; regulation of health care benefits, and other topics. Course Goals : LIR 422 has been substantially revised to reflect two significant changes in my goals for the course. Since you will soon be employed in your chosen profession, your graded assignments reflects the kind of analysis of employment regulations that may be part of your work. Thus, my goal is to integrate the knowledge you will be acquiring about employment law in this course with a problem-solving methodology that is consistent with your future work.     January 27, 2002 For nearly two years, the EEOC has been investigating the pension conversion age-discrimination complaints that I and fellow employees filed, as well as about a thousand others from around the country relating to cash balance pension conversions. Now that the Enron collapse has broken another leg off my retirement stool, it's even more important to start enforcing the laws. I would very much appreciate your contacting the EEOC and asking them why they have not taken action to remedy this matter. In 1999, I and many other employees at Portland General Electric (PGE), a subsidiary of Enron, had their traditional pension plan converted to a cash balance hybrid. We were fed copious amounts of misinformation making the switch appear benign rather than a pension cut, which is typical for these conversions throughout the nation. (See www.PGEpension.com for details.) As if the cash balance pension conversion wasn't enough, Enron became the poster child for corruption and bankruptcy. As an Enron employee, my 401k is severely depleted despite my investments being as diversified as Enron would allow. The matching Enron stock, that was payment for work performed, couldn't be moved anywhere unless you were Enron upper management (or over age fifty, and then with restrictions). If our country does not enforce the existing laws with respect to their intent, there is no point writing new ones. Simply passing a bill or creating an inefficient bureaucracy often does little or nothing to remedy the problem, and can worsen it. This was the case with Enron and its exemption from commodity and futures regulation.

    A Note about the EEOC Supporters of reverse discrimination* (preferential treatment, or racial preferences) like to talk about the fact that non-minorities file very few complaints with EEOC. They like to imply that "everything must be OK with the non-minorities because they don't file complaints with EEOC." Next:
    Research suggests otherwise Almost 20% (about 1 out of 5) discrimination complaints with the EEOC are filed by non-minority federal workers! Non-minorities do have a great many actionable complaints, but EEOC will never hear about them unless the non-minorities file complaints! By all means, file a complaint if you feel you have grounds! According to the Federal Times (11/24/97), at the end of fiscal 1996, white federal employees had filed 11,295 complaints with the EEOC, while blacks had filed 9,339 race-based complaints.     Subject: New Study Links Breastfeeding with Reduced Hypertension
    A study to be published in The Lancet this Saturday indicates a link between breastfeeding and reduced blood pressure levels. Blood pressure can be a predictor of heart disease risk later in life. The study is believed to be the first experimental study of how early nutrition influences blood pressure. The study began nearly 20 years ago by scientists at the Institute of Child Health in London, England with pre-term babies. The 216 pre-term babies that were studied were divided into three groups: one group received donated breast milk, one group received infant formula made for pre-term babies, and the third received regular infant formula. Most infants remained in the study for one month. Sixteen years later the children returned to have their blood pressures compared. The researchers found that the diastolic reading was 3.2 points lower in the breast milk fed children. The systolicreading was 2.7 points lower in the breastfed group. There was not difference in readings between the groups fed the two types of formulas. Although the numbers appear small, heart disease studies have found that if adults' diastolic blood pressure was lowered two points, the prevalence in the U.S. of high blood pressure would drop by 17%, the risk of heart disease would fall by 6%, and the risk of stroke and heart attack would drop by 15%.

    Twenty years ago aged care policy was only just emerging on the national and international agenda. At that time, in keeping with a form of compassionate ageism, older adults were generally seen as a homogenous group of undemanding, frail and impoverished individuals.
    Aged care was not a high priority issue for governments, nor was it viewed as significant industry by either business or the community. Aged care was seen to be the responsibility of the family and the civil society-the churches, service clubs, local government and not for profit agencies. The situation today is very different with issues of ageing central to the economic and social development planning in most countries throughout the world. As a society we are gradually changing from one where youth centred values have dominated our thinking and our planning and where institutions and services provided were fashioned as a reflection of stereotypes, segregations and stigmas. The Australian population is growing older. And as their numbers increase, older Australians will become more and more important as the dominant consumer group.

    Can Antioxidant Foods Forestall Aging?
    American Journal of Clinical Nutrition (vol. 68, pp. 1081-1087). Early evidence for the protective power of high-ORAC foods comes from rat studies. Rats fed daily doses of blueberry extract for six weeks before being subjected to pure oxygen suffered much less damage to the capillaries in and around their lungs. In other tests, middle-aged rats were fed diets fortified with spinach or strawberry extract or vitamin E for nine months. A daily dose of spinach extract prevented some loss of long-term memory and learning ability normally experienced by 15-month-old rats. Spinach also proved most potent in protecting different types of nerve cells in two separate parts of the brain against the effects of aging, the researchers reported in the Journal of Neuroscience (vol. 18, pp. 8047-8055).
