Legislative Framework
There are six key Commonwealth and State Acts relating to equal opportunity and discrimination which apply to state schools. They are:
  • Victorian Equal Opportunity Act (1995) Victorian Public Sector Management and Employment Act (1998) Commonwealth Disability Discrimination Act (1992) Commonwealth Human Rights and Equal Opportunity Act (1986) ... Commonwealth Sex Discrimination Act (1984)

    Victorian Equal Opportunity Act (1995)
    This act:
    • makes it unlawful to discriminate against a person on the grounds of a person's age, disability, industrial activity, lawful sexual activity or sexual orientation, marital, parental or carer status, physical features, political beliefs or activity, pregnancy, race, religious belief or activity, sex or personal association with a person who is identified by reference to any of the above attributes prohibits both direct and indirect discrimination makes it unlawful to sexually harass a person in employment promotes equality of opportunity.

Both papers were written by the following officers from the Civil Justice Division of the Attorney-General's Department: Kathy Leigh, First Assistant Secretary; Renée Leon, Assistant Secretary; Catherine Hawkins, Principal Legal Officer; Matt Hall, Senior Legal Officer; and Scott Wilson, Senior Legal Officer.
    Foreword
    The Government believes that people of all ages should be able to participate in Australian life. Negative stereotypes should not prevent people from contributing to the workforce or enjoying all aspects of community life simply because of their age. The Government made an election commitment in 2001 to develop legislation to prohibit age discrimination. We undertook to work with business and the community to ensure that the legislation would be fair and balanced. I have consulted with a wide range of business and community representatives. On the basis of this consultation so far, I have developed proposals for age discrimination legislation to implement the Government's election commitment.

    I-C. ADDITIONAL EMPLOYER RESPONSIBILITIES
    Business Structure Establishing Tax Accounts Employment may be defined differently by laws regarding taxes, worker compensation, labor, and unemployment. Often, a worker's status as an employee is dependent on how much work is performed and how wages are paid. Some laws use tests involving the amount of control the payer has over how, where, and when the work is done. The IRS has Publication 15A , which outlines the criteria it uses to make the determination of whether a worker is an employee or an independent contractor. The term "independent contractor" is used to refer to a business, a business owner with employees, or a self-employed business owner with no employees. This should not confuse the issue of employer responsibilities. If you have employees, you are responsible for them. If you are unsure of whether someone who performs services for you is an employee or and independent contractor, consult each agency listed in this section to be sure of which definitions apply for which purposes.

    AVOIDING POTHOLES ON THE EEO HIGHWAY
    Your company's road to success is littered with curves and hazards, not the least of which are potholes of concern about discrimination lawsuits. Unfortunately, many employers ignore the potholes until they hit one. Hoping it won't happen isn't good "road sense." There are positive steps you can take to make the road a little smoother.
    Know the rules of the road. Generally, companies with 15+ employees are subject to Federal and State laws prohibiting discrimination on the basis of age, sex, race, national origin, religion, marital status, disability, veteran's status. These include:
    • Civil Rights Acts of 1964 and 1991
    • Equal Pay Act
    • Age Discrimination in Employment Act
    • Americans with Disabilities Act
    • Rehabilitation Act
    • Pregnancy Discrimination Act of 1973
    • Florida Human Rights Act
    • Laws applying to government contractors: Walsh-Healey Public Contracts Act, Davis Bacon Act, Service Contract Act

    What are my State education rights regarding age discrimination? State education includes education at any state university, state college, TAFE or state school. You have the right to generally apply for and get education, and/or any educational benefits, at any state educational institution - no matter what age you, or your relatives, (including children), or associates are. Exceptions
    However, there are some commonsense exceptions to this. For example:
    • the school entry age is the same as it always was. However, there is no upper age limit on either entry to, or staying on at, state schools.
    • other State educational institutions can refuse you admission if you are below the age they have set for the type of education, training, or qualification you are applying for (as, for example, with mature age entry programs). However, there is no upper age limit on entry to, or staying on at, any State educational institution.
    • benefits or concessions provided to help students in specific age groups, such as mature age students, or school students in particular grades, are still OK.

    Note that independent educational institutions are not covered by the age discrimination law - they can discriminate on the basis of age if they want to.
