General Legislative Provisions
This first part of the review examines statutory provisions that have implications for, but do not necessarily address directly, students with disabilities or special education. Various provisions in state statutes grant charter schools varying levels of authority to govern themselves and to make decisions regarding the operation of the schools, including decisions related to personnel, curriculum, and expenditures. The extent of a charter school's operational autonomy will have an impact on how special education programs are implemented in these schools. As described in the following paragraphs, statutory provisions that give higher levels of autonomy include ones that allow or require charter schools to (1) operate independent from local school districts, (2) make their own personnel decisions, (3) be exempt from state and district education laws and regulations, (4) assume liability for their actions, and (5) receive their funding directly from the state.     The University of Arizona
    The University of Arizona is one of three publicly-supported institutions of higher learning in Arizona under the jurisdiction of the Arizona Board of Regents. It was established in 1885 as a land grant institution 27 years before Arizona was admitted to the Union as the 48th state. During its colorful history it has developed into one of the great universities of the southwestern United States with 14 colleges, eight schools, 119 academic committees or departments, and 52 research and special service units. Commensurate with the rapid growth of the state during the past two decades, the University has grown to its present enrollment of 33,737 full- and part-time students, 8,120 of whom are enrolled in graduate studies. The bachelor's degree is offered in 126 programs, the master's degree in 123 and the doctorate in 91, plus other degrees available in 7 fields. The University offers nearly 350 fields of study. Its more than 135,000 active alumni are represented in every community in Arizona, all of the United States, and in 124 foreign countries. The University is located about one mile from the downtown area in Tucsonthe center of a rapidly growing metropolitan area with a population of more than 650,000.

    Like the major in ecology and evolutionary biology, the general biology program focuses on the history, development, and interaction of living organisms on this planet. It provides a broader background, covering molecular, cellular, physiological, ecological, and evolutionary biology. Majors also study species evolution, the effect of environmental pressures on evolution, patterns of biological diversity, and species interaction within a given ecosystem.General biology prepares students for careers in a number of fields including field biology, environmental biology, physiology, botany, zoology, dentistry, and medicine.     On February 6, 2003, Draft Preventive Maintenance Guidelines were submitted to the SFB for information purposes. These guidelines were prepared by a committee of School District representatives, who will serve as the statewide peer group in the continuing evolution and final approval of these guidelines. The School Facilities Board and staff are very appreciative of their excellent efforts. The Board instructed SFB staff to begin statewide workshops to secure additional School District comments. We have attached the Draft Preventive Maintenance Guidelines for initial review and comments. It is suggested that you read the Board Report first and then proceed to the seven (7) individual preventive maintenance components. Each of the seven components is broken down to a number of sheets.

    NEA policy embraces high standards, accountability and strong local control for charter schools. It also offers guidance in the form of various criteria that can significantly improve the chances for success of these programs, which after 10 years are still in the experimental stage. Among other things, NEA firmly believes that all affected public education employees must be directly involved in the design, implementation and governance of these and other educational programs.
    Failures spur review of charter school laws
    Charter schools are part of the landscape of public education. According to the Education Commission of the States, as of August 2001 there were more than 2,300 public charter schools serving more than 500,000 students nationwide. The Commission reported that 37 states, the District of Columbia and Puerto Rico have laws providing funding and permitting charter schools to operate. However, many of those statutes are being revisited and revised in light of a number of charter school failures, some with disastrous consequences for students. NEA's position on charter schools is necessarily general. State laws and regulations vary widely, and NEA state affiliates have positions that are appropriate to the situation in their states. For example, accountability for meeting high academic standards is an essential component of successful charter schools. But not all state charter laws have strong accountability requirements. In addition, not all state laws require charter schools to develop programs conforming with state or local academic standards, and many charter laws do not require charters to participate in the state accountability system.
