HEADLINES March 31, 2003 House Bill 2518: Requiring Homeschools to Prove "Quality Education" Author: Representative John Lewellen (D-District 34) Summary: This bill would authorize the Arkansas State Board of Education to issue rules, regulations, and guidelines to ensure that homeschool students receive a "quality education." This subjective standard would inevitably result in oppressive state oversight of homeschooling. Whatever the State Board of Education thought was good for homeschoolers would be imposed on them. The authority of the State Board would be completely unrestrained under the law. Status: This bill was considered by the House Education Committee on March 25, 2003, and was ordered postponed until an interim study committee can consider it further. This effectively kills the bill for this session.

F rom Alpena to Altheimer, Portia to Perryville, New Spadra to New Hope, Eudora to Evening Shade . . . are all children in Arkansas getting the same educational opportunities and funding for instruction that will adequately prepare them for life after high school? Citizens acting on behalf of the Lake View School District in Phillips County said "No!" in 1992 and filed a lawsuit that says the State of Arkansas is not providing a general, suitable, and efficient system of public education that is good enough and fair enough for our children. The courts have agreed and the decision now lies with Arkansas' highest court - the State Supreme Court. Because the Arkansas Constitution says it is the legislature's responsibility to provide a fair and equal education, our lawmakers passed Act 1398, An Act to Create a Blue Ribbon Commission on Public Education , in the 2001 legislative session in hopes of avoiding a very likely possibility that our education system will be declared unconstitutional. The Commission is made up of 25 Arkansas citizens and six legislators who are charged with addressing our serious educational problems and proposing solutions to them.

The MRH Administrative Council manages and supervises the school district. The Council consists of a fourteen-member administrative team including five Central Office Administrators, five Principals, two Deans of Students, one Director of Student Services, and one Director of the Alternative School. Administrative Council meets monthly to discuss district goals, progress, and achievement.

Linda Henke joined MRH in July 2000. She has served as teacher, curriculum coordinator, director, and principal. Linda was Assistant Superintendent in the Clayton School District for ten years before coming to MRH as Superintendent. She has a PhD from University of Iowa, was recognized by University of Iowa for outstanding research, and received one of six excellence in scholarship awards from the American Association of School Administrators in 1990. Linda has published several articles, chapters, and one book. Her work was most recently highlighted by Panasonic Foundation and by Peter Senge in his book Schools that Learn. Linda has one son named Andrew who attends John Carroll University.

Gateway Alternative Program
The Arkansas Avenue Gateway Alternative program serves regular and special education students in sixth through twelfth grades who do not have responded to building level intervention efforts and who continue to demonstrate chronic disruptive social behaviors, which interfere with their education and that of other students. The program serves students who show evidence of understanding appropriate social behavior but who have made a poor choice or a mistake, which poses a threat to self or others in a regular school setting. Placement occurs through a suspension/expulsion hearing, when a hearing officer recommends an extended suspension or expulsion for the student and an assessment for placement in the Gateway program. Parents cannot place students directly into the program, nor can they request placement; it is the decision of the hearing officer.
Alternative Educational Setting Program
This program is for special education student who have created challenges for themselves or others at their base school. This program serves sixth through twelfth grade students who are identified as needing special education services but cannot attend their base school due to behavior or disciplinary reasons. The Special Education Division makes all placements into this program, parents do not have the option to place their child into this program.

(a) Every parent, guardian, or other person residing within the State of Arkansas having custody or charge of any child or children age five (5) through seventeen (17) years on October 1 of that year, both inclusive, shall enroll and send the child or children to a public, private, or parochial school or provide a home school for the child or children as described in Sec. 6-15-501 et seq. under such penalty for noncompliance as shall be set by law with the following exceptions:
  • Any child who has received a high school diploma, or its equivalent as determined by the State Board of Education, is not subject to attendance requirement.

    Highlights of Arkansas Home School Law
    These come from HB 1157 which passed in the 1997 legislative session and was signed into law on March 7, 1997 by Governor Mike Huckabee. Additional changes to the law were made in 1999. Go HERE for those changes.
    The bill was sponsored by: Representatives Simon, McGinnis, Newman, Thicksten, Bisbee, Bryant, Wren, Molinaro, Magnus, Wilkinson, and Thomas

      Notification - Parents or guardians desiring to home school their children must give written notice of their intent to home school to the superintendent of their local school district. They must also sign a waiver releasing the State of Arkansas from any future liability for the education of their child. This notification must be given at the beginning of each school year for parents who are currently homeschooling their child; or at the time during the school year that the parent withdraws the child from the local school district; or, for families moving into the state during the school year, within thirty (30) days of establishing residency within the district.
      Comments - This part is a nice change from the old law which required notification in August or December before the semester during which home schooling would start. Thus, it was very difficult to remove a child from a damaging government school situation.
