We asked John Delaney, Partner at Morrison Foerster and authority on new media law, to outline the principal legal issues confronting those who build and manage online communities. Which are the principal legal issues that online communities face? Online communities face significant legal issues. These issues primarily arise from the fact that, by definition, an online community web site has a high degree of user interactivity.

Online Environments for Supporting Knowledge Management and its Social Context*

    1. Introduction
Our approach to managing knowledge or expertise is to do it on-line, via multi-user networked environments that support group communication and collaboration. That is, we are interested in designing on-line environments within which users can engage socially with one another, and, in the process, discover, develop, evolve, and explicate knowledge relevant to shared projects and goals. We refer to online multi-user environments used in these ways as "knowledge communities." This chapter consists of two sections. In the first section we make the case for a deeply social approach to knowledge management. We begin with an example that depicts a number of ways in which the production and use of knowledge is fundamentally entwined with social phenomena. We note that this socially situated view of knowledge is supported by research in a number of disciplines, and also has made its way into the business discourse that surrounds knowledge management. This view raises a challenge for those designing technology: knowledge management systems must take into account, either explicitly or implicitly, the social context within which knowledge is produced and consumed.

Overview There's no question that the heart of Morrison County is Little Falls. The county seat is the only city in Morrison County with a population of more than 2,000 people and one of only two, along with Pierz, with more than 1,000 people. The city's 21 historic sites also draw many tourists. Historic sites in the county outside of Little Falls include the Clough Township Hall in Randall, Crow Wing State Park in Barrows, the Soo Line Depot in Genola and the McDougal Homestead in Royalton. Morrison County, like Little Falls, is split north-to-south by the Mississippi River.

    Abstract
Despite strong interest among practitioners and scholars, the study of communities of practice (CoPs) and Information Technology (IT) is short of empirical research. This paper presents a theoretical framework for communities of practice and provides alternative perspectives on IT supports for communities of practice. The framework was developed based on the literature and ethnographic case studies of communities of practice within two organizations. The study examines how people share and construct their knowledge and how they use collaborative IT to support work practices in two organizations. The surprising finding is that the groups that used IT most intensively had the least well-developed CoPs. The results of the study would inform practice and research in Knowledge Management. Introduction
This paper introduces a framework for CoPs. The framework was developed based on the literature and the ethnographic case studies conducted by the first author. Second, we will discuss three kinds of knowledge and argue that some knowledge is difficult to share in electronic formats. Next, we will address the relationship between CoPs and IT. Finally, the implications of the study for further IT research will be discussed.

    THE ATTORNEY GENERAL'S STATEMENT
    December 6, 2001
During his opening comments, Attorney General John Ashcroft defended the Bush administration's efforts to combat terrorism and the possible use of military tribunals to try suspected terrorists. Online Special Report:
America after the Attacks The U.S. War on Terrorism ATTORNEY GENERAL ASHCROFT: Mr. Chairman, Senator Hatch, members of the Judiciary Committee, thank you for this opportunity to testify today. It is a pleasure to be back in the United States Senate. On the morning of September 11, as the United States came under attack, I was in an airplane with several members of the Justice Department en route to Milwaukee, in the skies over the Great Lakes. By the time we could return to Washington, thousands of people had been murdered at the World Trade Center. 189 were dead at the Pentagon. Forty-four had crashed to the ground in Pennsylvania. From that moment, at the command of the President of the United States, I began to mobilize the resources of the Department of Justice toward one single, over-arching and over-riding objective: to save innocent lives from further acts of terrorism. America's campaign to save innocent lives from terrorists is now 87 days old. It has brought me back to this committee to report to you in accordance with Congress's oversight role. I welcome this opportunity to clarify for you and the American people how the Justice Department is working to protect American lives while preserving American liberties.

    Legal Technology Predictions for 1999
What To Expect On The Internet
    By Jerry Lawson
Jerry Lawson is the author of The Complete Internet Handbook for Lawyers , due from the American Bar Association in January 1999. He is also the designer of the Internet Tools for Attorneys Web site. He compiled the Annotated Bibliography of Internet Legal Research Books for LLRX and writes "LLRX is one of the classiest Internet sites around, and I am always pleased to have something I wrote published there." Published January 4, 1999 Dennis Kennedy, Lawyers Weekly USA columnist and publisher of his own excellent legal technology newsletter , invited a number of people to polish off their crystal balls and make some law office technology predictions for 1999. His query prompted me to start thinking about the effects the Internet will have on the practice of law. Here is what I saw in the tea leaves:
    • A few lawyers will (mistakenly) urge their firms to their drop Westlaw/Lexis accounts in favor of the Internet.

    Position Statement
Designers of online communities can learn much from the evolution of our legal system. However, the affordances of the digital environment and the higher levels of consensus possible in planned online affinity communities will permit the design of considerably more streamlined and transparent quasi-legal processes. Likewise, architectural processes as well as legal ones come into play when exploring the less restrictive design space of virtual worlds. By adopting the approach taken by the Pattern Language movement to the legal and technical context of online communities, it becomes possible to promote their organic growth and enhance their long term viability. This is the strategy being pursued by The Continuity Project in its efforts to unify Hypertext Digital Library Metacomputing End User Programming , and Online Community research to transform the online public access catalog into a collaborative medium for the social construction of knowledge. Any modern legal system is a study in complexity. But underlying this seemingly chaotic structure are a few basic patterns that have been combined and overlaid to reinforce or mitigate each other's effects as countless players vie for personally beneficial results. Indeed, game play is perhaps the most appropriate analogy and economic model to capture the evolution of this process.
