March 18, 2002 Members of the Joint Committee: My name is Phillip Escamilla. I am here today representing CSBA—the California School Boards Association. CSBA represents approximately 1,000 school districts from all over the state, from small, rural districts to large, urban districts. I have four main topics I would like to address with you today with regard to the Emerging Modes of Delivery, Certification, and Planning Report: Charter Schools, Shared Use of Facilities, Technology, and State Funding. Charter Schools The report calls for charter schools to be "standards-based and evaluated rigorously." Under current law, which allows for the granting or operating of charters outside of the jurisdiction of the charter granting agency and the establishment of "satellite charters" while providing districts little latitude in denying a petition, the rigorous evaluation of charters called for in the report in not possible. With regard to charter school oversight, CSBA opposes the ability of charter schools to operate in a district other than the district that approved the charter. We also support greater flexibility with regard to the ability of a school board to deny a petition on the grounds that the charter may have a negative impact on other students in the district. A change in law to reflect these oversight issues would enable districts to meet the report’s goal of ensuring that charter schools are standards-based and evaluated rigorously. The report also calls for districts to "encourage innovative emerging organizational forms, including charter schools." Current law already has intent language calling for charters to "encourage the use of different and innovative teaching methods." Codifying this intent as one of several explicit requirements for which petitions must contain a reasonably comprehensive description would help encourage innovation in the early stages of the petition review process.

What is a "charter school"?
A charter school is an independent public school that is designed to meet the needs of students who aren't well suited for traditional school systems. Charter schools can be privately operated and sponsored by an existing public school board or a county board of education. Charter schools must be nonsectarian, and they cannot charge tuition or discriminate by residency, race, religion, or economic status.
What is the purpose of a charter school?

  • Encourage the use of different and innovative teaching methods
  • Create professional opportunities for teachers
  • Provide parents and students with expanded educational opportunities within the public school system without the traditional bureaucratic structure

DISPUTE RESOLUTION The capricious revocation action of the San Diego City SchoolDistrict Board of Education in revoking the Johnson/Urban LeagueCharter late last November should serve as warning to charterdevelopers that school district boards are intensely political bodiesand often lack the sophistication they need to make high-stakesdecisions. A well-constructed dispute resolution process could helpensure that school boards exercise their oversight authority with duecare, thereby insulating a charter school from arbitrary orpolitically-motivated school board decisions. CHARTER STUDY Recent amendments to the Charter Schools Act deleted the referenceto the defunct CLAS test and inserted a requirement that charterschools administer the yet-to-be-developed AB265 state assessmentsand meet any established state performance standards. The standardssetting commission is currently working on establishing a set ofcontent and performance standards. Given the broad ideologicaldiversity on the commission it remains to be seen whether ameaningful and implementable set of standards will emerge.

It is situated on the north side of the City of Santa Barbara. From the original six-classroom building, Peabody has expanded to its 33 classroom campus for K-6 students. In 1993, the staff, parents, and students reached a consensus that becoming a charter school would allow the ability, flexibility, and latitude to provide innovative curriculum, development, and instruction. Working together with the Board of Education of the Santa Barbara Elementary School District, a contract was negotiated to create a charter school as permitted under Senate Bill 1448 of the State of California. As a charter school focused on meeting students' needs, the school functions with the freedom to create its own academic programs, teaching methods, measures of success, community and family involvement guidelines and fiscal responsibilities.

    California Business Leaders Join Forces to Pursue
    Education Reform Agenda
    Leading California business organizations and businesses today announced the formation of California Business for Education Excellence. The coalition, composed of seven business organizations and four California companies with a long term involvement in education reform, will focus on insuring that recently adopted statewide academic standards are implemented in all public schools. Coalition Chairman Bill Hauck, President of the California Business Roundtable said, "California business leaders, while pleased with the progress made in the last few years in improving public schools still believe that we need to do more to assure that our young people are properly trained to succeed in a very competitive world." California Business for Education Excellence will concentrate on school accountability and additional competition. In the area of accountability the group will work to assure that:
