January 1, 2000
This part shall be known, and may be cited, as the "Charter Schools Act of 1992." It is the intent of the Legislature, in enacting this part, to provide opportunities for teachers, parents, pupils, and community members to establish and maintain schools that operate independently from the existing school district structure, as a method to accomplish all of the following: (a) Improve pupil learning. (b) Increase learning opportunities for all pupils, with special emphasis on expanded learning experiences for pupils who are identified as academically low achieving. (c) Encourage the use of different and innovative teaching methods. (d) Create new professional opportunities for teachers, including the opportunity to be responsible for the learning program at the schoolsite. (e) Provide parents and pupils with expanded choices in the types of educational opportunities that are available within the public school system. (f) Hold the schools established under this part accountable for meeting measurable pupil outcomes, and provide the schools with a method to change from rule-based to performance-based accountability systems.

ELEMENTS OF THE CHALLENGE
The Challenge school district reform initiative for California public schools has a primary focus on resultswhat every child should know and be able to do. Currently, there are 57 Challenge districts, with another 100 expressing an interest in signing on at a later date. Many reports have been published, including those of the California Business Roundtable and the Education Commission of the States, that call for significant changes in education, the Challenge incorporates many of these recommendations. The reports all call for:
These basic tenets will move the public education system to become focused on increasing student achievement based on high standards, helping us change from regulating processes to facilitating needed improvements and focusing on the most important producthigh levels of learning for all students. The initial Challenge school districts will lead the way for all California districts in making the fundamental changes needed to move to a high-performance, standards-based system of public instruction for all students. "Cyber Schools Carving Out Charter Niche"
As 'cyber' charter schools gather momentum in a dozen states, policymakers and administrators are struggling with how to classify these online institutions. Because students enrolled in the online schools stay at home, and have little contact with licensed teachers, many school districts argue that the cyber schools are little more than an organized form of home schooling. Therefore, they say, the schools do not qualify for public funds. But supporters say the critics are simply unwilling to accept inevitable change. "We're part of a revolution, and the system wants to shut us down," said Jeffrey Forster, principal of the Electronic Classroom of Tomorrow Charter School (eCOT), in Ohio. The 29 cyber charters currently serving students operate in Alaska, Arizona, California, Colorado, Florida, Kansas, Minnesota, New Mexico, Ohio, Pennsylvania, Texas and Wisconsin. Their numbers are expected to grow rapidly, however, as companies line up to provide them with the materials and services they need. Also, cyber charters are relatively easy to open because they require neither bricks and mortar nor more than a few teachers. But in Pennsylvania, cyber charters are causing quite a stir. The state's charter school law requires school districts to pay charters 80 percent of the state's per-student allocation. Because four of Pennsylvania's seven charters enroll students from across the state, the financial burden has hit many districts. But so far, more than 60 percent of them have refused to pay tuition to the cyber charters, prompting the state to withhold $850,000 in aid to these districts.

  • Education Code Section 60850 (a) requires that: "The Superintendent of Public Instruction, with the approval of the State Board of Education, shall develop a high school exit examination in language arts and mathematics in accordance with the statewide academically rigorous content standards adopted by the State Board of Education…" These state content standards are guidelines for districts to use in developing local district content standards. The content standards also serve as the basis for the curriculum frameworks, and all adopted instructional materials and state tests are aligned with them.
  • The purpose of the CAHSEE is to ensure that students who graduate from high school can demonstrate grade level competency in the state content standards for reading, writing, and mathematics.
  • Education Code Section 60851 requires the Superintendent of Public Instruction to provide the high school exit examination to students who "may take the high school exit examination in grade 9 beginning in the 2000-01 school year" and to students who "shall take the high school exit examination in grade 10 beginning in the 2001-02 school year." The exam has two parts: English- language arts and mathematics. Students must pass both parts of the CAHSEE to receive their high school diploma, beginning in spring 2004. Students must also meet the district's requirements for graduation.

Adjacent to Silicon Valley, Sherman Oaks Community Charter School is a small, neighborhood school, serving a predominantly Hispanic population. Roughly 20 percent of the students are recent immigrants. The school's charter focuses on bilingual immersion all students take both Spanish and English and on teaching with technology. Since nearly 75 percent of the families at Sherman Oaks qualify for free or reduced lunch, few have access to computers at home. All of the school's classrooms are equipped with several computers and a range of technology resources.

    OHIO COMMITTEE APPROVES SCIENCE STANDARDS. After a 10-month debate concerning the best way to teach Ohio's students about the origins and developments of life on earth, a nine-member standards committee of the Ohio State Board of Education adopted a set of science standards that they believe balances the importance of teaching about evolution with the critical debate surrounding the scientific theory. The committee approved one element of the state's science standards which says that students should be able to, "describe how scientists today continue to investigate and critically analyze aspects of evolutionary theory." Committee co-chairman Joseph Roman said, "I think we have a set of science standards that have a very good chance of getting kids excited about science, rather than afraid of it." The full state board will vote in December on the standards.

    December 1997 The District of Columbia and 27 states have enacted charter school legislation. Approximately 500 charter schools are in operation. Several charters have been revoked due to financial mismanagement. Recent reports reflect:
    • Minority students are well represented in charter schools.
    • On average, charter schools have a lower proportion of students with disabilities.
    • On average, charter schools have a lower proportion of Limited English Proficient students.
    • On average, charter schools enroll approximately the same proportion of low-income students as other public schools.
    • It is still too early to determine the educational effectiveness of charter schools.
    Three charter school bills have been introduced in the New York State legislature. Current reform vehicles in New York State include CR100.11, Variances, and 21st Century School Legislation.

    CERAI-00-07 Response to The Thomas B. Fordham Foundation Report "The State Of State Standards" By Gerald W. Bracey January 2000 In 1997 and 1998, The Thomas B. Fordham Foundation, under the direction of its president, former assistant secretary of education Chester E. Finn, Jr., issued reports evaluating the quality of the educational standards adopted by various states. In January, 2000, the Foundation updated these evaluations, declaring that the states were inching towards better standards. In the Foundation’s new report, each state is given a letter grade of A to F for each of the five areas evaluated – English, mathematics, history, geography and science. Only five states make the report’s honor roll, while 42 are rated negatively. The problem with the evaluations is a simple one: the states’ rankings for quality of standards are inverse to their performance on the National Assessment of Educational Progress (NAEP) and on the Third International Mathematics and Science Study (TIMSS). That is, the same states that have done the best job in the eyes of the Fordham report’s authors in implementing high standards have shown the poorest performance on widely accepted national tests for student achievement, and vice versa. These states have also performed poorly when compared to other nations.

    California's Charter Law
    As early as 1983, the California legislature mandated higher standards, revamped curriculum frameworks, lengthened the school day and year, established mentor teacher programs, improved textbooks, and set up teacher accountability systems. In recent years, the state also has passed laws to create more school-based management systems and teacher career opportunities and to promote school restructuring. Yet, legislators and educators were dissatisfied with student learning progress resulting from these changes. The charter originally was proposed in 1987-88 by California public school educators frustrated by bureaucracy and eager to have real freedom with accountability. A year after Minnesota enacted its charter law, California passed legislation authorizing up to 100 Charter Schools beginning in 1993. California's charter law seeks to:
    • improve student learning increase learning opportunities for all students, particularly for academically low-achieving students
