Modbee.com Tougher dairy regulations reviewed in Merced By MICHAEL MELLO BEE STAFF WRITER MERCED Stronger environmental regulations for Merced County's dairy industry are inevitable, dairy owners said Tuesday. But they hope the county will adopt restrictions that will appease environmentalists while not running the dairies out of business. A public hearing brought out a crowd to endorse the dairy ordinance the Board of Supervisors is considering. Planning commissioners gave their OK in June.The ordinance, if approved, would place much tougher environmental standards on existing dairies and livestock operations. New dairies would face more stringent and potentially costly regulations. Among other things, the ordinance would keep dairies from being built near homes, stipulate uniform guidelines for handling manure and provide for county inspections of most dairies every three years.The ordinance would apply not only to dairies, but also to poultry, sheep and rabbit ranches. It would update an ordinance last altered in 1983.County officials want to update the ordinance before the dairy industry grows further. Several large dairy owners crowded out by growth in Southern California are looking to move to Merced County. County planners have pledged to consider the new dairies after the ordinance has gone into effect.The supervisors did not vote on the ordinance Tuesday. They instead asked Environmental Health Division Director Jeff Palsgaard to work in some changes. The ordinance is scheduled to return for the board's approval next month.Merced County's 335 dairies, more than any other county in the state, produced $625.7 million in revenue last year, much more than any other industry. Each dairy has an average of 608 cows, smaller than only Tulare and Kern counties, which average more than twice as many.

Midwives A licensed midwife is an individual who has been issued a license by the Medical Board of California to practice midwifery. The practice of midwifery authorizes the midwife, under the supervision of a licensed physician and surgeon, to attend cases of normal childbirth in a home or birth clinic setting. Licensed midwives are also referred to as direct entry midwives or lay midwives. To date, more than 140 licenses have been issued to this classification of midwife. Licensed midwives differ from certified nurse midwives, who are licensed by the Board of Registered Nursing. Those individuals are registered nurses who have received extensive additional training in obstetrics and are certified by the American College of Nurse-Midwives. They work in hospitals and birthing centers licensed by the state, always with physician supervision. Currently, there are more than 1,000 licensed certified nurse midwives in California. The Licensed Midwifery Practice Act of 1993 establishes the licensure of direct entry midwives with the Medical Board of California, Division of Licensing. The major inclusions in this Act are educational requirements equivalent to those of nurse midwives, mandatory physician supervision, and language requiring the referral of complications. The clear intent is to provide an option in the management of normal, low risk pregnancies, while establishing a system which supports identification and referral of cases in which there are complications.

The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.

    Student Privacy Rights

    The Federal Family Educational Rights and Privacy Act of 1974 and regulations adopted thereunder and California Education Code 67100 et seq. were designed to protect the privacy of students concerning their records. Institutions must provide students access to records directly related to them and an opportunity for a hearing to challenge such records on the grounds that they are inaccurate, misleading or otherwise inappropriate. The right to a hearing under the law does not include any right to challenge the appropriateness of a grade as determined by the instructor. The law requires that written consent of the student be received before releasing personally identifiable data about the student's own records to other than a specified list of exceptions. The InterAmerican College has adopted a set of policies and procedures concerning implementation of the statutes and the regulations on the campus.
