Perspective on Capital Punishment
In response to an overture from the Classis of Delaware-Raritan the 1999 General Synod voted: MGS 1965 , pp. 211-214, 222-225; and MGS 1996, pp. 220-222); and further, to instruct the Commission on Christian Action to review said resolution and accompanying biblical study to determine if it should be revised and reaffirmed for present circumstances ( MGS 1999, R-30, p. 116). The reasons cited in support of this recommendation were:
    1. The increased frequency of capital punishment in many states merits a response by the church. 2. Seeking a new consensus on this vital issue through shared theological reflection would be a faithful use of time and gifts.

Overview:
The word " capital " in " capital punishment " refers to a person's head. In the past, people were often executed by severing their head from their body. Surveys in the US and Canada regularly show that a sizable majority of adults are in favor of the death penalty for convicted murderers. Depending upon the exact question asked, 65 to 80% of adults support the death penalty. In 1984, individuals who give greatest support to capital punishment were found to be older, white, male, rich, urban dwellers, politically independent and religious believers.

Capital Punishment Reforms Urged

The panel's report contains 85 recommendations, ranging from videotaping all interrogations of suspects in capital cases to establishing a statewide commission that would determine whether local prosecutors can seek the death penalty.

A panel formed to revamp Illinois' death penalty has recommended dozens of changes - including drastically reducing the number of circumstances warranting execution - but a majority of panelists doubt the system can be fixed.
The recommendations came more than two years after Gov. George Ryan suspended executions in the state after investigations that found several prisoners scheduled for execution were innocent a scenario that death penalty opponents say is not unique to Illinois.
In all, 38 states have death laws on their books but the American Bar Association has called for a moratorium on executions nationally and opponents have grown more vocal.
Illinois reinstated the death penalty in 1977 and carried out 12 executions before Ryan imposed the moratorium. At the time he noted that 13 death row inmates had been exonerated.

III. CAPITAL PUNISHMENT AND MENTAL RETARDATION: LEGAL STANDARDS
International Human Rights Law The cornerstone of human rights is respect for the inherent dignity of all human beings and the inviolability of the human person. These principles cannot be squared with the death penalty, a form of punishment unique in its cruelty and finality, and a punishment inevitably and universally plagued with arbitrariness, prejudice, and error. Recognition that the death penalty violates basic human rights has fueled a growing movement to abolish capital punishment around the world. Members of the European Union, for example, are united in their opposition to the death penalty in all circumstances, considering it an "inhuman, medieval form of punishment and as unworthy of modern societies." Out of the world's nearly 200 countries, 108 have rejected judicial executions in law or practice. Less than thirty carry out executions in any given year. Although the International Covenant on Civil and Political Rights (ICCPR) does not outlaw capital punishment outright, it specifically prohibits cruel and inhuman punishment and arbitrary executions, and limits capital punishment to "the most serious crimes." Forty-one countries have signed a Second Optional Protocol to the ICCPR by which they agree not to execute anyone and to take the necessary steps to abolish the death penalty. The practice of executing people of diminished culpability including people with mental retardation is particularly abhorrent. In recent years, the U.N. special rapporteur on extrajudicial, summary or arbitrary executions has received reports of the execution of people with mental retardation in only three countries Japan, Kyrgyztan, and the United States.

     Like former Illinois Gov. George Ryan, Maryland Attorney General J. Joseph Curran Jr. took a bold step yesterday in calling for elimination of the death penalty in the Free State. Top Stories
     With high-profile executions pending in each local jurisdiction, capital punishment throughout the region should be reviewed, revisited and possibly revamped.
     In Maryland, a new Republican governor, Robert L. Ehrlich Jr., and his lieutenant, Michael S. Steele, are at odds about reinstituting capital punishment after a two-year moratorium, even as a state judge clears the way for a March execution. It would be the first since the state-sponsored study at the University of Maryland demonstrated discrimination in capital punishment cases.      In Virginia, where capital punishment statutes continue to be refined because of new DNA evidence or improper jury selection, the issue of imposing the death penalty against a juvenile creates much consternation and conversation.      Once a staunch opponent of capital punishment for several reasons, I have re-evaluated my own position on occasion. However, my stance against killing juvenile offenders is unwavering.

     ANNAPOLIS — Attorney General J. Joseph Curran Jr. yesterday said his personal opposition to the death penalty does not affect the ability of his office to represent Maryland in appeals of capital-punishment sentences. Top Stories
     He said state Sen. Sharon M. Grosfeld, Montgomery County Democrat, would introduce a bill today that would abolish capital punishment.
      As many as seven death-row inmates could be executed this year.      Mr. Curran has long opposed capital punishment, and his office fought the appeals of the three killers Maryland has executed since reinstating the death penalty in 1978.      Mr. Curran sent a letter Wednesday to Mr. Ehrlich, Lt. Gov. Michael S. Steele and members of the General Assembly saying the state should end executions. Mr. Curran said he also sent letters to the relatives of victims of death-row killers.      The attorney general cited a University of Maryland study released this month that concluded that race and jurisdiction play key roles in whether a killer is sentenced to death. Murder suspects in Baltimore County and blacks accused of killing white victims are statistically more likely to be charged with a capital offense, the study concluded.      Delegate Carmen Amedori, Carroll County Republican, is sponsoring a bill that would settle the geographic issue by taking away prosecutorial discretion in death-penalty cases. Under her bill, if a crime is death-penalty eligible, prosecutors would have to seek the death penalty, she said.

"It's going to be very interesting these next few days," said Kimball Anderson, the Winston & Strawn attorney who represented George Ryan in his successful fight against Jim Ryan last fall. The legal and political issues here are deeply intertwined, he said, making this an early "gut-check," particularly for Madigan.
Anderson's withering brief last October accused Jim Ryan of staking out a position that "lacks support from the plain language of the Illinois Constitution, the constitutional debates, the statutes, the legislative history, and [the Illinois Supreme] Court's decisions, [and] also lacks common sense."
"There are at least two legitimate legal questions still out there concerning the non-signers and the unsentenced," Madigan said in an interview Monday. "Right now we're still weighing the options with everyone who wants to weigh in," including state's attorneys throughout Illinois and those who strongly support the blanket commutation.
"Our goal is to be the reasonable, moderate voice here," she said, sounding as though she were foreshadowing narrow legal support for Devine in the context of broad rhetorical support for criminal justice reform.

    America's politically conservative represent a vast body of individuals whose overlapping philosophies unify them in an alliance of common interest. As intellectuals, patriots, scholars and common citizens, conservatives, while fighting to sustain essential freedoms, often advocate the advancement of personal responsibility and self-government. Yet while conservatives recognize the common ground that distinguishes them from other schools of thought, they also understand that every politically right winged individual does not hold the exact same opinions about politics and society. An occasional internal disagreement or friendly intellectual scuffle should therefore be expected (especially among passionate members) as the natural result of unhindered independent thought. Discussion is healthy in that it requires the individual to not merely assert his or her belief, but to explain the reasons why that belief is held. When formulating a personal philosophy, it is wise to remember that the most important positions and policies are inspired by deeply held convictions and result from a careful consideration of the larger picture. That capital punishment is not only wrong but also a non-Christian practice is certainly a dissenting proposition among conservative circles. General unpopularity however, is not a sufficient reason to abstain from arguing against that immoral and blasphemous institution.

    Activities Executed Retreat for Catholic Leaders Permanent Human Rights Commission (PHRC Death Penalty Conference Report Introduction
    By the resolution of the 1997 Catholic Commission for Justice and Peace (CCJP) annual general meeting, the commission has initiated a campaign on the abolition of Capital Punishment in Zambia. The national office has therefore a task to source financial resources to support the campaign. The Embassy of Sweden made a contribution of ZK 57 312 500. 00 to the campaign. This report is an intermediate appraisal, to the Swedish Embassy as partners in to the campaign, on the project .It also gives a brief financial statement on the expenditure to date from the Swedish grant. The report covers the period between January, 1998 to end of June 1998. Activities executed to date include: Prooduction and Circulation of Awareness Material
    This process has already started. CCJP has compiled selected information material produced by Amnesty International and has circulated them to dioceses for use by diocesan CCJP commissions in their awareness programmes.The process of producing awareness materials still continues. CCJP is currently working on a flyer with simple campaign information on the question of capital punishment. Retreat for Catholics in Leadership
    Contacts with the Permanent Human Rights Commission
    The Chairperson of the Human Rights Commission was among those invited to participate in the above retreat. However, she received the correspondence late as she was out of the country at the time. She and her commission wrote to CCJP indicating that the Permanent Human Rights Commission has great interest in the subject matter. The commission therefore proposed a meeting with CCJP to explore mutual interests in the issue and see what possibilities are there for collaboration.The meeting between CCJP and the Human Rights Commission was held on Tuesday June 23rd, at 10:00 hours.
