SUBCHAPTER XV. CAPITAL PUNISHMENT. Article 100. Capital Punishment. § 15A-2000. Sentence of death or life imprisonment for capital felonies; further proceedings to determine sentence. § 15A-2001. Capital offenses; plea of guilty. § 15A-2002. Capital offenses; jury verdict and sentence. If the recommendation of the jury is that the defendant be sentenced to death, the judge shall impose a sentence of death in accordance with the provisions of Chapter 15, Article 19 of the General Statutes. If the recommendation of the jury is that the defendant be imprisoned for life in the State's prison, the judge shall impose a sentence of imprisonment for life in the State's prison, without parole. The judge shall instruct the jury, in words substantially equivalent to those of this section, that a sentence of life imprisonment means a sentence of life without parole. In the Name of God, Most Gracious, Most Merciful Second: Capital Punishment The second topic was Capital Punishment. The Council had previously consulted Dr. Azizah Y. al-Hibri. She provided the Council with a legal-Islamic point of view regarding this issue, and after an extensive discussion the Council took the following stand: CAPITAL PUNISHMENT Islam is a complete, comprehensive, inter-related and inter-dependent way of living. As such, criminal law is only one aspect of it, aiming at protecting individual and society. It pre-supposes the full implementation of its other aspects. Before meting punishments for crimes, Islamic law requires the removal of the causes of such crimes. For example, social and economic justice are means of crime prevention, as they remove the causes and motives of many crimes. Even when this is done, due process of Islamic Law must be followed, including strict rules of evidence and the absence of any doubt or extenuating circumstances (shubuhaat) surrounding the crime.

Arguments For and Against the Death Penalty

Abstract
    Despite capital punishment having been abolished in Canada 20 years ago, the majority of Canadians continue to favour the death penalty as a sentencing option. In this study, a 2 x 6 design was employed to investigate the effects that argument position (for or against the death penalty) and type of justification for punishment (deterrence, morality, rehabilitation, incapacitation, economic, and possibility of mistake) have on participants' sentence recommendations for a defendant found guilty of first degree murder. Results indicated that only those arguments in favour of the death penalty, based on retribution, economics, and impossibility of mistake, were effective in influencing participants to recommend that the accused be sentenced to death. Compared to participants who recommended a life sentence, those who recommended the death penalty were found to have significantly higher scores on a measure of vengeance.
A lthough the Parliament of Canada abolished the death penalty as a sentencing option in 1976 (Amnesty International, 1987), a majority of Canadians (approximately 65-75%) have indicated that they would support a return of the death penalty (Reid, 1987). Furthermore, calls for the reintroduction of the death penalty by politicians and others occur frequently. As a result of the public's apparent support for capital punishment, and the possibility of its return, it is important to continue studying factors that influence people's attitudes regarding the death penalty.

Background/Intro
Each year there are about 250 people added to death row and 35 executed.The death penalty is the harshest form of punishment enforced in the United Sates today. Once a jury has convicted a criminal offense they go to the second part of the trial, the punishment phase. If the jury recommends the death penalty and the judge agrees then the criminal will face some form of execution, lethal injection is the most common form used today. There was a period from 1972 to 1976 that capital punishment was ruled unconstitutional by the Supreme Court. Their reason for this decision was that the death penalty was cruel and unusual punishment under the eighth amendment. The decision was reversed when new methods of execution were introduced.
Capital punishment is a difficult issue and there are as many different opinions as there are people. In our project, both sides have been presented and argued with focus on several topics as listed below. This page was constructed to show the different opinions held by the members of our group. C APITAL Punishment is a term which indicates muddled thinking. The dilemma of kill or be killed, which confronts civilized society daily and inexorably, is bedeviled by the jumble of panic, superstition, and angry resentment we call punishment, expiation, propitiatory blood sacrifice, justice, and many other imposing names. The dilemma is a hard fact which must be faced and organized. The jumble should be unraveled and its superstitions utterly discarded.
Let me illustrate. Dogs are friends of Man; but an exceptional dog sometimes goes mad and runs amok through the streets, biting and infecting everybody it comes across. Fond as we may be of dogs we must kill it on the spot, by gun or bludgeon.
Cobras and adders, perfectly sane and normal, may get loose in a school playground or domestic garden. We break their necks without trial by jury.

Capital Punishment in the United States provides annual data on prisoners under a sentence of death, as well as those who had their sentences commuted or vacated and prisoners who were executed. This study examines basic sociodemographic classifications including age, sex, race and ethnicity, marital status at time of imprisonment, level of education, and State and region of incarceration. Criminal history information includes prior felony convictions and prior convictions for criminal homicide and the legal status at the time of the capital offense. Additional information is provided on those inmates removed from death row by yearend. The dataset provides information on inmates whose death sentences were removed in addition to information on those inmates who were executed. The file also gives information about inmates who received a second death sentence by yearend as well as inmates who were already on death row.

Common reasons in support of capital punishment
The Bible The Bible requires the death penalty for a wide variety of crimes, including sex before marriage, adultery, homosexual behavior, doing work on Saturday and murder. It even calls for some criminals (e.g. prostitutes who are the daughters of priests) to be tortured to death by being burned alive. Most Christians, with the exception of those in the Reconstructionist movement , feel that many of these grounds for the death penalty no longer apply to Christian societies. U.S. However, Bible passages are still used to promote the retention of capital punishment for murderers; some advocate that homosexuals also be executed. Justice/Vengeance Many people feel that killing convicted murderers will satisfy their need for justice and/or vengeance. They feel that certain crimes are so heinous that executing the criminal is the only reasonable response. Deterrence Many people feel that the death penalty will deter criminals from killing. This does not seem to be confirmed by an analysis of the available data. However, it feels intuitively correct for many people.

Letter to the Parliament on capital punishment IHD, Association of Tunceli People
and Mothers for Peace sent letter to the Turkish Grand National Assembly asking for lifting capital punishment whereas Hamit Geylani said that capital punishment was a crime against humanity and murder.

Human Rights Association (IHD) Istanbul Branch, Association of Tunceli People and Mothers for Peace sent letter to the Turkish Grand National Assembly (TBMM) asking for capital punishment to be lifted. And Hamit Geylani, HADEP Deputy General Chairman, said that capital punishment was a crime against humanity and murder.
A group of people including Eren Keskin, Chairwoman of IHD Istanbul Branch, Nimet Tanrikulu, Chairwoman of Association of Tunceli People and representatives of Mothers for Peace sent to letter to the parties in TBMM other than MHP (Nationalistic Action Party, a fascist party). Making a statement, Eren Keskin said that although capital punishment was not implemented actually it was used by all political parties as bargaining material for domestic politics. Emphasizing that right to live was a right having impunity, keskin continued with words to the effect: “Regardless of all motives, every death sentence is a murder. We as human rights defenders state that right to live cannot be bargain and ask for capital punishment to be lifted unconditionally.” As for not sending letter to MHP, Keskin gave the following reason: “MHP, having been making dirty politics for years is now making the death sentence a tool. As its stance is too clear, we did not send letter to them.”

Clinical Education Programs
The Children's Rights Clinic and Criminal Defense Clinic are available in the fall semester, spring semester, and summer session. The Capital Punishment Clinic, Domestic Violence Clinic, Mediation Clinic, Juvenile Justice Clinic, and Elderlaw Clinic operate during the fall and spring semesters. The Mental Health Clinic and Housing Law Clinic are available in the spring semester only. Capital Punishment Clinic. The Capital Punishment Clinic gives law students practical experience in capital litigation. Students are supervised by attorneys who represent indigent inmates on Texas' death row. Students review transcripts; interview clients; interview other potential witnesses, including jurors; identify and obtain social history records; and undertake other kinds of legal research and writing. Students who take part in the clinic register for Law 278R , which focuses on the intricate doctrines that have developed since the Supreme Court "constitutionalized" capital punishment law. The clinic and other coursework expose students to both the theoretical and the practical sides of death penalty law.
