The statistics researched by Reverend Lowell Grisham, rector of St. Paul's Episcopal Church in Fayeteville and presented to his congregation confirm this. Our Criminal Justice System is imperfect * Innocent people are executed. According to a study published by the Northwestern University Press, 23 people executed in the United States since 1900 have been proved innocent after their execution. * Innocent people are convicted. Since 1973 82 people have been exonerated and released from death row and more than 20 have had their convictions overturned. * People are executed when there are public doubts about their guilt. There is a new emphasis on faster executions, even in the face of increased discovery of judicial error thanks to DNA (testing) and new scientific expertise, the work of investigative journahsts, and expert attorneys. Rarely does the state seek to reopen a questionable death verdict.

Editorial: Don't execute the juveniles
From the Journal Sentinel Last Updated: Jan. 31, 2003 Last year, the nation's top court barred states from executing adults with the minds of children on the ground that doing so was cruel and unusual punishment. The other day, the court declined to stop states from executing actual children. The U.S. Supreme Court was right to stop capital punishment for mentally retarded offenders but wrong to shy away from the next logical step: keeping kids off death row. The execution of offenders who were minors at the time of their crime heightens the barbarity of the American death penalty. The court declined to hear an appeal of Oklahoma inmate Scott Allen Hain, who was 17 when he took part with an older friend in a murder in 1987. Hain was arguing that the death penalty for minors violated America's evolving standard of decency.

This represents a 7.5% increase over 2001 when 66 people were executed. All of these executions were for first degree murder and all but one was carried out by lethal injection. Linda Lyon Block was put to death by electrocution in Alabama.
The bulk of them took place in Texas with 33 and neighboring Oklahoma, with 7. California, with the largest death row population in the US (over 600 inmates), managed to carry out just one execution again this year. The state of Alabama strapped her into Yellow Mama, as the chair is called, and poured 2,200 volts of electricity through her until a doctor pronounced her well and truly dead. The day before, the Governor of Maryland had put a temporary halt to executions in his state, joining what many believe is a swelling tide of government restraint that could see the death penalty eliminated in the United States, not in one grand gesture, but state by state, act by humanitarian act. But supporters of the death penalty say capital punishment is alive and well in the United States. And two economists have produced a report that maintains homicide rates actually increase when death-penalty moratoriums are imposed. Ms. Block, 53, was the first woman put to death in Alabama since 1957. (Nine years ago, Ms. Block and her common-law husband murdered a police officer during an identity check in a Wal-Mart parking lot. Her husband, too, is on death row. The two believed most of the U.S. government is illegitimate.)

Therefore, while a sketch of both pro and con rationales is provided, this report takes no position on the legality, the wisdom, or the morality of the death penalty for juvenile offenders. The author of these reports has been involved with this issue for nearly thirty years as a researcher and as an attorney. References to some of those involvements can be found in Appendix C to this report. EXECUTIVE SUMMARY Beginning with the first in 1642, at least 365 juvenile offenders have been executed by 38 states and the federal government, constituting less than 2% of the total of about 20,000 confirmed American executions since 1608.

DETERRENCE THE DEATH PENALTY IS NOT A DETERRENT. A New York Times survey, released in September 2000, found that during the last 20 years, the homicide rate in states with the death penalty has been 48 percent to 101 percent higher than in states without the death penalty. FBI data showed that 10 of the 12 states without capital punishment have homicide rates below the national average. The threat of execution at some future date is unlikely to enter the minds of killers acting under the influence of drugs and/or alcohol, or who are in the grip of fear or rage, or who are panicking while committing another crime (such as a robbery), or who suffer from mental illness or mental retardation and do not fully understand the gravity of their crime. Likewise, children and young people are less likely to reflect upon or genuinely comprehend the consequences of their actions. Recent studies cast further doubt that the death penalty has any deterrent effect. Rather, these studies found support for the theory that the death penalty has a brutalizing effect.

Death Penalty Click here to add the counter to your webpage. Capital punishment is the ultimate denial of civil liberties. The ACLU opposes capital punishment under all circumstances because it violates the constitutional ban on cruel and unusual punishment, is administered arbitrarily and unfairly, and fails to deter crime or improve public safety. In 1976, the ACLU launched its Capital Punishment Project, a public education and advocacy program that seeks to bring about the abolition of the death penalty. After the Supreme Court reinstated the death penalty in 1976 the number of executions increased dramatically from one in 1977, peaking at 98 executions in 1999. The execution rate has since fallen, with only 66 executions in 2001 and 71 in 2002. But there is mounting evidence that this system is failing. Between 1973 and 2003, 107 death row inmates in 25 states were found to be innocent and released from death row, more than a third of them in the last seven years. There is also irrefutable evidence that the way in which the death penalty is applied is grossly unfair and discriminatory:
  • There is a double standard for rich and poor. The quality of legal representation is a better predictor of whether or not someone will be sentenced to death than the facts of the crime. The quality of legal representation depends on whether or not you can hire a lawyer. Almost all people on death row could not afford to hire a qualified attorney.
