Hamilton went on to assure his fellow citizens in Federalist Number 81 that they could rely on Congress to punish "judiciary encroachments on the legislative authority" by impeachment and removal of the encroaching judges. There never can be danger that the judges, by a series of deliberate usurpations on the authority of the legislature, would hazard the united resentment of the body intrusted (sic) with it (the power of impeachment and removal), while this body was possessed of the means of punishing their presumption, by degrading them from their stations.

The death penalty, or capital punishment, may be prescribed by Congress or any state legislature for murder and other capital crimes. The Supreme Court has ruled that the death penalty is not a per se violation of the Eighth Amendment's ban on cruel and unusual punishment. Furthermore, the Sixth Amendment does not require a jury trial on the sentencing issue of life or death. In the landmark case, Coker v. Georgia, 433 U.S. 584 (1977) , the Supreme Court ruled that the death penalty is a grossly disproportionate punishment for the crime of rape of an adult woman. The Court came to this conclusion by considering objective indicia of the nation's attitude toward the death penalty in rape cases. At the time, only a few states allowed for executions of convicted rapists. More recently, in Atkins v. Virginia , the Supreme Court used the same line of reasoning to rule that executions of mentally retarded criminals are "cruel and unusual punishments" which are prohibited by the Eighth Amendment The Supreme Court has established that for death penalty sentencing the sentencer's discretion be narrowly guided as to the circumstances that justify imposing the death penalty and that the sentencing process should be individualized.

A 38year-old house painter convicted of raping his 10-year-old stepdaughter became the first person to be executed in the Philippines since 1976 when he went to his death Friday in a prison outside Manila. Leo Echegaray, who steadfastly maintained his innocence since being convicted in 1994, died by lethal injection. The Philippines abolished the death penalty in 1987 but concern over a rise in violent crime led to its restoration in 1994. Philippine President Joseph Estrada, a strong advocate of capital punishment, said Echegaray's death would serve as a warning that the government means business. Wired News

Though the federal government and 38 of the 50 states have death penalty laws, and public opinion polls in the last decade have generally indicated that the majority of Americans favor capital punishment, organizations and sites advocating the abolition of the death penalty are more common and easily found on the World Wide Web than organizations and sites favoring retention of the death penalty . That more anti than pro-death penalty sites are listed on this page is due to that reality, and should not be construed to indicate the Justice Center's advocacy of either a pro or con position on the death penalty.
