FOR4005 Lecture 18: “Private Property, Trespass Laws and Silvicultural Activities.” by Van Lantz. Introduction: Private woodlot owners have traditionally fought against interfering government policies. There has been an historical belief in Canada that “one has the right to do what one wants with their own property”. Attempts by the government to directly regulate private woodlots in Canada and the US have caused many problems in the past. For example, in a study conducted in North Carolina on the reaction of landowners to the endangered species act, findings indicated that owners increased harvests in areas they believed would be protected as a result of the new act. As a result, the act actually reduced the amount of endangered species habitat in the state. Canada has had similar problems. In the past, if a private woodlot owner was charged under the ESA (1974), a plea of ignorance is sufficient to have the case thrown out of court. As a result of the negative consequences of direct regulation on private woodlot owners, the government has traditionally initiated policies that attempt to support and/or influence private woodlot management, from the ‘outside’. Such forest policies (currently in the media) include Trespass and Silviculture Policies. Most recently, however, there has been a focus on the markets to replace government forest policies. Certification systems are becoming more and more popular as landowners become aware of the potential benefits that this structure can provide.
