Ct. 2309 (1996) Date Decided: June 26, 1996 Issue: Freedom of Speech Whether campaign spending limits constitutionally can be applied against a state committee of a political party whose spending was not coordinated with a candidate. Vote: No, 7-2 Facts: The Federal Election Campaign Act of 1971, 2 U.S.C. § 431 et seq., imposes limits on contributions to candidates for federal office. The Act, for example, provides that individuals may contribute no more than $1,000 to any candidate with respect to any election. 2 U.S.C. § 441a. The Act similarly provides that multicandidate political committees may contribute no more than $5,000 to any candidate. Expenditures that are made by a person or committee in cooperation with a candidate are deemed to be contributions under the Act. Political committee expenditures are also deemed to be contributions attributable to a particular candidate if the expenditures create a communication that refers to a clearly identified candidate and contains an electioneering message. In early 1986, the Colorado Republican Federal Campaign Committee sponsored radio advertisements critical of then-Representative Tim Wirth, a Democrat seeking his party's nomination for the U.S. Senate. At the time that the advertisement was broadcast, the Republican Party had not yet nominated a candidate for the Senate seat. After the Colorado Democratic Party filed an administrative complaint under the Act, the Federal Election Commission determined that the expenditure for the advertisement was a coordinated party expenditure subject to the limitations of the Act.

    A political party is a group organized to support certain policies on questions of public interest. The aim of a political party is to elect officials who will try to carry out the party's policies. The questions may range from issues of peace, war, and taxes to how people should earn a living. A large political party usually has millions of members and supporters. When people in a democracy disagree about what the government should do, each voter expresses his opinion by voting for the candidate that supports his side of the argument. How Parties Began Although parties began long ago, they have not always existed. The ancient Greeks, who were pioneers in political affairs, had no organized political parties in the modern sense. In ancient Athens all native, free, male Athenians belonged to the Assembly, the governing body of the city. Each man voted as he thought best. The Council of Five Hundred, renewed each year, carried out the wishes of the Assembly and proposed measures for their consideration. Groups in the Assembly sometimes acted together to pass a law. But they did not organize into lasting political parties. The Roman senate had two groups that were somewhat like modern political partiesthe Patricians and the Plebeians. The Patricians represented noble families. The Plebeians represented the wealthy merchants and the middle class. Although these two groups often mingled, at times they voted as factions, or parties, on particular issues that were important to the groups they represented.

Political parties only emerged after the Meiji Restoration of 1868. In the following century or so, there were dozens of new parties born, dissolved and merged. There are currently (May, 2000) seven major political parties, described below. Changes happen with frightening regularity but we try to keep this page up to date. Of the seven parties, the LDP, New Komeito and Hoshuto form the current coalition government. Jiyu Minshuto or Jiminto (Liberal Democaratic Party - LDP) New Komeito (New Clean Government Party) Komeito was formed in 1964 as the political wing of Soka Gakkai, an organization affiliated with Nichiren Buddhism. The party lacked support due to its strong connection with religion until it officially severed the link in the 1970's. Komeito went on to become a mainstay of centrist politics. The party merged with the New Peace Party in 1998. While established to promote international peace, support social welfare and eliminate political corruption, recent years have seen the party move closer to the more conservative policies of the LDP. This helped the party enter government in a coalition with the LDP and Hoshuto. Currently led by Kanzaki Takenori.
