Miller Proposes Criminal Laws for 2002
DES MOINES. Attorney General Tom Miller on Thursday announced a series of proposed changes in Iowa criminal laws he is submitting to the Iowa Legislature, which convenes next week. Miller submits proposals every year to modernize and improve the Iowa Criminal Code. ( Click here for full description of all the proposals in PDF format Summary - Miller's proposals would: Strengthen Iowa's money-laundering law. "We have had a strong law against money-laundering for several years, but we need to close an important gap by establishing regulation of money transmitter businesses such as check cashers, check sellers and wire transfer firms," Miller said. Money laundering is how meth-trafficking networks and other criminal organizations convert illegal monies into apparently clean assets in order to conceal and expand illegal activity. Miller is asking the Legislature to give the State Superintendent of Banking regulatory authority over money transmitter businesses

As part of its Plan of Reorganization (POR), the company is committed to fulfill all of its valid claims, including all legitimate tax and other governmental obligations. "As the Attorney General should know, Pacific Gas and Electric Company proactively asked for specific permission from the bankruptcy court to proceed with its ongoing environmental remediation programs, shortly after filing for Chapter 11 Bankruptcy protection. The court granted our request on June 26, 2001, and since then, the company's remediation actions have proceeded unabated. In fact, this year the company's financial commitment to supporting its robust environmental programs will exceed previous years' commitments. In connection with its review process, the SEC will examine and, as necessary, determine whether (i) the acquisition will unduly concentrate control of utility systems, (ii) the purchase price is reasonable, (iii) the acquisition will unduly complicate the capitalization of the resulting system, (iv) applicable state laws have been complied with or preempted, and (v) the transaction will serve the public interest by facilitating the economic and efficient development of an integrated public utility system.

    Don't Call Enforcement to Begin
    Oklahomans who registered for the attorney general's Don't Call program should see a drop in telemarketing calls beginning tomorrow, Attorney General Drew Edmondson said today. "Feb. 1 is the day telemarketers who purchased the Don't Call list must stop calling the numbers on the registry," Edmondson said. "We can begin prosecuting violations of the Telemarketer Restriction Act tomorrow." More than 436,000 telephone numbers are on the registry and 180 telemarketers, including 14 from Oklahoma, have purchased the list. Tomorrow's enforcement date applies only to consumers who registered their telephone numbers with the attorney general before Dec. 1. Telemarketing companies who do not adhere to the new statute can be found in violation of the state's Consumer Protection Act, Edmondson said.

    UC, CSU, ATTORNEY GENERAL WIN PRELIMINARY INJUNCTION AGAINST ENRON ENERGY SERVICES The University of California and the California State University today (Wednesday, April 11) won a preliminary injunction preventing Enron Energy Services from unilaterally jettisoning the two university systems as direct access electricity customers. U.S. District Court Judge Phyllis Hamilton, ruling from the bench in San Francisco, issued the preliminary injunction effective immediately. The ruling directs Houston-based Enron to return the California State University (CSU) and University of California (UC) to direct access service from Enron and reverses, pending a trial, Enron's attempt to switch the universities to bundled electric service as provided by the Pacific Gas and Electric Co. and Southern California Edison.

    "Standards for State, Court, and County Law Library Collections" . In addition to coordinating this collection, the Library provides information, access, and research services for the staff of the Law Department. This includes procuring information in any form- books and print, online and electronic media, and microfiche/film. The Law Library also manages subscriptions and print ordering for the Divisions and Sections. All items are processed and cataloged according to Library of Congress standards. The Librarian provides training and education for various products, services and research methods. The Law Library endeavors to facilitate the various knowledge management goals of each unit within the Law Department.

    Attorney General Charlie Condon was born and raised in Charleston, South Carolina, and graduated from the Bishop England High School. He received a bachelor of arts degree from the University of Notre Dame in 1975 and a law degree from Duke University School of Law in 1978. In 1980, at the age of 27, he was elected Solicitor for the Ninth Judicial Circuit. At the time, he was the youngest solicitor ever elected. He and his wife Emily, a family practice physician, have four children. Elected as South Carolina's Attorney General in 1994, Charlie Condon is known as an innovative attorney general whose office has aggressively prosecuted criminal cases; has promoted legislation and other initiatives to fight crime, particularly violent crime; has promoted programs and policies designed to prevent crime; has represented the State in civil litigation; and has rendered legal opinions on a variety of subjects.     Attorneys General React to Finding of Fact in Microsoft Antitrust Case
    November 14, 1999 Attorneys General from several of the 19 states which were party to the antitrust lawsuit against Microsoft issued the following initial reactions to the release of the finding of fact in the case: Iowa Attorney General Tom Miller: "With other State Attorneys General, I am most gratified by the Court's finding of harm to consumers. That's the bottom line for State Attorneys General, who fight every day to protect the interest of consumers throughout the nation. Judge Jackson found that many of Microsoft's actions 'harmed consumers in ways that are immediate and easily discernible.' (Par. 409.) The Court has found that Microsoft practices have harmed consumers by undermining and distorting competition, choking off innovation, causing higher consumer prices, and reducing consumer choice. Illinois Attorney General Jim Ryan: "We believed from the start and continue to believe that consumers are being harmed by Microsoft's bullying of the marketplace. Today's court finding is an important first step toward making sure that the bullying ends and that the booming information age is free and open to competition. Only then will consumers be able to take advantage of one of our country's and state's greatest assets its innovative spirit."
