  • In 1998 was the first year State and Federal courts convicted a combined total of nearly 980,000 adults of felonies.
    Between 1990 and 1998 the number of felony convictions increased 12% in State courts.
    State courts convicted almost 928,000 adults of a felony in 1998. The general trend has been upward since 1990.
    From 1990 to 1998 the number of felony convictions increased faster than the number of arrests.
    Sixty-eight percent of those convicted in 1998 were sentenced to incarceration.
    Almost two-thirds of defendants charged with a felony in the 75 most populated counties in May 1996 were released from jail pending disposition of their case.

    HOW THE U.S. COURT SYSTEM FUNCTIONS

      The U.S. Constitution establishes a system of federalism under which the federal government is granted limited authority, with all remaining authority left to the states. This model of shared powers defines the relationship between the federal and state courts. In this overview of the various levels of the U.S. courts, Toni M. Fine, associate director of the Global Law School Program at New York University Law School, explains how the court system functions. It is something of a myth to speak about a single U.S. court system because the U.S. judicial system is in reality composed of multiple autonomous courts. There is the federal court system, an integrated system divided into numerous geographic units and various levels of hierarchy; in addition, each state has its own court system with a system of local courts that operate within the state. Under this dual federal/state court structure, the U.S. Supreme Court is the final arbiter of federal law, while the highest court of each state (usually called supreme courts) has the ultimate authority to interpret matters of the law of its state. When federal constitutional or statutory matters are involved, the federal courts have the power to decide whether the state law violates federal law. The functioning of these systems is complicated by the fact that there are multiple sources of law, and courts of one system are often called upon to interpret and apply the laws of another jurisdiction. In addition, more than one court may have sovereignty to hear a particular case.

    Local Committees to Promote Trust
    and Confidence in the Legal System
    The court system has five local committees to promote public trust and confidence in the legal system. These committees, which are composed of judges, attorneys, court personnel and community members, are assisting in implementation of the recommendations of the State Committee to Promote Public Trust and Confidence in the Legal System and helping to make the courts more responsive to individual community needs. The committees are located in Nassau and Queens County, and in the Second, Seventh and Eighth Judicial Districts. The committees, except the newest in the Second Judicial District, formally were known as Judicial Advisory Councils and continue their earlier work assisting the local Administrative Judge in enhancing citizen involvement in the courts.

    In 1969 Michigan Law consolidated almost all of the state's Municipal Courts into a co-ordinated system of Districts where full-time judges, elected by the citizens, could serve the local legal needs of their communities as "courts-of- record." There are l00 District Courts in Michigan. Their 265 District Judges handle hundreds of thousands of traffic, criminal, and civil cases annually. JURISDICTION The Court has exclusive jurisdiction of : (1) Jury and non-jury adjudication of all civil litigation up to $25,000.00 (Civil cases are non-criminal disputesthey are all cases where no one is going to jail.) District Courts also may handle cases over $25,000 where a Circuit Judge has decided that the "probable value" is under that amount, but the judge or jury has no limitation in those cases as to what the final judgment amount may be. In many counties, District Judges hear some Circuit Court cases if time allows on the District Court docket and if the Circuit Judge needs assistance. (2) Jury and non-jury trials of all criminal misdemeanors under State law or local ordinances. (that's where punishment may not exceed one year in jail)
