This page contains a general outline of the two systems. State trial courts Municipal and county courts are limited in jurisdiction. They are restricted by the amount of money involved in a civil lawsuit and have jurisdiction only for crimes with limited penalties (misdemeanors and traffic offenses). Preliminary hearings in more serious (felony) criminal cases are also held in these courts. Most cities have a municipal court, with one or more judges. The jurisdiction of a municipal court may extend only to the limits of the city where it is situated, or its jurisdiction may extend to certain areas outside the city or even cover a whole county. What are common pleas courts? A judge of the court of common pleas may be designated domestic relations judge. In some counties, he or she has jurisdiction over divorce, alimony, annulment and custody in family disputes. What is probate court?

Courts center repairs to take month longer

Repair of the flood-ravaged Harris County Criminal Justice Center, scheduled to reopen this week, will take a month longer than anticipated. Art Storey, director of the county's public infrastructure department, said Monday officials are now hoping to have the $100 million criminal courts center ready for public use again May 6. "There are a lot of people involved, a lot of tenants, and we're trying to floodproof, upgrade and reconstruct all at the same time," said Storey, who had set an April 1 date for reopening the CJC. "It's been an intense effort." The 20-story criminal courts center at 1201 Franklin first opened in January 2000. It houses the county's state district criminal courts, criminal courts-at-law, the district attorney's office and other criminal justice support staff.

At least half of adults arrested test positive for drugs at the time of arrest, said moderator Richard Stalder of the Louisiana Department of Public Safety and Corrections, and often arrestees have related substance abuse or mental health problems. We must do more than arrest, convict, and lock up these individuals if they are to return successfully to their communities, functioning as productive citizens, said Justice Thomas Merrigan of Orange, Massachusetts. The magnitude of the problems and the skills required to address these problems require responses that are best provided by multiple organizations/systems working together.

Editor’s Note: Following this article are some brief descriptions of blind kids who have received ESY services in the state of Maryland. The descriptions of these children, the reasons they received ESY, and the services they received may help you understand how the ESY guidelines described below are applied to real-life situations. Some school districts have become very comfortable and familiar with ESY services and routinely include it in timely IEP discussions. Others resist providing it, and still others are simply uninformed. If you believe that your child may need ESY services, you will need to request an IEP meeting to discuss it. Be sure that there is sufficient time between the meeting and the end of the school year so that, if services are denied, you can file a due process complaint and get a decision before the school year ends. Here now, is the description of the evolution of ESY services through the court system: Since the precedent for extended school year programming was set in the Armstrong v. Kline case in Philadelphia, in a large number of instances the courts have been asked to determine the eligibility of individual children for extended school year services. This summary looks at the judicial decisions that have been rendered regarding this issue.

Q: What is the mission of the Conference of Chief Justices?
A: First, let me begin by briefly describing the Conference of Chief Justices (CCJ). CCJ, founded almost 50 years ago, is composed of the highest judicial officer in each of the 50 states, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of Northern Mariana Islands, and the territories of American Samoa, Guam, and the Virgin Islands. Its mission is to improve the administration of justice in the states, commonwealths, and territories of the United States. CCJ carries out its mission by (1) developing and exchanging information; (2) educating and developing leaders to become effective managers; (3) promoting independence and effectiveness; (4) developing and advancing policies in support of common interests and shared values; and (5) supporting adequate funding and resources for operations. The CCJ members work together to represent the judicial branches in their respective jurisdictions in the same way that the National Governors Association represents the executive branches of state government.

The openness of judicial proceedings has always been a fundamental principle of the state court system in the United States. However, the courts are finding themselves faced with some unexpected consequences of such an open access system as they become increasingly reliant upon the Internet. With caseloads growing each year, the Internet has become a valuable tool for court officials in terms of managing cases in an efficient and timely manner and streamlining document processing. At the same time, courts are using the Internet to give the public electronic access to court records, making judicial proceedings more transparent but also making widely available personally identifiable and sometimes sensitive information that, while legally a matter of public record, used to be practically obscure.

USA AND JAPAN Issue No. 25. Winter 1998 The Judicial Systems of Japan and the US Fireworks sparked the closing ceremonies at the 1988 Olympic Games in Calgary, Alberta Japan's judicial system is quite different from that of the United States. Article 76 of Japan's Constitution states: "The whole judi-cial power is vested in a Supreme Court and in such inferior courts as are established by law." Japan thus has a unitary court system. The entire judicial system for civil, criminal and administrative matters is within the jurisdiction of a single court hierarchy (Fig. 1); there are no separate federal, state, county and munici-pal systems as in the United States.
The Saiko Saibansho or Supreme Court of Japan is headed by a chief justice appointed by the emperor after designation by the cabi-net, and 14 cabinet-appointed justices. It decides matters of law. The Supreme Court sits either as a full court (daihotei) or in divisions (shohotei). The full court is composed of 15 judges who hear constitutional cases for which there are no precedents as well as those deemed by a division to be significant. Three divisions composed of five justices each receive and hear all other cases. Similar to the US Supreme Court, Japan's Saiko Saibansho is the court of last resort "with power to deter-mine the constitutionality of any law, order, regulation or official act," in the words of the Constitution. All cases heard are appeals, how-ever, as the court does not possess original jurisdiction like its US equivalent.

    The Report of the National Task Force on Court Automation and Integration was published by the Bureau of Justice Assistance, U.S. Department of Justice, in June 1999. The Report identifies key issues and challenges for court automation and integration.
