Court Rulings Uphold Open Government Principle

"Democracies die behind closed doors. A government operating in the shadow of secrecy stands in complete opposition to the society envisioned by the framers of our Constitution. . .The First Amendment, through a free press, protects the people's right to know that their government acts fairly, lawfully and accurately in deportation proceedings. When government begins closing doors, it selectively controls information rightfully belonging to the people. Selective information is misinformation" 6th Circuit Court of Appeals (Cincinnati, 2002) With this resounding rebuke of the Bush Administration's secret deportations of Arab and Muslim men, the 6th Circuit Court of Appeals affirmed a U.S. District Court ruling that blanket closure of all immigration hearings violates the constitution. The Cincinnati ruling related to the case of Rabin Haddad, the Lebanese co-founder of an Islamic charity jailed since December.
"A true democracy is one that operates on faith-faith that government officials are forthcoming and honest, and faith that informed citizens will arrive at logical conclusions," said Judge Damon Keith, author of the 6th Circuit opinion. "This is a vital reciprocity that Americans should not discard in these troubling times."

ContinuousPark writes: "We've talked about hacking the Tivo and, more recently, about ReplayTV boxes being controlled over the Web. Now, the New York Times is taking it a bit further. The interesting point is that while everyone is raving about the new gadgets or complaining about how useless these devices are, the reality is that they are eventually going to disturb the TV industry just as Napster is doing with the music industry. It's just that ReplayTV and Tivo have been very discreet about this, even playing along with the networks. But it will happen and it's going to be a major disruption. I can't wait. Read why Tivo changed the way I handle TV, but its relatively steep price prevents it from becoming as common as Napster, which is, well, free. Both will alter their industries (and then the industries will converge, but that's another story ;)

Thank you Sandra for that kind introduction. Every time a man in a position of responsibility has the opportunity to speak to a group of women, he trots out a list of women in his life. There are first, the women who have influenced his life his mother and third grade teacher; second, the women who make a difference in his life today his wife, his daughters; and third, the women he works with or has appointed to important jobs. This is an organization of prominent women in communications. So far be it from me to take the podium today without acknowledging at least this third group of women in my life. You know many of them. So I am proud to acknowledge today the women who have top leadership roles at the Federal Communications Commission. In addition to the impressive work done by my colleagues on the FCC, Commissioners Susan Ness and Gloria Tristani, who you all know, I am proud that during my tenure as Chairman, I have appointed Bureau Chiefs Deborah Lathen, Regina Keeney and Kathy Brown; and the chiefs of our public affairs and legislative offices, Liz Rose and Sheryl Wilkerson.

Last Thursday, Madelyne Gorman Toogood was caught on tape in the worst way. Toogood, 25, was seen beating her 4-year-old daughter, Martha, by a video surveillance camera in a northern Indiana department store parking lot. Following the incident, Toogood turned herself in to police and was promptly charged with battery to a child, a felony that could put the mother behind bars for up to three years. Toogood, also a mother of two boys, pleaded not guilty, claiming the taped incident was isolated. “Martha didn’t deserve what she got. I just lost my temper,” she said. If convicted, should Toogood receive a lighter sentence if this is found to be her first incident of abuse? And does this strengthen the argument for more cameras — and less privacy — in public areas? Leave it to the law and turn off your television Caitlin Hall What should happen to the woman allegedly caught beating her daughter on tape? Exactly the same thing that happens to everyone else accused of committing a crime: She should be tried and, if convicted, punished according to the law. There’s not really an issue to debate there — it’s a simple matter of legality.

I know I go on and on about this, but what would be truly innovative here would be to add an RSS feed so that I can subscribe to their daily posts. That's how to hook me as a new reader since I read their publications (print and online) on an irregular basis at best.

Sylia Stingray stood quietly in front of the huge window that overlooked MegaTokyo's downtown core from her apartment. Hundreds of headlights moved haltingly through the main streets as the night took hold of the city. Serpentine files of pedestrians wound their way along the jammed sidewalks to their destinations amid the bright flicker of neon light and constant traffic noise. A media barge moved slowly through the skyscraper canyons just overhead, spewing its never-ending loop of announcements and news clips. Bright spears of white light emanating from the barge's belly scanned the streets and buildings below in a sweeping, circular pattern. No sudden, abrupt changes. No strange, violent occurrences. Just life as usual. Smooth and uninterrupted. She continued to watch the relatively calm scene as a vague feeling suddenly swept over her. Like someone whispering her name in the distance. While Priss'instinct had unveiled immediate dangers that usually manifested themselves in the form of Boomers, Sylia's inner vision was focused on the arrival of impending danger. Nene jokingly called it her 'women's intuition' but it was more than that. A nagging feeling that something was interfering with the normal flow of things. That feeling had saved the Knight Sabers more than once and now that feeling was resurfacing, almost unrecognizable in the wake of years of inactivity.

Charles Deakin, a consultant anaesthetist at Southampton General Hospital, and colleagues found that less than one quarter of a group of doctors knew how to position defibrillation paddles correctly. They recruited 101 doctors of all grades and specialties at the hospital to take part in the study, and were asked to perform defibrillation on a male resuscitation manikin. The position of the centre of the pads was recorded using a grid placed over the chest wall. The results are published in the British Medical Journal. The researchers found that 65 per cent of the paddles were placed within 5cm of the recommended position under European Resuscitation Council guidelines - but only 22 per cent were placed correctly. They found no difference in the results according to doctors’ grades or specialties, or between those who had or had not received training in the last three months. “Given that each minute of delay in restoring normal heart rhythm increases mortality by 7-10 per cent, teaching of advanced life support must place greater emphasis on paddle position if successful defibrillation is to be optimised,” they said.

  • The media's obsession with personal trivia stories is problematic. But regulating to protect privacy does not raise standards of journalism. The rise of confessional journalism is part of a broader culture of victimhood. Challenging this culture requires more speech, not less.
Trivia as news The debate about the quality of speech involves value judgements - and it is difficult to devise clear standards about what counts as a high or low standard of speech. Decisions about what is newsworthy or too prurient to publish are based on opinions that not everybody shares. They can reflect the outlook of powerful interests in society over the less powerful, keeping public figures' private lives secret when they may be important to reveal.

At times the lobby has to resort to crime to achieve its assaults on public transit, while at other periods, it just used its money, muscle and propaganda with state and Washington lawmakers. Earlier, GM tried to pressure banks to reduce credit to these trolley companies and when that did not succeed sufficiently, the conspiracy to buy out their competitors and shut them down was hatched.
Our very infrastructure of the nation is based not on the "free market" but on elite thuggery.

Goto: Chapter Bibliography Chapter 6 TV Goes to War The Gulf war was the first war played out on TV with the whole world watching it unfold, often live. Never before had so many people watched so much news. The nation had rarely, if ever, been so involved in a single story. There was discussion of the vicissitudes of the war throughout the TV day and there had probably never been so much concentrated TV coverage of a specific event week after week for the duration of the war. And never had the nation been exposed to and fallen prey to so much disinformation and propaganda. For the rest of the Gulf war, both the Bush Administration and the military vilified Saddam Hussein and the Iraqis whenever possible while presenting their own actions, however brutal, in a positive light so that few negative images appeared of U.S. military actions. The Big Lie that was repeated daily throughout the war maintained that the U.S-led multinational coalition bombing campaign was precise and was avoiding civilian casualties. This lie was promoted by both the Bush administration and the U.S. military. General Schwarzkopf, in a January 27 briefing, insisted that the coalition forces "are absolutely doing more than we ever have" to avoid casualties. He claimed that "I think no nation in the history of warfare" has done more to use their technology to minimize civilian casualties and to avoid hitting cultural or religious targets. George Bush echoed this in a February 5 press conference, claiming: "We are doing everything possible and with great success to minimize collateral damage.... I'd like to say that we are going to extraordinary, and I would venture to say, unprecedented length, to avoid damage to civilians and holy places."

Colonel Charles A. Lindbergh was a genuine American hero. In 1927, Lindbergh captured the public imagination by flying solo from New York to Paris in a single-engine airplane . This pioneering flight across the Atlantic instantly changed the character of global travel and made "the Lone Eagle" a world celebrity. Joined by his wife, author Anne Morrow , this soft-spoken adventurer traveled the world, using his celebrity status to advance the cause of aviation. Together, the Lindberghs came to symbolize a youthful and optimistic America and a newfound global communication.
