  • The changes mean that the FBI, which has failed to manage the ocean of information it already collects, will be gathering yet more information in situations completely unconnected to any suspicion of criminal conduct, and will be continuing for longer periods of time investigations that are producing nothing.
    The expanded surveillance and use of data mining could be written off as just a waste of money, but for two paramount problems: the changes are likely to make the FBI less efficient in preventing terrorism, by diverting resources down rat-holes of fruitless investigations; and the DOJ has proven its determination since September 11 to arrest people based on innocent coincidences and hold them in jail even after concluding that they were unrelated to any terrorism and in some cases (the material witnesses) had committed no legal violation at all.
    The FBI is using the terrorism crisis as a cover for a range of changes, some of which have nothing to do with terrorism.

1. The scope is very broad as it would apply to all data in relation to land and mobile telephones and Internet connections. 2. The key provisions are Article 3(1), the obligation of service providers, and Article 3(4), governing access by law enforcement authorities to that data for at least the usual list of "Euro-crimes". 3. Articles 3(1) and 3(2) vague as to what exactly will be collected on top of the mandatory list in 3(1) but falling short of content, which is prohibited under this Framework Decision by Article 3(2). Perhaps this is to cover data on where the mobile phone is located, or collection of data from a computer or phone other than the content of the conversation? The data collection obligation in Article 3(1) is not limited to traffic data and that 3(1) uses the non-exhaustive wording, "in particular". 4. In Article 3(4) there is a reference to data which is retained during the application of the article then a reference to "traffic data". Are these two different and if so, what the first category consists of? 5. There are grave gaps in civil liberties protection even compared to Schengen, the Cyber-crime convention or other recent EU measures like the arrest warrant, despite the references to harmonising procedural guarantees in the preamble. Affecting the Privacy of Communications and Personal Information
As Congress considers this important piece of legislation, it should be guided by several critical factors:
  • Law enforcement and intelligence agencies already possess broad authority to conduct investigations of suspected terrorist activity. In fact, Congress approved new surveillance powers to combat terrorism in late 1998. Describing those provisions after enactment, an FBI national security official said that "any one of these extremely valuable tools could be the keystone of a successful operation" against sophisticated foreign terrorists.
    Any expansion of existing authorities should be based upon a clear and convincing demonstration of need. Congress should assess the likely effectiveness of any proposed new powers in combating the threats posed by terrorist activity.
    Any new authorities deemed necessary should be narrowly drawn to protect the privacy and constitutional rights of the millions of law-abiding citizens who use the Internet and other communications media on a daily basis.

FBI Academy - Quantico, Virginia 22135 This paper reflects on currents approaches to crime scene photography described in numerous photographic publications but also includes the observations and suggestions of profilers and photographic examiners who analyze these photographs for behavioral and forensic evidence. For purpose of criminal investigative analysis (profiling), it is important to record much more than those areas in which acts of violence took place. Photographs can be instrumental in recording the victim's lifestyle and personality; the topography and socioeconomic conditions surrounding the crime scene; and much more which is important to any investigator or analyst who is unable to visit the crime scene. When photographing violent crime scenes, the aim should be to record a maximum of useful information which will enable the viewer to understand where and how the crime was committed. The term "crime scene" refers not only to the immediate locality where the crime took place, but adjacent areas where important acts occurred immediately before or after the commission of the crime. Long range, medium range and close-up photographs should be taken to enable the viewer to gain a clear concept of where each object or area interrelates to another. Aerial photographs are particularly important in serial rape or murder investigations since they geographically link crime scenes together.

Program Description The Department of Criminal Justice Administration offers an undergraduate program designed for the development of knowledge and understanding of practices, theory, and concepts of justice administration, as well as to prepare students for professional careers in justice administration, law enforcement, and corrections. As the Army's primary criminal investigative organization, the "CID" is responsible for the conduct of criminal investigations in which the Army is, or may be, a party of interest. Headquartered at Fort Belvoir, Virginia and operating throughout the world, the CID conducts criminal investigations that range from death to fraud, on and off military reservations, and, when appropriate, with local, state and other federal investigative agencies. The Command supports the Army through the deployment, in peace and conflict, of highly trained soldier and government service special agents and support personnel, the operation of a certified forensic laboratory, a protective services unit, computer crimes specialists, polygraph services, criminal intelligence collection and analysis, and a variety of other services normally associated with law enforcement activities. The U.S. Army Criminal Investigation Command (USACIDC) was organized as a major command of the Army to provide investigative services to all levels of the Army. Using modern investigative techniques, equipment and systems, USACIDC concerns itself with every level of the Army throughout the world in which criminal activity can or has occurred. Unrestricted, CID searches out the full facts of a situation, organizes the facts into a logical summary of investigative data, and presents this data to the responsible command or a United States attorney as appropriate. The responsible command or the U.S. attorney then determines what action will be taken. Ultimately, the commander of USACIDC answers only to the Chief of Staff of the Army and the Secretary of the Army. CID has the authority to investigate felony crime affecting the Army anytime, anyplace in the world.
