SUPREME COURT: PRIVATE SCHOOLING FOR "CONFINEMENT" DOES NOT QUALIFY FOR DISTRICT FUNDING
WASHINGTON, February 26, 2002 The U.S. Supreme Court for a second and likely final time Feb. 19 declined to review an Illinois case challenging whether a school district is required to pay for private schooling that is deemed primarily to confine rather than educate a child with special needs. The mother of Dale M, a teenager in Illinois' Bradley-Bourbonnais School District, asked the school district to pay for her son's placement at Elan, a private school in Maine, after he was released from juvenile detention for repeated burglary and drug offenses in the local community. Though the Illinois state hearing officer initially granted her petition, ordering the school district to pay his costs at Elan, it was overturned by a state review officer, then traveled up the chain of state and federal appellate courts to the Supreme Court.

Matthew Cohen's Biography
Matthew D. Cohen, Esq. , is co-founder of the law firm and is well known for his work in special education law and has extensive experience in health care and mental health law. He has been the principal litigator in a number of important special education cases, most notably the Max M. v. Thompson, Lavon M. v. Turlington, McManus v. School Dist. 39, Joey T. v. Azcoitia, District 130 v. ISBE and Cara B. cases. He is the primary or collaborating author of several amendments to the mental health and special education laws of Illinois. In 1997, he was invited to the White House to participate in the signing ceremony for the Individuals with Disabilities Education Act Amendments of 1997, in recognition of his participation in the process leading to passage of that legislation. Mr. Cohen has lectured nationally on a wide variety of topics, including special education and mental health and confidentiality law and has authored numerous articles on these subjects. He has represented or consulted with hospitals, residential treatment centers, community mental health centers, agencies, police social workers and private health care, social services and education practitioners. Mr. Cohen is an adjunct professor of law at Loyola University Law School. While engaged in private law practice continuously since 1981, Mr. Cohen served as the Executive Director and Corporate Counsel of a large psychiatric services corporation from 1985 to 1990. Mr. Cohen received his law degree from the University of Minnesota (1981) and his bachelor's degree from Grinnell College (1977).

Mike Lawch
Mike Lawch graduated from Northwestern University in 1972 with a BS in Industrial Engineering and Management Science. He received his Masters in Management from the Kellogg Graduate School of Management at Northwestern in 1974 with majors in accounting, finance and quantitative methods. Michael received the highest grade in the State of Illinois on the May, 1974 CPA exam and is a non-practicing CPA is both Illinois and Texas.
After graduation, he began his career as an operational auditor for the Far East Division of Exxon Corporation and then went on to hold a variety of financial positions including Assistant Controller and Treasurer for Aminoil USA, a large independent oil and gas company in Houston, Texas. He left Aminoil in 1985 and joined Criterion Investment Management Company, a major publicly traded Fixed Income Manager with $3 billion in assets under management, as Vice President and Chief Financial Officer. Upon the sale of the company in 1995, he left to become a full time trader of futures, options on futures, stocks, and equity options for his own account.
