Voluntary Acknowledgment of Paternity For Unmarried Parents New 2000 Illinois Laws That Help Domestic Violence Victims Full Faith and credit Enforcement of Out-of-State Protective Orders (Public Act 91-0903 Effective January 1, 2001) On July 6, 2000, Illinois amended the Criminal Code, Codes of Criminal and Civil Procedure, and the Illinois Domestic Violence Act in Public Act 91-0903. The Act states enabling language that authorizes law enforcement officers and courts to give full faith and credit to victims' out-of-state protective orders pursuant to the Federal Violence Against Women Act of 1994. Under Illinois law, a protective order issued by a state, tribal or territorial court related to domestic or family violence shall be deemed valid if the court that issued the order had jurisdiction over the parties and the matter under their law. There is a presumption of validity if an order is certified and appears authentic on its face. California's Castration Law California's new law mandating castration for certain sex offenders was passed on Aug 30, 1996, and became part of the criminal code on Jan. 1, 1997. According to this law (chapter 645 of the penal code) offenders convicted for the second time of rape, oral copulation, sodomy, or lewid or lavicious acts in cases in which "the victim has not attained 13 years of age, shall, upon parole, undergo medroxyprogesterone acetate treatment or its chemical equivalent, in addition to any other punishment prescribed for that offense or any other provision of law." There are several problems with this law: There is no provision that the state prove that this treatment will actually prevent recidivism. There is no rationalle provided to explain why these offenses have been singeled out over others. The provision that the offender is still subject to "any other punishment prescribed for that offense or any other provision of law." implies that he may still be subject to civil commitment or to mandatory registration. If the castration solves the problem of recidivism, why is he elligible for additinal sanctions? If he is still dangerous and these sanctions are necessary, how is the castration justified? It has never been proven that castration will actually prevent recidivism in sex offenders. Castration has certainly never been linked specifically to sexual acts against children. The etiology of sex offending is complex. There are biological, psychological, social, cognitive factors involved. How does the specified treatment relate to these factors?

Rohypnol: A Concentrated Response By Stacey Champagne, Second Year Administration occurred (Staten, 1996). One of the first steps in reframing the issue is to enact state legislation similar to federal policy which condemns the use of controlled substances in perpetrating violent crimes. Current state legislation must therefore be changed to: (1) classify Rohypnol under the strictest category of substances under the Controlled Substances Act of 1970, Schedule I; and (2) acknowledge drug related sexual assault as a felony under the criminal code. As mentioned previously, Illinois law only censures the non-medical use of Rohypnol, thereby framing the issue of the drug in medical/health terms. However, Rohypnol must be explicitly recognized as a drug used to facilitate violent and serious crime. Those individuals in positions to develop and alter policy must be made aware that Rohypnol is not only illegal and poses physical danger, but that it is utilized as a stealth weapon to perpetrate violent acts of sexual assault against women. If Rohypnol was classified as a Schedule I drug, and drug-related sexual assault was designated a felony under the criminal code, this crime would be punishable by a mandatory jail sentence of 30 years. Therfore, implicit in this new legislation would be a broad social goal of intolerance of violence against women.

Courtrooms in the Clouds: The Law and the Skin Trade in the Windy City Illinois Starts Total Revision of the Criminal Code by J. D. Obenberger, Attorney at Law Thirty-nine years ago, the Illinois state legislature made a wholesale revision of all of the criminal laws that were on the books. By 1961, our State was nearly 150 years old, and the criminal laws resembled a mess in Grandma’s attic: There were criminal laws from every era and time, from the nineteenth century to that time. Some of the laws seemed to be at odds with one another, some of them seemed to deny common sense, and a great many of them had been passed at the urging of well-funded special interests, including industry lobbying groups. They were just strewn haphazardly into the law books, and you might find a crime laid out in sections dealing with mortgages or divorces or autos. The legislature had two advantages in doing the job in 1961. As you should know, except for Louisiana, all of the state jurisdictions in the United States, and the federal government, are “common law” jurisdiction, with laws derived from basic principles of English law as to who should be punished and under what circumstances. In 1957 England had just studied its centuries-old body of criminal law with a blue-ribbon commission that examined the extent to which private “morals” matters should be the subjects of criminal laws. The Wolfenden Report sent shockwaves throughout the English-speaking world by its affirmation that, in matters of private moral behavior, society and the criminal law should defer to personal freedom. The Wolfenden Report’s recommendation that prostitution per se remain legal in England and that private homosexual conduct, including sodomy, be free from criminal sanctions, together with another English re-examination of how the criminal law looked at Heroin addiction, started a debate about the limits of what the criminal laws should punish among all of the peoples around the world who speak English and derive their legal systems from the English tradition.
