"Let's make sure that business and residential consumers choosing to buy green power don't get green scammed. We want to see real green power that helps to produce real environmental benefits," said Howard Learner, Executive Director of the Environmental Law and Policy Center. "This standard will define for consumers what is legitimately green power. A consistent standard for make the competitive playing field clear for both Illinois electricity suppliers and for the public." How Does the New Federal Job Creation and Worker Protection Act Affect Illinois Income Tax?
Net income subject to Illinois income tax begins with federal "adjusted gross income" for individuals and federal "taxable income" for all other taxpayers. "Adjusted gross income" is taxable income before exemptions, the standard deduction or itemized deductions are taken into account. Any federal law changing the computation of adjusted gross income or taxable income automatically changes the computation of Illinois net income, unless a specific provision of Illinois law reverses the effect of federal law. For taxpayers other than individuals, the law requires any net operating loss deduction to be added back. The law then provides for separate computation and carryover of Illinois net losses by all taxpayers except individuals. The law allows Illinois net losses to be carried back 2 years or forward 20 years, and without regard to federal carryover periods. Accordingly, individuals automatically get the benefit of the 5-year carryback period allowed in the Job Creation and Worker Protection Act, because they are allowed to take the federal net operating loss deduction in computing their Illinois net income. All other taxpayers are allowed only the 2-year carryback period provided by Illinois law.

General Information

The General Assembly created the Teachers' Retirement System of the State of Illinois (TRS) in 1939 for the purpose of providing retirement annuities and other benefits for teachers, annuitants, and beneficiaries. TRS is a public pension defined benefit plan that provides its members with retirement, disability, and survivor benefits. Membership
TRS is the retirement system for public school teachers and administrators employed in all Illinois public schools except the city of Chicago. As of June 30, 2002, there were 155,979 active members and 66,971 inactive members in TRS. In addition, 67,949 annuitants and beneficiaries were receiving benefits. The average age of a member is 43. The average age of an annuitant is 70. As of June 30, 2002, the average monthly retirement annuity was $2,462. Back to top Key statutory provisions
TRS is a governmental plan as defined in the Internal Revenue Code of 1986, Section 414(d), as amended, and the Employee Retirement Income Security Act of 1974, Section 3(32), as amended. TRS is a qualified plan under the Internal Revenue Code of 1986, Section 401(a), as amended.

ALR: American Law Reports

Published since 1888, this legal research tool contains countless articles on narrow topics of law. Originally called the Lawyers Reports Annotated , the title was changed in 1919 to the American Law Reports . There are two series of the Lawyers Reports Annotated , and five series of ALR plus a sixth which contains only Federal Cases. ALR articles, called annotations, begin with the full text of a demonstrative case followed by a discussion of the legal trend or doctrine it represents. If you find an annotation in ALR on your topic, it will provide citations to relevant cases, statutes, law reviews, other ALR annotations, as well as prevailing policy arguments and legal doctrine for the issue covered. Except for those contained in the ALR Federal series, ALR annotations are not jurisdiction specific. Within each article, there is a Table of Jurisdictions directing you to cases within specific states.

O'HARE EXPANSION Plan to enlarge airport violates constitutional law, legal scholar says CHAMPAIGN, Ill. A University of Illinois law professor says that proposed federal legislation to give Chicago the green light to proceed with a $6.6 billion expansion of O'Hare International Airport is unconstitutional. Ronald D. Rotunda, a UI professor of law, wrote last month that the hotly debated O'Hare bill, sponsored by Sen. Dick Durbin, D-Ill., and Rep. William Lipinski, D-Ill., would violate the 10th Amendment right of states to make laws for municipalities free of federal intervention. Rotunda offered his opinion at the request of Rep. Henry J. Hyde, R-Ill. "Congress cannot confer powers on a political subdivision of a state where the state has expressly limited its delegation of state power," Rotunda wrote. Thus, the UI scholar contended that the bill letting Chicago expand O'Hare runways as a matter of federal policy implemented by U.S. aviation officials would subvert the provisions of the Illinois Aeronautics Act.
