American Federation of Teachers. (1996). Charter school laws: Do they measure up? Washington, DC: Author.
    Based on the AFT criteria for effective charter legislation, this report analyzes the legislation in 25 states. These criteria reflect accessibility to all students, high academic standards, standardized methods for assessing student performance, collective bargaining agreements for staff, certification of teachers, approval of local school districts, and reporting requirements. None of the state laws met all of the criteria. Although special education was not identified as a particular point of analysis, it was addressed in several of the criteria. For example, effective legislation should start with explicit language that ensures participation of all public school students. Schools that target students on the basis of academic or athletic ability are risking discrimination against students with disabilities. Likewise, schools that recruit "at-risk" students are not inclusive if the definition of "at-risk" is vague. Strategies for assessing student performance need to be adapted to reflect the unique learning styles and curricular needs of students with disabilities. School reporting should include student demographics that reflect the special needs of its students.

BEALL, Times-Union Staff Writer “Disabled” doesn’t mean “unable”, Tammy Ummel, director of the North Central Indiana Special Education Cooperative, told the Warsaw Community Schools Board of Trustees Monday. “We want to think of young students with disabilities as students first,” she said. “They have unique skills and abilities.” The cooperative serves 1,816 students in five school corporations – 30 public schools and six to 10 private schools, Ummel said. In the Warsaw schools alone, 784 students are being served – or 12.9 percent of the student population. Of those students: 324 have a learning disability; 28 have a communication disability; 113 are mentally handicapped; 56 are emotionally handicapped; 11 are autistic; 16 have other disabilities; 10 have multiple disabilities and 10 have orthopedic disabilities. “We’re seeing students with more complex needs,” she said. “We’re meeting those needs by taking the services to the students and having a highly trained staff to focus on those needs.” In other business, Superintendent Dr. Lee Harman announced Jefferson Elementary school was selected as one of 32 schools to receive training to become a pilot school for the Four-Block Literacy Model in Indiana.

Paula Rosen, Northeast Regional Director of Lutheran Special Education Ministries In a New York Lutheran High School, a student with a reading disability achieves honor roll status with the support of the resource room teacher. In Illinois, a child diagnosed with ADHD (Attention Deficit/Hyperactivity Disorder) and his classroom teacher receive support from the on-site consultant special education teacher. In California, a little girl with a math disability works three days a week with a special education teacher building her skills. In Michigan, a child with a hearing impairment receives special instruction toward confirmation. A preschool staff in Indiana attends a workshop about how to include a child with special needs in their school. In Minnesota, a child with a writing disability receives special instruction on the writing process and keyboarding lessons from the special education teacher. It's a lose-lose situation when the parents of a special needs child go to
battle with a school system over their child's education, says Christopher
Tallo, a Pierceton pediatrician and member of the board of directors for the
Down Syndrome Association of Northeast Indiana.
Both schools and parents are at a financial risk when they go to a due
process hearing to decide a child's future. When a party forces due
process costs can reach thousands of dollars. Continuing the appeal
process in the court system can cost much more. Time costs for teachers, administrators, and family members aren't figured in. Neither is the emotional toll for everyone involved. Schools are obligated by the Individuals with Disabilities Education Act—federal legislation which outlines special education across the country—to place children with special needs in the least restrictive environment that's appropriate.
