CERD General Recommendation XXIII (Fifty-first session, 1997): On the Rights of Indigenous Peoples, A/52/18 (1997) 122 at paras. 1-6. 1. In the practice of the Committee on the Elimination of Racial Discrimination, in particular in the examination of reports of States parties under article 9 of the International Convention on the Elimination of All Forms of Racial Discrimination, the situation of indigenous peoples has always been a matter of close attention and concern. In this respect, the Committee has consistently affirmed that discrimination against indigenous peoples falls under the scope of the Convention and that all appropriate means must be taken to combat and eliminate such discrimination. 2. The Committee, noting that the General Assembly proclaimed the International Decade of the World's Indigenous Peoples commencing on 10 December 1994, reaffirms that the provisions of the International Convention on the Elimination of All Forms of Racial Discrimination apply to indigenous peoples. 3. The Committee is conscious of the fact that in many regions of the world indigenous peoples have been, and are still being, discriminated against and deprived of their human rights and fundamental freedoms and in particular that they have lost their land and resources to colonists, commercial companies and State enterprises. Consequently, the preservation of their culture and their historical identity has been and still is jeopardized.

    Author's Note: In the above work, notice the sense of expanding serenity and groundedness, the feeling of being held within multiple flowings of vast energy.     For Land, Nature, Life and the Future The 336 representatives of the Mayagna, Miskito, Rama indigenous peoples, ethnic communities, 10 representatives of the Honduran Moskitia, and over 1,200 leaders, visitors and observers that met in the city of Bilwi from the 20th to 26th of February in the "Juan Amos Comenius" Moravian Institute, Taking into consideration that: Indigenous territory is the heritage of the peoples that live within it and thereforeis an inalienable right and guarantees the preservation of our cultures and identities. This territory has been recognized by international agreements that hold up this ancestral right of ownership, under a system of communal coexistence with other cultures, respect for nature, the necessary use of its natural resources and historic heritage for our future generations. The Constitution of the Republic establishes in its Fundamental Principles that "The State recognized the existence of Indigenous peoples who shall enjoy the rights, responsibilities, and guarantees provided by the Constitution, and, in particular, those of maintaining and developing their identity, culture, their own forms of social organization and administration of local affairs; likewise, to maintain communal forms of property on their lands and possession, use, and enjoyment of the same, in full conformity with the Law." [Article 5, Constitution] It is noted in Article 180 of the Constitution that "The communities of the Atlantic coast have the right to live and develop themselves under forms of social organization that correspond to their historical and cultural traditions." It goes on: "The State guarantees these communities enjoyment of their natural resources, effectiveness in their forms of communal property and free election of their authorities and legislative representatives."     We, the undersigned Indigenous peoples and organizations, would like to draw the attention of the General Assembly to questions related to the budget for the United Nations Permanent Forum on Indigenous Issues.
    Allow us to also draw your attention to the fact that Indigenous peoples worldwide (1) want the Permanent Forum on Indigenous Issues to have a Separate Secretariat; and (2) want the Secretariat of the Permanent Forum to be staffed by qualified Indigenous persons.
    Financing of the activities of the Permanent Forum:
    The success of the Permanent Forum on Indigenous Issues depends very much on the financial arrangements for its activities. We hold the view, that it is crucial that the General Assembly, through the Regular Budget of the UN, provide the necessary financial resources for the functioning of the Forum, including the establishment of a separate secretariat. Moreover, we strongly encourage governments to support the functioning of the Permanent Forum through voluntary financial contributions.

    Full text Introduction The European Union believes that building partnerships with indigenous peoples is essential to fulfil the objectives of poverty elimination, sustainable development, and the strengthening of respect for human rights and democracy. The EU has in recent years significantly enhanced its policy framework and positive actions in promotion and protection of the rights of indigenous peoples, and the European Parliament and the Council have played an important role in the development of this support. In preparing this report, the Commission took the opportunity to consult widely with indigenous peoples’ organisations, in addition to its own staff in Delegations, to establish their views of progress achieved on the ground. Given the original time-frame of the intended review, and the nature of the research involved, the report focuses on those activities which the Commission decided to finance between 1998 and 2000. The report highlights the key recommendations of the Resolution and the Working Document, and the opportunities and problems encountered in working towards these goals. Against this background, the report assesses the progress achieved so far and, importantly, the work which remains to be done.
