RESEARCH
The Health Law and Policy Institute is committed to research and is actively engaged in the study of health issues affecting the state and nation. Each biennium since 1991, the Texas Legislature has appropriated special item funding to the Institute to study important issues of health law and policy. The Institute's studies on such issues as occupational injury and illness nonfinancial barriers to health care , and family violence and the health care system have helped to set the stage for legislative action. E-mail us at healthlaw@uh.edu for information about ordering these studies. 2002/2003 Health Policy Fellows In addition to its research for the Texas Legislature , the Institute has worked with other entities, such as the Texas Cancer Council , the National Institutes of Health , and the U.S. Department of Energy, on major research projects. From 1996 to 1999, the Institute coordinated the activities of the Texas Cancer Council's Managed Care Steering Committee, including furnishing speakers, tracking health care legislation at the local and national level, and providing the Committee with legal and policy research and briefing papers on a variety of issues related to managed care and cancer. The Institute monitored the development of Independent Review Organizations and health plan report cards. The Institute worked with the Committee on the development of three employer- and consumer-oriented publications: Small Employers Guide to Health Care Plans Cancer and the Law: 1998 Choosing a Health Care Plan" Recently, the Institute was involved in a project that profiled local tobacco worksite ordinances in the absence of state policy regulation. DISTRIBUTION OF SEXUALLY EXPLICIT PUBLICATIONS ON CAMPUS From time to time, ASU receives complaints about "adult" publications distributed on campus. Often the complaints arise from sexually suggestive photographs on the covers of these publications. Some students, employees and visitors to campus have told us that they find the publications and the photographs offensive and inappropriate in an educational environment. Others have expressed concern that children on campus for various programs are also being exposed to these publications. The purpose of this briefing paper is to explain the applicable law regarding the distribution of sexually explicit publications on campus and to identify campus resources for individuals who may have concerns about this material. The final section of this paper also identifies additional campus resources for addressing speech issues. A. Legal Issues
The First Amendment to the U.S. Constitution protects the press from governmental interference. It prohibits government action "abridging the freedom of speech." Courts have interpreted this to mean that governmental entities cannot restrict or prohibit the content of speech, except in very limited circumstances. Obscene speech is not constitutionally protected and can be restricted. Even if the content of speech is otherwise "legal," a governmental entity can impose reasonable time, place and manner restrictions on it. The Arizona Constitution provides even broader protection to the press. It provides that "every person may freely speak, write, and publish on all subjects, being responsible for abuse of that right."

The Hotline Outcomes Assessment StudyPhase III. Final Report: Full Scale Telephone Survey by Jessica Pearson and Lanae Davis with appendix by Bob Echols and Julia Gordon. The Project for the Future of Equal Justice, a joint project of CLASP and the National Legal Aid and Defender Association, and the Center for Policy Research recently completed the Hotline Outcomes Assessment Study, an independent assessment of the effectiveness of using telephone Hotlines to provide brief legal advice and referrals to low-income people. This report describes the results of Phase III of the Study, which researched whether clients understand the advice they are given by Hotlines, whether they follow up on it, and whether they realize a satisfactory resolution of their problems. The report offers a set of recommendations to improve favorable hotline outcomes. (Publication No. 02-69). Child Support: An Important but Often Overlooked Issue for Low-Income Clients by Paula Roberts. Many legal services programs assist neither custodial nor noncustodial parents in basic child support matters. Since the many local child support enforcement agencies that are left with this work struggle to provide adequate and timely service, a good argument can be made for more legal services program involvement in this area. STANDARDS FOR LEGAL REPRESENTATION OF CHILDREN, PARENTS AND THE CHILD WELFARE AGENCY INTRODUCTION Children's interests are not well served unless all parties have good legal representation. Courts face difficult decisions about how best to protect children and judges need to be confident that they are reaching the best-informed decision about a child's future. "Given that attorneys and other advocates often determine what information a judge is presented with, it is vital that all parties in child abuse and neglect cases have adequate access to competent representation so that judges can make informed decisions." (NCJFCJ Child Abuse and Neglect Cases: Representation as a Critical Component of Effective Practice , 1998, p. 3.) These Guidelines are meant to clarify what is good practice in child welfare legal representation. Lawyers become involved in a child welfare case whenever legal proceedings are contemplated or actually initiated. They can greatly influence a case, for good or ill, depending on their level of involvement, their training and experience, and the legal standards governing their conduct. Some States have established formal standards for lawyers representing children, and the American Bar Association House of Delegates adopted Standards of Practice for Lawyers Who Represent Children in Abuse and Neglect Cases (February 1996). The ABA Standards, however, are merely advisory and have no legal authority in individual States. To our knowledge, there are no national standards at all for legal representation of the child welfare agency or of parents accused of child maltreatment.

This extract from the Guidance document indicates that the police and other authorities should be aware that home educated children are not truants. Education Otherwise provides to all members a card for children to carry which indicates that they are home educated. It is not a requirement that children carry this card; it is up to parents and/or the children to make the choice. Children being educated otherwise than at school
4.20 In planning for, and operating, a truancy initiative using the new power it is important to remember that not all children aged 5-16 are registered at school. Children educated outside the school system altogether (see paragraph 4.1), for example, by home tuition, might be out and about during the daytime for wholly legitimate reasons, for example visiting a library.
