9-43.100 Prosecution Policy Relating to Mail Fraud and Wire Fraud
Prosecutions of fraud ordinarily should not be undertaken if the scheme employed consists of some isolated transactions between individuals, involving minor loss to the victims, in which case the parties should be left to settle their differences by civil or criminal litigation in the state courts. Serious consideration, however, should be given to the prosecution of any scheme which in its nature is directed to defrauding a class of persons, or the general public, with a substantial pattern of conduct.

What is e-mail fraud, and what should I do about it?
There are many types of fraud, and e-mail is an inexpensive and thus popular method for distributing fraudulent messages to potential victims. According to the US Secret Service, millions of dollars are lost annually to fraud. Never respond to any message that asks you to send cash or personal information. You won't receive any riches, and in fact, you could get into legal trouble if you get tangled in one of these webs. Some of the most common fraudulent messages are non-monetary hoaxes or non-monetary chain mail . Treat these as you would spam; for more information, see the Knowledge Base document What should I do when I get spam e-mail? However, if you receive an e-mail message that appears to involve money, or asks for personal information, do not respond . See the information below to determine what you should do with this type of e-mail.

Former Adjuster Pleads Guilty To Mail Fraud
January 24, 2003 An insurance adjuster faces a maximum sentence of five years and a $250,000 fine after pleading guilty to mail fraud in U.S. District Court in Lexington, Ky.
According to the Lexington Herald-Leader , Wail J. Lodhi of Bradenton, Fla., promised to settle a Lexington man's workers' compensation claim for $75,000 in exchange for a $25,000 kickback.
The former adjuster for St. Paul Fire and Marine Insurance Co., was arrested by postal inspectors in October, when he drove to Lexington to collect the kickback.

By Ben Fritz In a new twist on the Social Security debate, some House Republicans are pushing legislation that would issue a certificate to Social Security recipients falsely claiming to guarantee that their benefits cannot be cut. This legislation takes dissembling beyond what we have come to expect from politicians, making the federal government itself just another instrument for false rhetoric. Two versions of the bill The Social Security Benefits Guarantee Act of 2001 and The Social Security Guarantee Act of 2001 are before the House, sponsored by Reps. James DeMint, R-S.D., and Walter Jones, R-N.C., respectively. Both propose the same thing: that senior citizens shall, as soon as they become eligible for Social Security, receive certificates from the secretary of the treasury guaranteeing that they will receive the Social Security benefits promised under the law and that those benefits will be indexed for inflation.

I've been doing a paper on the history of mail fraud and I was interested to see in one history of the postal inspector's office, that Dickens published an expose of some of the more notorious English mail con artists. The author seemed to think it was in "Sketches By Boz", but the particular collection of the "Sketches" I've been able to find (on Project Gutenberg) doesn't appear to have the info in it. Can someone give me more specific information - like a title of the actual essay or a date, or alternate collections of the "Sketches" which might have this work? Thanks! Jason

    WHEN THE F.B.I. COMES CALLING... You may be charged with: Mail Fraud is the oldest form of fraud statutorily regulated and prosecuted by the federal government. Like other forms of white collar fraud, the objective of mail fraud is to accomplish a desired result by deception, trickery, concealment, and/or dishonesty, albeit through the use of the United States Mail Service or other private/commercial interstate carriers. Statutorily regulated since 1872, the United States Supreme Court has repeatedly upheld the authority of Congress to pass the statute.
    Interpretation of today's revised mail fraud statutes finds generally that four elements must be met for an individual or organization to be convicted of mail fraud. An Assistant United States Attorney (AUSA) must present evidence that when submitted to a jury or judge would prove beyond a reasonable doubt:
    1. That the defendant knowingly created a scheme to defraud;

    Harmon guilty of mail fraud
    Former state assemblyman involved in mortgage scam

    LAS VEGAS SUN Former state Assemblyman Harley L. Harmon was found guilty this morning in federal court of 34 counts of mail fraud in connection with a multimillion-dollar mortgage scandal. Harmon, 55, showed little emotion as the jury's verdict was read. Halfway through the verdict, he put his head down and stared at the desk in front of him. He faces up to five years in prison on each count a potential sentence of 170 years. He could also be fined when he is sentenced before U.S. District Judge Philip Pro. Sentencing is set for 9:30 a.m. May 2. The judge and attorneys will discuss sentencing issues on Feb. 21. Harmon walked out of the courtroom this morning showing no emotion. "I have no comment," Harmon said, responding to reporters' questions. Pressed further, he said, "You have to be kidding." His attorney, Frank Cremen, said he would "take all appropriate measures." Asked if he would appeal, he said, "absolutely." Harmon was tried on 34 counts of mail fraud after a joint FBI and Metro Police investigation into the operations of the now defunct Harley L. Harmon mortgage company. He had been indicted in April 2001 on 71 counts, but most were dropped because some witnesses were unavailable.

    LAS VEGAS SUN Larry Wayne Harris, who was arrested in Henderson this week after supposedly carrying enough deadly anthrax germ to "wipe out" Las Vegas, has a troubled history with fatal biological material. Harris also is aligned with a racist, anti-semitic movement that refers to Jews as the "children of Satan" and blacks as "subhuman mud people." A registered microbiologist who holds art degrees from Ashland University and Ohio State University, Harris, 46, who was born in Richlands, Va., was thrust into national notoriety in 1995. In May of that year, he was arrested at his Lancaster, Ohio, home with three vials of freeze-dried yersinia pestis, an organism that causes bubonic plague. The bubonic plague killed one-fourth of Europe in the 1300s but now can be treated with antibodies. Harris' samples, which were inert, were in the glove compartment of his Subaru. None of the vials had been opened. Harris reportedly paid $240 for the samples and received them via Federal Express from American Type Culture Collection, a lab in Rockville, Md.

    Mail fraud continues to be a problem in America, according to data provided by the U.S. Postal Service. The number of arrests for mail fraud, as with other crimes, understates the extent of the problem. For an assortment of reasons, many of those who engage in these illegal practices never are charged with crimes.
    Generally, promoters scheme to get your money by offering a product, service or investment that does not comply with its claims. If the U.S. mail is used as a part of a fraudulent scheme, it becomes mail fraud.
    Although the sales pitch may be made over the telephone, if you are asked to mail in a check for the product or service, this can be a form of mail fraud. Common mail-fraud practices include ads selling land, work-at-home schemes promising hefty incomes for performing mundane tasks, fraudulent charitable fund-raising, investment scams, non-existent job opportunities, chain letters and others.
    Most fraudulent schemes offer a deal that seems too good to be true. This enables promoters to maximize profits early and get out before the authorities catch them. The best protection is to remain alert and skeptical. If the deal seems too good to be true, assume it is.
