HEADLINES February 5, 2003 Maine Homeschoolers Fight Against Repressive Regulations Maine Legislative Document 160 would create a new homeschool option free of the needless restrictions the Department of Education has imposed through its rules. The bill would allow home schoolers to breathe freely after 20 years of stifling micromanagement. This new legislation would be an amazing improvement for Maine's homeschooling families. Under these new requirements, parents would only be required to provide a notice to the Commissioner of Education 14 days before the beginning of the home instruction program. The notice must contain the parent's name, signature address, the child's name and age, the date home instruction will begin, assurance that 175 days of instruction will be provided in the required subjects (same as currently required). Parents must send a letter to the Commissioner before September 1 every year thereafter, stating whether they intend to continue home education for the child.

Clarification on Eligibility for Students with Attention Deficit Disorder (ADD) and Attention Deficit Hyperactivity Disorder (ADHD)
A student with Attention Deficit Disorder (ADD) and Attention Deficit Hyperactivity Disorder (ADHD) can be identified under Individuals with Disabilities Education Act (IDEA) Part B under "Other Health Impairment," "Specific Learning Disability," or "Emotional Disability" or under Section 504 of the Rehabilitation Act of 1973. This clarification was provided in a memorandum to Chief State School Officers from the Assistant Secretaries of the Offices of Special Education and Rehabilitative Services (OSERS), Office for Civil Rights (OCR), and Office of Elementary and Secondary Education (EASA) on September 16, 1991. Please note the references in this memorandum are to IDEA regulations and to section 504. these are Federal laws.

Roles in the Dispute Resolution Procedure
Advocates
Parents are often confused about who qualifies as an advocate and what an advocate's role is, as compared to the role of a lawyer. Ideally, an advocate is someone with specialized training in special education and Maine State Education Regulations (MSER). An advocate should be able to help identify the key issues, understand how they relate to special education law, and support the parent in articulating those points. Some advocates have formal legal training; many do not. Some advocates volunteer their services, while others charge a fee for their time. FMI See MSER 111 13.4 p. 81.
Lawyers
Lawyers are trained legal experts. Most lawyers focus their law practice on a specific branch of law (i.e. corporate law, criminal law, labor law, family law, etc.). If you are seeking the services of a lawyer to assist you in dispute resolution, it is wise to ask what level of experience they have in special education law.

Some individuals work only as mediators, while others serve as hearing officers or complaint investigators. As stated previously, each one will vary in their own style. We are a very diverse group, and it has been possible for us to practice home education without the state requiring that we conform to any single educational model or method. Homeschoolers have asserted their need to choose the educational approach that is most suitable for their unique situations, and the state has not objected to a relatively wide interpretation of the provisions of Chapter 130. It would be difficult to attempt a description of all the approaches to learning that can fit under the term home education. EQUIVALENCY OF FOREIGN LEGAL EDUCATION
The Board has adopted the following regulation pursuant to Maine Bar Admission Rule 14 in order to administer its duties under Maine Bar Rule 10(c)(4): An applicant who has graduated from a foreign law school may be deemed to have a legal education equivalent to that provided in those law schools accredited by the American Bar Association if the applicant shall have successfully completed, as part of the law school education or at a law school accredited by the American Bar Association, at least 24 semester credit hours, or the equivalent, of courses dealing with either the law of the United States or the law of one of the States of the United States, and with at least 16 of those semester credit hours from among at least five of the categories enumerated below:
