MISSISSIPPI GAMING COMMISSION, NO. 1999-CC-00548-SCT TOPIC(S) : Charitable bingo - Arbitrary and capricious decision - Injunctive relief AUTHOR : Presiding Justice Pittman FACTS ANALYSIS Issue 1: Arbitrary and capricious decision Post 134 argues that the Commission's decision was arbitrary and capricious. A decision which is not based on substantial evidence is arbitrary and capricious. In this case, there was overwhelming evidence which justified the revocation of Post 134's license. The violations were witnessed by the agent who went undercover to investigate the complaint and were supported by session reports, monthly reports, and bingo paper which were entered into evidence. One regulation which was violated, Regulation A, § 2(d)(7), provides that a violation of the section will result in revocation of the license. Therefore, the hearing officer had to revoke the license upon finding a violation of the section. Since the record includes substantial evidence of violations by Post 134, the Commission's decision to revoke the license was not arbitrary and capricious. Issue 2: Issuance of injunction HOLDING : Affirmed on direct appeal; vacated on cross-appeal.

PROPOSED BALLOT SUMMARY: This initiative would amend the Mississippi Constitution to require a non-prevailing party in a civil action to pay attorneys' fees to a prevailing party. A non-prevailing party could avoid liability for attorneys' fees only if he offers to allow judgment to be entered against himself for a specified amount, the prevailing party then rejects that offer but does not obtain more than that offer at the conclusion of the trial. The number one priority in the FBI's Civil Rights Program is the investigation of hate crimes. The FBI's jurisdiction pertaining to hate crimes is primarily predicated on four federal statutes:
Title 18, United States Code (U.S.C.), Section 241
(Conspiracy Against Rights);
Title 18, U.S.C., Section 245
(Interference with Federally Protected Activities);
Title 18, U.S.C., Section 247
(Damage to Religious Property; Obstruction in Free Exercise of Religious Beliefs); and
Title 42, U.S.C., Section 3631
(Criminal Interference with Right to Fair Housing).
Although the Hate Crimes Statistics Act of 1990 (amended in 1994 and 1996) defines a hate crime as a crime against a person or property motivated by bias toward race, religion, ethnicity/national origin, disability, or sexual orientation, the FBI does not have any federal jurisdiction to investigate hate crimes motivated by a sexual orientation bias. The FBI's authority to investigate hate crimes motivated by a disability bias is generally limited to incidents interfering with the victim's housing rights.
The most recent available hate crimes statistics compiled by the FBI are for the year . During 1999, 7,876 hate crime incidents were reported to the FBI by 12,122 law enforcement agencies in 48 states and the District of Columbia. The 1999 statistics reflected the following:

The FBI's Civil Rights Program The Federal Bureau of Investigation is the primary federal agency responsible for investigating all allegations regarding violations of applicable federal civil rights laws. These laws are designed to protect the civil rights of all citizens and inhabitants. The mission of the FBI's Civil Rights Program is to enforce federal civil rights statutes and to ensure that the protected civil rights of all inhabitants are not abridged. The FBI's Civil Rights Program consists of the following four sub-programs:
  • Racial/Religious Discrimination
  • Color of Law/Police Misconduct
  • Involuntary Servitude/Slavery
  • FACEFreedom of Access to Clinic Entrances
Although Color of Law/Police Misconduct investigations represent approximately 75% of the caseload for the FBI's Civil Rights Program, the top priority of the Civil Rights Program is Hate Crimes. Hate Crimes Defined Hate crimes present a particularly difficult challenge for law enforcement because they are more violent, socially disruptive, random, and serial in nature than ordinary crimes, and are more difficult to solve. This is because there is a terroristic component associated with hate crimes, whereby even a relatively minor incident can breed fear and distrust across fragile intergroup lines. Research has also shown that hate crimes tend to be more violent, more traumatic to the victim, and sometimes committed by groups of perpetrators who are previously unknown to the victim. Such crimes terrorize the entire targeted community.
