ALR: American Law Reports

Published since 1888, this legal research tool contains countless articles on narrow topics of law. Originally called the Lawyers Reports Annotated , the title was changed in 1919 to the American Law Reports . There are two series of the Lawyers Reports Annotated , and five series of ALR plus a sixth which contains only Federal Cases. ALR articles, called annotations, begin with the full text of a demonstrative case followed by a discussion of the legal trend or doctrine it represents. If you find an annotation in ALR on your topic, it will provide citations to relevant cases, statutes, law reviews, other ALR annotations, as well as prevailing policy arguments and legal doctrine for the issue covered. Except for those contained in the ALR Federal series, ALR annotations are not jurisdiction specific. Within each article, there is a Table of Jurisdictions directing you to cases within specific states.

Summary of Opinion
The Mississippi Attorney General was asked whether a county may require a landowner to fence in livestock from public roads. The Attorney General responded that no such authority exists, but that a county may enact criminal ordinances imposing fines on landowners who do not fence their livestock off public roads.

Hazlehurst, Mississippi 39083-0869 Dear Mr. Shannon: Attorney General Mike Moore has received your request for an opinion and has assigned it to me for research and reply. Your entire letter is attached for ease of reference. Your letter poses two questions which we will state and answer in order. Does the county have any authority to require the landowner to fence the area or to fence the area on the county right-of-way? Miss. Code Ann. Sec. 69-13-205 states: The respective boards of supervisors of the several counties of the state, in their discretion, are authorized and directed to erect, construct and maintain suitable fences and cattlegaps along the right of ways of United States Highways and state designated highways to prevent livestock from running at large as provided hereinafter. However, nothing in this article shall apply in any county coming under the state stock law. The board of supervisors in any county having voted to come within the provisions of the statewide stock law, may maintain any fence or fences constructed under the authority of this article from any funds not public funds, donated by any person, firm or corporation for said purposes and further, may receive and accept funds from the Mississippi State Highway Commission for the relocation of said fence or fences required by said commission. In its discretion and in the alternative, said board may authorize any person, firm or corporation to maintain said fence or fences.

S o begins the Mississippi Open Meetings Law, establishing the principle that public government must be open to the public. The Mississippi Public Records Act grants citizens the right of public access to public records:
All public records are hereby declared to be public property, and any person shall have the right to inspect, copy of mechanically reproduce or obtain a reproduction of any public record of a public body in accordance with reasonable written procedures…No public body shall adopt procedures which will authorize the public body to produce or deny the production of a public record later than fourteen working days from the date of request for the production of such record. The Mississippi Department of Transportation Office of Law Enforcement is responsible for enforcing Mississippi's size, weight and load laws, fuel tax laws, privilege license laws, and the collection of these taxes.

BIOGRAPHICAL SKETCHES: JUDGE JAMES W.M. HARRIS Born in Natchez, Mississippi in 1828, James W.M. Harris studied at Amherst College and returned to his native state to read law under General Sparrow. In 1852 Harris married Mary C. Lum (1831-1871), and the couple took up residence near Vicksburg at Avenel Plantation. The young couple soon had a growing family, with the birth of daughters Annie Laura (Lola) in 1853, Caroline (Carrie) in 1855, and Natalie in 1859. Harris continued to practice law in Vicksburg, but the family cotton plantation, Avenel, also provided income. The couple's lives would change, however, with the coming of the Civil War. State Groups / Governmental Entities Article 3 § 12 of the Mississippi Constitution states: "[t]he right of every citizen to keep and bear arms in defense of his home, person, or property, or in aid of the civil power when thereto legally summoned, shall not be called in question, but the legislature may regulate or forbid carrying concealed weapons." In Wilson v. State of Mississippi , 81 Miss. 404 (1902), the Supreme Court of Mississippi affirmed a conviction for illegally carrying a concealed weapon, reasoning that the constitutional right to bear arms did not guarantee a right to carry a concealed weapon in one’s home.
