GENERAL INFORMATION REGARDING
STATE EDUCATION RULES AND REGULATIONS Statutory Authority:
The Administrative Procedures Act (Sections 84-901 to 84-920 of the Revised Statutes of Nebraska) contains the main statutory provisions detailing how state agency rules and regulations are adopted. Under state law, the terms "rules" and "regulations" may be used interchangeably. The State Board of Education has the authority to adopt state rules and regulations for carrying out the State Board's constitutional responsibilities and those responsibilities assigned to the State Department of Education by the Legislature. State regulations that are properly adopted and filed with the Secretary of State have the effect of statutory law (See Nucor Steel v. Leuenberger , 233 Neb. 863 (1989).
Nebraska Administrative Code: All Nebraska state agency regulations are compiled in the Nebraska Administrative Code (NAC). Each agency is assigned certain titles of the Code for its rules and regulations. The Nebraska Department of Education uses Titles 92, 93, and 94. The Nebraska Department of Education administration regulations are contained in Title 92 of the NAC, and each of the Department of Education's "rules" are actually "chapters" of Title 92 of the NAC. Thus, the formal legal citation to the Department's "Rule 1" is "Title 92, Nebraska Administrative Code, Chapter 1", or "92 NAC 1" when abbreviated. In addition, Title 93 is used for the Department's Personnel regulations for its state employees and Title 94 is used for Education Standards.

Laws Pertaining to Private Schools that are Home Schools from the Nebraska UniCAM site. DOCUMENT: 79-201 HEADING Chapter 79. Schools. CATCHLINE Compulsory education; attendance required. LAW 79-201. Except as provided in section 79-202, every person residing in a school district within the State of Nebraska who has legal or actual charge or control of any child not less than seven years of age and not more than sixteen years of age shall cause such child to attend regularly the public, private, denominational, or parochial day schools which meet the requirements for legal operation prescribed in Chapter 79 each day that such schools are open and in session, except when excused by school authorities, unless such child has graduated from high school. The school term shall be as provided in section 79-211.

Title 92, Nebraska Administrative Code, Chapter 20: Regulations for the Approval of Teacher Education Programs and accompanying guidelines. Effective date: March 6, 2002. Rule 21
Title 92, Nebraska Administrative Code, Chapter 21: Issuance of Certificates and Permits to Teach, Counsel, Supervise, and Administer in Nebraska Schools. Effective date: November 12, 2000. Please note : Rule 21 has been under revision since Fall 2002. The 2nd draft revision was approved by the State Board of Education in February 2003, will go to hearing on March 18, and back to the State Board for final approval in April. The addition of Alternative Certification is part of the Rule 21 revision. Until the revised version of Rule 21 is approved by the State Board of Education, the Attorney General, and the Secretary of State, Rule 21 dated November 12, 2000 is the most current document regulating the issuance of certificates and permits in Nebraska. Rule 22
Title 92, Nebraska Administrative Code, Chapter 22: Regulations Governing the Master Teacher Program. Effective date: January 13, 2002. Rule 22 was passed by the Legislature in 2000; however, no funds were appropriated to the Nebraska Department of Education for Rule 22. As stated in Rule 22, the purpose of the master teacher program was to "build a group of recognized teachers of high achievement in the teaching profession."

State Board of Education Approves New Accreditation Regulations

LINCOLN - In what could be described as an arduous seven-hour meeting Friday, the State Board of Education approved a revised draft of Rule 10, otherwise known as Regulations and Procedures for the Accreditation of Nebraska Schools. The regulations will be scheduled for public hearings later this year. Two points of contention in the revised draft, which exceeded 100 pages, accounted for most of Friday's debate. Much discussion focused on a proposed rule that would have allowed schools to more easily fill a teaching vacancy. It would have allowed a school to use an already employed teacher, not endorsed in the subject involved, without fear of being put on probation. The regulation was intended to address purported problems with teacher shortages, especially in smaller districts. What the Department of Education found, Commissioner Doug Christensen told the board at a Thursday work session, is that the teacher shortage problem wasn't actually a problem - at least for the 2001-2002 school year. In addition, Jay Sears, head of the Nebraska State Education Association, said enacting a rule where it wasn't needed might lower standards for teachers statewide.

001 Purpose and Objectives
The purpose of the Scholarship Assistance Program is to enhance the educational opportunities of Nebraska resident students by providing financial assistance to eligible students attending eligible postsecondary institutions.
002 Definitions
002.01 Commission shall mean the Coordinating Commission for Postsecondary Education. 002.02 Eligible postsecondary educational institution shall mean a public or private institution located in Nebraska which: (1) is primarily engaged in the instruction of students; (2) is satisfying the provision of Nebraska law relating to the approval and licensure of schools, colleges, and universities and is maintaining accreditation by an accrediting organization recognized by the U.S. Department of Education; (3) is offering courses of instruction in regularly scheduled classes to regularly enrolled undergraduate students who have received high school diplomas or the equivalent, or are beyond the age of compulsory school attendance; and (4) is complying with the Commission's request for information needed for determining institutional allocations as set forth in 003.02 of the rules and regulations.
