DELIVERY AND CLERICAL EMPLOYMENT IN FACTORY OFFICES AND SERVICE STORES
Although no minor under 16 may work in a factory workroom, 14 or 15 year-olds may work in delivery and clerical jobs in a factory office that is enclosed and separate from the place where manufacturing is carried on. The office must have a partition at least seven feet high, and must have an entrance that will permit the minors to enter or leave the office without passing through the factory workroom. A minor 14 or 15 year old also may work in a delivery or clerical job in a dry cleaning store, tailor shop, shoe repair shop, laundry store, hat cleaning store, and similar service stores, but he or she is not permitted to work in proximity to dangerous machinery, equipment, or process.* * Federal law requires that any delivery work for retail stores, which is performed by 14- and 15- year-olds be made on foot, by bicycle, or via bus. It also forbids them from working in a place where processing (such as laundering or dry cleaning) takes place.

Albany, NY 12234 Dear Commissioner Mills: I am pleased to approve New York's final assessment system under Title I of the Elementary and Secondary Education Act. I appreciate the actions your agency has taken to bring New York into full compliance with the 1994 Title I requirements. The Department granted New York a waiver of timeline that expired on January 31, 2002. The timeline waiver was granted to allow time for New York to modify existing school report materials to include all the disaggregated data and performance comparisons required by Title I; provide an assurance of local distribution of individual student reports; administer and report results from the Alternate Assessment and devise a method of including the results from that assessment as a measure of school progress at grades 4 and 8; and approve revisions to the Regulations of the Commissioner of Education as needed to support these changes. Please be aware that approval of New York's assessment system for Title I is not a determination that the system complies with Federal civil rights requirements, including Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, Title II of the Americans with Disabilities Act, and requirements under the Individuals with Disabilities Education Act. Finally, please remember that if you make significant changes to your assessment or accountability system, you must submit information about those changes to the Department as required by section 1111(e)(2) of Title I.

CHANGES TO THE NYSTCE PROGRAM Program Overview
The New York State Teacher Certification Examinations (NYSTCE®) address New York Education Law and Commissioner’s Regulations, which require prospective New York State teachers to pass designated tests as a requirement for receiving state certification. These tests measure a candidate’s knowledge and skills in the liberal arts and sciences, in teaching theory and practice, and in the subject matter of the candidate’s field of certification. The NYSTCE program was developed with the extensive involvement of New York State educators to meet New York State needs and specifications. The purpose of the NYSTCE program is to help ensure that teachers have the knowledge and skills important for their job in New York State public schools. The NYSTCE program includes the following tests:
  • Liberal Arts and Sciences Test (LAST) Elementary and Secondary Assessment of Teaching Skills–Written (ATS–W) Content Specialty Tests (CSTs)
Program Updating The NYSTCE program is closely linked to New York Education Law, policy, and practice. One government function is education, which is administered through the public school system by the department of education. The states, therefore, have primary responsibility for the maintenance and operation of public schools. The Federal Government also has an interest in education. The National Institute of Education was created to improve education in the United States. Each state is required by its state constitution to provide a school system whereby children may receive an education. State legislatures exercise power over schools in any manner consistent with the state's constitution. Many state legislatures delegate power over the school system to a state board of education. There is a strong concern with equality in education. Within states this leads to efforts to assure that each child no matter where he or she is situated receives an adequate education. The Equal Education Opportunities Act of 1974 provides that no state shall deny equal educational opportunity to an individual on the basis of race, color, sex, or national origin.
