A Review of the Year 2000's Transportation Cases
Part 1 (reprinted from the December 2000 issue of School Transportation News
By Peggy A. Burns, Esq. Special needs transportation, governmental immunity and bus stop selection were among the legal issues which focused directly on school transportation in the past year. The cases reviewed here are mainly state court cases and hearing officer decisions. While that means they have no binding impact on the courts of other states, nevertheless, they can be extremely instructive as to how a court might consider a particular issue. In this issue we'll review 10 cases that made it to state courts. Next month's STN will have Part II of the annual Year in Review. Special Needs Transportation
Here is a sampling of the special needs cases decided in 2000. The Office for Civil Rights considered a parent's complaint that students in a district's Moderate Intervention Programs (MIPS) were required to ride a school bus with students with severe behavioral and emotional problems. The complaint alleged that the MIPS students were denied FAPE because of the physical and verbal abuse to which they were subjected. OCR found for the parents because the district "failed to implement strategies to ensure the safety of MIPS students."

Location History Home ... email Education The Ottawa-Glandorf Local School District has two elementary buildings housing kindergarten through eighth grade, and a modern high school. The district has an enrollment of approximately 1800 students in kindergarten through twelfth grade. Ottawa-Glandorf High School presently has an enrollment of 698 students in grades 9-12. There are currently 21 credits required for graduation which is higher than the state minimum. The high school's academic program is designed for three areas: College Preparation, General Education and Vocational Education. The High School offers a total of 183 units of instruction. Ottawa-Glandorf Local School District is a member of the Millstream Career Cooperative Program which provides greater vocational selections for interested students and adults. The State of Ohio mandates passing all parts of the Ohio 9th grade proficiency tests. Each of the elementary buildings offer self-contained classrooms for grades K to 5. The sixth, seventh and eighth grades are operated with teacher specialists in each subject area. Ottawa Elementary and Glandorf Elementary currently have an enrollment of 570 and 532 respectively. All three schools offer individualized opportunities for the exceptional/handicapped child. The O-G Titan Tikes Preschool offers a developmentally appropriate, play-based curriculum. Children with special needs are integrated with typically - developing children. Currently 105 children are enrolled in the program which is housed at the Locust Street Complex.

Mary Ey: Executive Director of Educational Services and Resources - CPS Mary Ey is the Executive Director of Educational Services and Resources for the Columbus Public Schools. Her fields of expertise are Special Education with a concentration in Mental Retardation, Elementary Education, and Curriculum and Instruction. For the project, Mary Ey works closely with Dr. Thomas Stephens in the planning and administration of all project activities, the scheduling of project related activities and selects and secures project sites. She directs and oversees all project activities as they relate to CPS project personnel, as well CPS students and their parents.
Dr. Thomas M. Stephens: Principal Investigator and Project Research Director: Dr. Stephens is Research Director in the School of Education at the University of Dayton-Columbus. He has more than 40 years experience in special education and school psychology. He received his doctorate in Special Education and Rehabilitation from the University of Pittsburgh. Dr. Stephens has authored 10 textbooks, and over 125 journal articles and other papers and has served as a journal and textbook editor. Among his many publications is the acclaimed text, Social Skills in the Classroom, now in its 2nd edition. He co-authored with Dr. Kevin Arnold the 2nd edition of the Social Behavior Assessment Inventory. He is also the author of the Criterion Referenced Curriculum (Psychological Corporation), a skill-based assessment and teaching strategy for children with learning disabilities.

The law also limits the tests' use in determining whether students will be promoted to the next grade or earn a high school diploma. The new law is based on recommendations developed by Governor Bob Taft's Commission for Student Success. Last year, the Commission reported that the Ohio tests were "rushed into place before the academic standards they were meant to measure had taken hold," reports the paper.
