As transmitted yesterday in CER's Special Newswire , the Sixth Circuit Court of Appeals has set the stage for a likely U.S. Supreme Court hearing on school choice the penultimate in court cases that school choice proponents have long hoped for and anticipated. The issue in such a case would likely be focused on whether or not aid to parents for educational services (no matter whether the services are religious or non-sectarian in nature) passes the constitutional test of whether a law "respects the establishment of religion, or prohibits the free exercise thereof" - the "Establishment Clause." While there are many opinions in this matter, there is already a solid record of government funding for private services such as, for example, existing government vouchers for low-income parents to help fund daycare at private and parochial facilities. Thousands of students in higher education also use federally funded Pell grants, National Direct Student Loans and GI benefits to attend universities ranging from Notre Dame to Yeshiva University. Dispatch Staff Reporters
Arsenic levels twice the federal limit have been detected in well fields serving two Perry County schools, prompting the Ohio Environmental Protection Agency to order the schools to stop using the water for drinking and cooking. As a result, local officials are seeking construction of a 6.5-mile waterline from Thornville to provide safe water to the schools. Perry County commissioners have asked the General Assembly for emergency financial aid to begin construction of the waterline from the Northern Perry County Water Supply System in time to serve Sheridan High School and Sheridan Middle School this fall. The Ohio EPA, in a letter dated July 2, notified commissioners that routine testing this summer had detected the elevated arsenic levels in the water. A second set of testing confirmed arsenic levels averaging 98 parts per billion, said Richard Ansel, of the EPA office in Logan. Federal law mandates that arsenic in drinking water should not exceed 50 parts per billion.

The seventeenth state of the American Union, admitted on 19 Feb., 1803. It is bounded on the north by Michigan and Lake Erie, on the east by Pennsylvania and West Virginia, on the south by West Virginia and Kentucky, and on the west by Indiana. Its greatest breadth is 215 miles, and its greatest length (north to south) 210 miles; its area is 41,060 square miles. The surface is an undulating plain 450-1500 feet above sea-level. The population (1910) is 4,767,121. The agricultural output in 1908 was valued at $198,502,260; the mineral output at $134,499,335; the value of dairy products was $15,484,849; and the total value of industries $960,811,857. The railroad mileage is 9274 miles, besides 4450 miles of electric railway. Ohio profits commercially by the Ohio River in the south, connecting with the Mississippi, and by Lake Erie on the north. There are also four canals, the Miami and Erie, the Ohio, the Hocking, and the Walhonding. CIVIL HISTORY Ohio was discovered by La Salle about 1670 and formal possession of the territory including the state was taken by the French in 1671. A controversy between France and England was settled by the Treaty of Paris (1763), by which Great Britain obtained all the French dominion in the north, and west as far as the Mississippi River. In 1787 an organization known as the Ohio Company of Associates was formed in New England by a number of those who had served in the American Revolutionary War and under their negotiations a purchase of a large tract of land in the territory northwest of the Ohio River was made from the Government. This was the first public sale of land by the United States. Marietta, the first settlement, was founded on 7 April, 1787.
