Elementary and Secondary Education Act (ESEA)
The Elementary and Secondary Education Act (ESEA) is our government’s single largest investment in elementary and secondary education. It provides targeted resources to help ensure that disadvantaged students have access to a quality public education. ESEA was originally authorized in 1965 for five years and had been reauthorized every five years since. ESEA contains a number of education programs critical to children and public education including:
  • Title I (funding initiatives aimed to help disadvantaged children meet high standards) The Eisenhower Professional Development Program Education Technology Class Size Reduction Safe and Drug Free Schools Bilingual Education Indian Education (Helping Native American students achieve to high academic standards.) Exposed the Failure of Dept. of Agriculture to Effectively Regulate Animal Feeding Operations Factory Pig Farms.- Exposed Data Showing Groundwater Pollution by Nitrates We helped uncover and publicly disclose that there is widespread contamination of groundwater by nitrates associated with swine farms in the state. Nitrates in drinking water pose a health threat including blue baby syndrome. The data we based the allegations on were new sampling results from monitoring done by CAFOs, which was being “hidden” in the depths of the ODA’s files. Additional sampling to verify contamination and determine sources was begun by ODA under contract with USGS. The EPA came in to take enforcement action regarding at least one of the facilities - one well was being used by a pregnant woman as a drinking water supply. Chicken Litter Problems - Exposed Department and Poultry Operators’ Failure to Obey Law Requiring Animal Waste Management Plans (AWMPs). Data was collected from ODA files that showed that a recent legal requirement for AWMPs was not being enforced – that few poultry operators had such plans even in the watershed of Lake Eucha, Tulsa’s Water Supply which has been shown to be polluted from chicken litter and excess nutrients. Media was provided with packets including a press release and copies of pertinent information showing noncompliance. ODA responded in the newspaper by trying to defend and dispute our allegations, other LTEs published as well.

    Envirothon is the largest high school, environmental education competition in North America. The Envirothon began in 1979 when three Soil and Water Conservation Districts from Pennsylvania held local competitions called Environmental Olympics. The first National Envirothon was held in 1988 with Pennsylvania, Ohio and Massachusetts participating. Since then, the competition has grown to include 42 states and 4 Canadian provinces. Last year the Oklahoma team ranked within the top 1/3 of all participating teams.
    Envirothon is an exciting and fun way for high school students to learn about the environment. It combines in-class curriculum with hands-on field experiences, while demonstrating the role people have in important environmental issues. The Envirothon conducts a series of competitions where students are tested on five subjects: soil, aquatics, wildlife, forestry and a specific environmental issue, which changes from year to year. Winning teams from each state advance to the five-day Canon Envirothon (international) competition in July, which is held at a different location each year.

    Key child care and early education trends in state legislation include an array of financing mechanisms, basic regulatory provisions, preschool expansions and quality improvements in the form of professional development and training for providers.
    Financing
    State legislatures continued to expand financing for early childhood services in several ways in the past year. At least four states ( Iowa, Kentucky, New York and Texas ) enacted laws providing grants to programs. Some states ( California, Iowa, Kentucky and Texas ) expanded funding through local means. Several states ( Illinois, Montana, Nebraska and Oregon ) created tax credits for either parents or employers to support the care and development of young children. Legislatures in two states ( California and Iowa ) directed loan funds to improve child care services. Two state legislatures (

    In a report last year, state Vo-Tech honcho Roy Peters quoted Machiavelli on "the introduction of a new order of things." Though he was perhaps too clever by half with that revealing quotation from that particular political theorist, Peters definitely knows whereof he speaks. For right under our noses he and others are implementing "a new order of things" in Oklahoma, a complete restructuring of the state's public education system. Though it's sometimes difficult to see this restructuring forest for all the trees (HB 1017, PASS, Goals 2000, School-to-Work, block scheduling, et al), various state and federal documents unashamedly tell the story. If one can trudge through the tortured bureaucratic prose, the TQM flumdiddle, and the suffocating educational puffery, one discovers that public education is indeed undergoing "comprehensive" and "systemic" change. Why? The re-inventors believe traditional education is no longer adequate. Observing the sorry state of public education, they realize that, in Richard Riley's words, "the dumbing down of American education must end." What they don't understand is that the problem has not been traditional education, but rather their steady abandonment of it (Whole Language and its attendant illiteracy being the classic example).

    The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
    There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.
