§21-886 Crime Against Nature Any person who is guilty of the detestable and abominable crime against nature, committed with mankind or with a beast, shall be guilty of a felony punishable by imprisonment in the State Penitentiary for a period of not more than twenty (20) years. Any person convicted of a second violation of this section, where the victim of the second offense is a person under sixteen (16) years of age, shall not be eligible for probation, suspended or deferred sentence. Any person convicted of a third or subsequent violation of this section, where the victim of the third or subsequent offense is a person under sixteen (16) years of age, shall be punished by imprisonment in the State Penitentiary for a term of life or life without parole, in the discretion of the jury, or in case the jury fails or refuses to fix punishment then the same shall be pronounced by the court. Article 2 (Gambling Offenses) in Chapter 66 (Offenses Against Public Health and Decency) states that it is an offense to engage in unlawful gambling, BUT that it is an "affirmative defense" to prosecution for the person to claim having been part of a "social game".
A "social game" is defined as gambling in a home where no house player (barring Home Craps and other home casino games), no house bank, and no house odds exist, and where there is no house income (rake) from the operation of the game. No House and no rake means that home gambling is a defense against unlawful gambling, and legal in the state of Alaska.

Law Cyberstalking US State Laws US State Laws The first state in America to pass laws specifically addressing real life stalking was California in 1990. Until this change in the law the Police were powerless to act unless the target was actually physically attacked. Since then almost every state in the USA has passed legislation making stalking a criminal offense. Old habits die hard however, and many contemporary stalking victims in America are still told that nothing can be done unless a physical assault takes place. The California laws against stalking passed in 1990 did not specifically address online stalking. Nevertheless it is useful to review them in relation to the Internet as a starting point for any discussion of cyberstalking and the law. The California Penal Code [ Section 646.9. Stalking. 1990 (Amended 1994) ] defines the crime of stalking as follows: Any person who willfully, maliciously, and repeatedly follows or harasses another person and who makes a credible threat with the intent to place that person in reasonable fear for his or her safety... is guilty of the crime of stalking

Technically., the distinction between a "legal" and a "factual" impossibility is articulated with facility. A "factual" impossibility exists where facts present at the time of the attempt, but unknown to the actor, render the consummation of the intended substantive crime impossible. Booth v. State , 398 P.2d 863 (Okl. Cr. 1964). Common examples of this variety of impossibility include: attempting to perform an abortion on a woman who is not pregnant, People v. Report on Federal Law Enforcement Wants to Reverse Federalization Trend
st Century. It submitted its report to Congress last month. While finding that federal law-enforcement agencies are among the finest in the world, the commission believes that several challenges threaten law enforcement's capacity to maintain and improve its system. It concluded that better coordination of law-enforcement operations and some consolidation of agencies is necessary; additional resources are required to combat terrorism; law enforcement needs to focus and coordinate its attack on global crime to match the sophistication of the drug cartels; and agency professionalism, integrity and accountability can be improved. Of particular interest to the Judiciary was the finding that the growth in the number of crimes considered federal is "startling," warning that if the trend continues, "the United States will develop the type of national police force that we have traditionally avoided." The commission said that "nearly 200 years of additions and revisions to the Federal Criminal Code have created an unwieldy and complex body of law, riddled with overlap, redundancy, inconsistencies, and unnecessary accretions." This situation "threatens to overwhelm federal law-enforcement capacities, just as dramatic and serious new law enforcement challenges grow in intensity." Steps must be taken to repair the damage to the law enforcement community at the federal, state and local levels caused by federalization of common crime.
