61. Oregon Department Of Education's Complaint System: Why Isn't It Working

At the press conference, no television station chose to send its reporters. The only media representative was Steven Carter of the Oregonian. His story covering the conference followed the saga of a single family in Oregon whose complaint history is extensively referenced in the OAC report. His article also summarized the findings of the report. Mr. Carter made no mention in his article of either OPU or FEAT, who provided the parents who spoke at the table. No quotes from FEAT or OPU spokespersons made their way into his article. At the press conference, Mary Broadhurst, one of three Special Education Law parent attorneys referenced in the national EDLAW list of parent attorneys, appeared on behalf of her clients, the Millers, who the Oregonian article featured. Ms. Broadhurst also announced the filing of a class action lawsuit against the Oregon Department of Education on substantially the same grounds outlined in the OAC report. Oregon's constitution prohibits state appropriations for the benefit of any religious institution. Ore. Const. Art. 1, Sec. 5. Registration/Licensing/Accreditation: Private schools must be approved for the public placement of students for special education services. OAR 581-15-126. Recordkeeping/Reports: Length of School Year/Day: Instruction in English: Teacher Certification: Teachers at registered private schools may demonstrate their qualifications by: 1) possessing a current teaching license; 2) teaching at least half time in the subject field in which the bachelor's degree was obtained while actively working toward an Oregon teaching certificate; or 3) possess relevant verifiable experience consistent with the educational goals of the school and the Department of Education. Or. Admin. R. 581-45-530. Curriculum: See Safety Fire and Earthquake Instruction. Special Education: School districts must make available special education designed to meet the needs of resident handicapped children in private schools. Such special education must not be provided in the private school. School districts must provide such children with genuine opportunities for equitable participation in special education consistent with the number of children and their needs. Or. Admin. R. 581-15-166 (1978). Private educational agencies furnishing special education to handicapped children pursuant to a contract with a public agency must have on file with the Oregon Department of Education a plan approved for the special education programs. The plan must 1) describe the population to be served and the instructional services to be provided; 2) include a staff roster indicating name, instructional qualification, and assignment of all special education personnel employed by the private educational agency; 3) describe facilities, equipment and materials to be furnished and utilized; 4) document compliance with state and local health, fire and safety standards; and 4) meet additional minimum standards set out by regulation. Or. Admin. R. 581-15-126 (1978).

The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.

MCLE Reporting Membership Fees Sitemap ... MCLE Rules Minimum Continuing Legal Education The Minimum Continuing Legal Education Rules are adopted by the Oregon Supreme Court. The MCLE program is administered for the court by the OSB Board of Governors, which appoints the MCLE Committee and operates the MCLE Department. The MCLE rules require that all regular active members complete 45 hours of approved continuing legal education activities in each 3-year reporting period. Of those hours, six (6) must be on the subject of legal ethics or professionalism; one of the six ethics hours must be on lawyers' child abuse reporting obligations. Beginning with the reporting period that ends in 2004, three of the general hours must be on "other aspects of professional responsibility," which is defined as "courses pertaining to the role of lawyers concerning racial and ethnic issues, gender fairness, disability issues, and access to justice."
