(AP) The Supreme Court said Monday it will decide whether to force states to evaluate cases individually before listing former sex offenders on registries meant to help people keep tabs on offenders living or working nearby. The court's ruling on "Megan's laws" in more than 20 states could mean separate hearings to determine the risk posed by a sex criminal who has completed a prison sentence. Each state has some form of sex offender registry named for the New Jersey child kidnapped, raped and killed in 1994 by a convicted sex offender who had moved in across the street. Her parents knew nothing of his history. The Bush administration sided with Connecticut, as did each of the other states with similar laws, in asking the Supreme Court to restore or preserve public access to information about former sex offenders.

Another term commonly used when this activity is "bias crime." When this behavior actually violates a criminal statute or law, it is a "hate crime". "No matter how laudable the goals of the Legislature are, there is a right to a fair procedure when the power of the government is used to burden and penalize citizens," U.S. District Judge Victoria Roberts ruled Monday. "This is true even when the citizens are convicted sex offenders." State officials could not be reached to find out whether they plan to appeal the decision and when they might shut down the Internet site. The ruling came less than two weeks after the U.S. Supreme Court agreed to review a case in Connecticut, which has a sex offender registry similar to that in Michigan and more than 20 other states. "I'm elated, overjoyed and thankful for my attorney and grateful for Judge Roberts taking a positive stand on this issue," Daniel Fullmer, 32, of Royal Oak, said after Roberts granted his motion for summary judgment in his lawsuit against the Michigan State Police.

Under current Michigan law, once an individual qualifies to be listed on the sex offender registry, there is no way for them to be removed. The basis for the judgment, according to the Free Press, was that the law does not allow a process for those listed to challenge the assumption that they are a danger to society. The case was brought by Daniel Fullmer, a former state corrections officer, who pleaded "no contest" when officials charged him with having consensual sex with a female inmate. The charge, fourth-degree criminal sexual conduct, is considered a misdemeanor. Fullmer reportedly filed the suit because a neighbor believed he was a pedophile based on his appearance on the Michigan sex offender list.
