Recognition of qualifications: six Member States to be referred to Court The European Commission has decided to refer six Member States to the Court of Justice for failure to comply with Community legislation on the recognition of qualifications and the right of establishment. The case against Germany concerns the non-conformity of its legislation on the use of academic titles obtained in another Member State. Cases are to be brought against France, Spain and Italy for failure to implement aspects of European legislation on the mutual recognition of qualifications in certain professional fields. Lastly, cases are to be brought against Luxembourg and the Netherlands for failure to notify the Commission of national measures to transpose Directive 98/5/EC on the right of establishment of lawyers. Germany - university qualifications
The Commission has decided to bring an action against Germany before the Court of Justice for imposing restrictions on the right to use, on its territory, academic titles awarded in the context of an exchange agreement between a university in one Member State and an educational establishment in another. The Commission considers that these restrictions contravene the rules of the EC Treaty on the freedom to provide services (Articles 49 and 50).

The first part of this questionnaire gathers basic information about job titles and terms of employment which, when combined with the compensation and personal background characteristics, provides a foundation for analysis of variations in wage levels for these categories of personnel. This will help us sort out the differences in wage rates due to experience, background training, and regional factors that affect variations in compensation across the U.S. Section IV of the special education teacher and related service provider questionnaire also provides information on how professional staff spend their non-contact time-that is, the time spent on activities other than direct service. These data will help us determine how much time is spent on pre-referral, assessment, evaluation, and development of IEPs (individual educational programs). October 2001 A new goal is challenging teachers: All students, with or without disabilities, including English language learners and students who are "falling between the cracks," are to achieve in the general education curriculum. For students with disabilities, access to the general education curriculum is mandated by the Individuals with Disabilities Education Act Amendments of 1997 (IDEA '97). Attitudes and Belief Systems Improved student learning requires teachers, schools, and districts to give up unproductive traditions and beliefs, replacing them with validated practices and a full understanding of the intent of the law. Successful student access to the general education curriculum is most likely when there is general acceptance of the following principles:
  • Responsibility for the learning outcomes of special education students is equally shared by the classroom teacher and the special education teacher.

In testimony prepared for and submitted to the President's Commission on Excellence in Special Education, NEA stated, "In addition to a civil rights issue, the delivery of special education is an education policy issue. Given that IDEA '97 has just begun to show its impact, we suggest few statutory changes during this reauthorization process.      Structuring learning environments to promote the inclusion of learners with disabilities is an important responsibility that educators in general and special education share. The physical placement of students with disabilities in general education classes is often overemphasized, while other aspects of developing inclusive environments are neglected. This article describes defining principles of inclusive education and provides important questions to ask in determining whether inclusive environments demonstrate these principles. This article also includes practical strategies for assisting educators in creating educational environments that manifest the defining principles of inclusion.

      English Language Learners With Special Needs: Effective Instructional Strategies

      Students fail in school for a variety of reasons. In some cases, their academic difficulties can be directly attributed to deficiencies in the teaching and learning environment. For example, students with limited English may fail because they do not have access to effective bilingual or English as a second language (ESL) instruction. Students from lower socioeconomic backgrounds may have difficulty if instruction presumes middle-class experiences. Other students may have learning difficulties stemming from linguistic or cultural differences. These difficulties may become more serious over time if instruction is not modified to address the students' specific needs. Unless these students receive appropriate intervention, they will continue to struggle, and the gap between their achievement and that of their peers will widen over time. Improving the academic performance of students who from non-English backgrounds requires a focus on the prevention of failure and on early intervention for struggling learners. This digest presents a framework for meeting the needs of these students in general education and suggests ways to operationalize prevention and early intervention to ensure that students meet their academic potential.

      Introduction
      Several factors influence the identification of English language learners with special needs. Limited prior schooling, lack of proficiency in English, native language background, cultural expectations, and personal or family concerns can all influence a learner’s academic progress. It can be difficult to distinguish between a learning disability and learning problems caused by a variety of other factors. English language learners whose difficulties in school stem from these factors may be misidentified as having a learning disability. In other cases, English language learners who have a learning disability may not be properly identified on the assumption that their learning problems stem from linguistic and cultural differences. To further complicate matters, special needs may not have been identified in the learner's native language but may become evident as the student is learning English.
      Identification
      Traditional identification instruments designed for English speakers may not be valid with English language learners. Identification of English language learners with special needs should include consideration of the following factors:
